حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، فِي آخَرِينَ قَالُوا: حَدَّثَنَا حَمَّادٌ، عَنْ بُدَيْلٍ يَعْنِي ابْنَ مَيْسَرَةَ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنْرَاشِدِ بْنِ سَعْدٍ، عَنْ أَبِي عَامِرٍ الْهَوْزَنِيِّ، عَنْ الْمِقْدَامِ الْكِنْدِيِّ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ، فَمَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَيَّ، وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَأَنَا مَوْلَى مَنْ لَا مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُّ عَانَهُ، وَالْخَالُ مَوْلَى مَنْ لَا مَوْلَى لَهُ يَرِثُ مَالَهُ وَيَفُكُّ عَانَهُ ، قَالَ أَبُو دَاوُد، رَوَاهُ الزُّبَيْدِيُّ، عَنْ رَاشِدِ بْنِ سَعْدٍ، عَنْ ابْنِ عَائِذٍ، عَنْ الْمِقْدَامِ، وَرَوَاهُ مُعَاوِيَةُ بْنُ صَالِحٍ، عَنْ رَاشِدٍ، قَالَ: سَمِعْتُ الْمِقْدَامَ، قَالَ أَبُو دَاوُد: يَقُولُ الضَّيْعَةُ مَعْنَاهُ عِيَالٌ.
مقدام کندی رضی اللہ عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: میں ہر مسلمان سے اس کی ذات کی نسبت قریب تر ہوں، جو کوئی اپنے ذمہ قرض چھوڑ جائے یا عیال چھوڑ جائے تو اس کا قرض ادا کرنا یا اس کے عیال کی پرورش کرنا میرے ذمہ ہے، اور جو کوئی مال چھوڑ جائے تو وہ اس کے وارثوں کا حق ہے، اور جس کا کوئی والی نہیں اس کا والی میں ہوں، میں اس کے مال کا وارث ہوں گا، اور میں اس کے قیدیوں کو چھڑاؤں گا، اور جس کا کوئی والی نہیں، اس کا ماموں اس کا والی ہے ( یہ ) اس کے مال کا وارث ہو گا اور اس کے قیدیوں کو چھڑائے گا ۔ ابوداؤد کہتے ہیں: اس روایت کو زبیدی نے راشد بن سعد سے، راشد نے ابن عائذ سے، ابن عائذ نے مقدام سے روایت کیا ہے اور اسے معاویہ بن صالح نے راشد سے روایت کیا ہے اس میں «عن المقدام» کے بجائے «سمعت المقدام» ہے۔ ابوداؤد کہتے ہیں: «ضيعة» کے معنی «عیال» کے ہیں۔
Narrated Al-Miqdam al-Kindi: The Prophet صلی اللہ علیہ وسلم said: I am nearer to every believer than himself, so if anyone leaves a debt or a helpless family, I shall be responsible, but if anyone leaves property, it goes to his heirs. I am patron of him who has none, inheriting his property and freeing him from his liabilities. A maternal uncle is patron of him who has none, inheriting his property and freeing him from his liabilities. Abu Dawud said: da'iah means dependants or helpless family. Abu Dawud said: This tradition has been transmitted by al-Zubaidi from Rashid bin Saad from Ibn 'A'idh on the authority of al-Miqdam. It has also been transmitted by Muawiyah bin Salih from Rashid who said: I heard al-Miqdam (say).

Narrated Jabir ibn Abdullah: I fell ill, and I had seven sisters. The Messenger of Allah صلی اللہ علیہ وسلم came to me and blew on my face. So I became conscious. I said: Messenger of Allah, may I not bequeath one-third of my property to my sisters? He replied: Do good. I asked: Half? He replied: Do good. He then went out and left me, and said: I do not think, Jabir, you will die of this disease. Allah has revealed (verses) and described the share of your sisters. He appointed two-thirds for them. Jabir used to say: This verse was revealed about me: They ask thee for a legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs.

He replied: The verse revealed in summer is sufficient for you. I asked Abu Ishaq: Does it mean a person who dies and leaves neither children nor father? He said: This is so. The people think it is so.
