حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، حَدَّثَنَا شُعْبَةُ. ح وحَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا وَكِيعُ بْنُ الْجَرَّاحِ، عَنْ سُفْيَانَجَمِيعًا، عَنْ ابْنِ الْأَصْبَهَانِيِّ، عَنْ مُجَاهِدِ بْنِ وَرْدَانَ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ مَوْلًى لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَاتَ وَتَرَكَ شَيْئًا وَلَمْ يَدَعْ وَلَدًا وَلَا حَمِيمًا، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَعْطُوا مِيرَاثَهُ رَجُلًا مِنْ أَهْلِ قَرْيَتِهِ ، قَالَ أَبُو دَاوُد: وَحَدِيثُ سُفْيَانَ أَتَمُّ، وقَالَ مُسَدَّدٌ: قَالَ: فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: هَاهُنَا أَحَدٌ مَنْ أَهْلِ أَرْضِهِ، قَالُوا: نَعَمْ قَالَ: فَأَعْطُوهُ مِيرَاثَهُ .
ام المؤمنین عائشہ رضی اللہ عنہا فرماتی ہیں کہ رسول اللہ صلی اللہ علیہ وسلم کا ایک غلام مر گیا، کچھ مال چھوڑ گیا اور کوئی وارث نہ چھوڑ ا، نہ کوئی اولاد، اور نہ کوئی عزیز، تو نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: اس کا ترکہ اس کی بستی کے کسی آدمی کو دے دو ۱؎۔ ابوداؤد کہتے ہیں: سفیان کی روایت سب سے زیادہ کامل ہے، مسدد کی روایت میں ہے: نبی اکرم صلی اللہ علیہ وسلم نے پوچھا: یہاں کوئی اس کا ہم وطن ہے؟ لوگوں نے کہا: ہاں ہے، آپ صلی اللہ علیہ وسلم نے فرمایا: اس کا ترکہ اس کو دے دو ۔
Narrated Aishah, Ummul Muminin: A client of the Prophet صلی اللہ علیہ وسلم died and left some property, but he left no child or relative. The Messenger of Allah صلی اللہ علیہ وسلم said: Give what he has left to a man belonging to his village. Abu Dawud said: The tradition of Sufyan is more perfect. Musaddad said: Thereupon the Prophet صلی اللہ علیہ وسلم said: Is there anyone belonging to his land ? They replied: Yes. He said: Then give him what he has left.

Narrated Jabir ibn Abdullah: I fell ill, and I had seven sisters. The Messenger of Allah صلی اللہ علیہ وسلم came to me and blew on my face. So I became conscious. I said: Messenger of Allah, may I not bequeath one-third of my property to my sisters? He replied: Do good. I asked: Half? He replied: Do good. He then went out and left me, and said: I do not think, Jabir, you will die of this disease. Allah has revealed (verses) and described the share of your sisters. He appointed two-thirds for them. Jabir used to say: This verse was revealed about me: They ask thee for a legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs.
