حَدَّثَنَا حَفْصُ بْنُ عُمَرَ، حَدَّثَنَا شُعْبَةُ، عَنْ بُدَيْلٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنْ رَاشِدِ بْنِ سَعْدٍ، عَنْ أَبِي عَامِرٍ الْهَوْزَنِيِّ عَبْدِ اللَّهِ بْنِ لُحَيٍّ، عَنْ الْمِقْدَامِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: مَنْ تَرَكَ كَلًّا فَإِلَيَّ، وَرُبَّمَا قَالَ إِلَى اللَّهِ وَإِلَى رَسُولِهِ، وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَأَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ أَعْقِلُ لَهُ وَأَرِثُهُ وَالْخَالُ وَارِثُ، مَنْ لَا وَارِثَ لَهُ يَعْقِلُ عَنْهُ وَيَرِثُهُ .
مقدام رضی اللہ عنہ کہتے ہیں رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: جو شخص بوجھ ( قرضہ یا بال بچے ) چھوڑ جائے تو وہ میری طرف ہے، اور کبھی راوی نے کہا اللہ اور اس کے رسول کی طرف ہے ۲؎ اور جو مال چھوڑ جائے تو وہ اس کے وارثوں کا ہے، اور جس کا کوئی وارث نہیں اس کا میں وارث ہوں، میں اس کی طرف سے دیت دوں گا اور اس شخص کا ترکہ لوں گا، ایسے ہی ماموں اس کا وارث ہے جس کا کوئی وارث نہیں وہ اس کی دیت دے گا اور اس کا وارث ہو گا۔
Narrated Al-Miqdam al-Kindi: The Prophet صلی اللہ علیہ وسلم said: If anyone leaves a debt or a helpless family I shall be responsible-and sometimes the narrator said: Allah and His Messenger will be responsible-but if anyone leaves property, it goes to his heirs. I am the heirs of him who has none, paying blood-wit for him and inheriting from him; and a maternal uncle is the heir of him who has none, paying blood-wit for him and inheriting from him.

Narrated Jabir ibn Abdullah: I fell ill, and I had seven sisters. The Messenger of Allah صلی اللہ علیہ وسلم came to me and blew on my face. So I became conscious. I said: Messenger of Allah, may I not bequeath one-third of my property to my sisters? He replied: Do good. I asked: Half? He replied: Do good. He then went out and left me, and said: I do not think, Jabir, you will die of this disease. Allah has revealed (verses) and described the share of your sisters. He appointed two-thirds for them. Jabir used to say: This verse was revealed about me: They ask thee for a legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs.

Narrated Al-Bara ibn Azib: A man came to the Prophet صلی اللہ علیہ وسلم and said: Messenger of Allah, they ask thee for a legal decision about a kalalah. What is meant by kalalah? He replied: The verse revealed in summer is sufficient for you. I asked Abu Ishaq: Does it mean a person who dies and leaves neither children nor father? He said: This is so. The people think it is so.
