قَالَ الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ: عَنِ ابْنِ وَهْبٍ، قَالَ: أَخْبَرَنِي أَبُو خُزَيْمَةَ عَبْدُ اللَّهِ بْنُ طَرِيفٍ، عَنْعَبْدِ الْكَرِيمِ بْنِ الْحَارِثِ، عَنِ ابْنِ شِهَابٍ، أَنَّ رَافِعَ بْنَ خَدِيجٍ، قَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ كِرَاءِ الْأَرْضِ ابْنُ شِهَابٍ: فَسُئِلَ رَافِعٌ بَعْدَ ذَلِكَ: كَيْفَ كَانُوا يُكْرُونَ الْأَرْضَ ؟، قَالَ: بِشَيْءٍ مِنَ الطَّعَامِ مُسَمًّى، وَيُشْتَرَطُ أَنَّ لَنَا مَا تُنْبِتُ مَاذِيَانَاتُ الْأَرْضِ وَأَقْبَالُ الْجَدَاوِلِ . رَوَاهُ نَافِعٌ، عَنْ رَافِعِ بْنِ خَدِيجٍ وَاخْتُلِفَ عَلَيْهِ فِيهِ.
۱؎: یعنی شعیب کی موافقت کی ہے اور یہ موافقت اس طرح ہے کہ زھری اور رافع کے درمیان سالم کا ذکر نہیں ہے جب کہ مالک اور عقیل نے سالم کا ذکر کیا ہے ۔شرافع بن خدیج رضی اللہ عنہ نے کہا: رسول اللہ صلی اللہ علیہ وسلم نے زمین کرائے پر دینے سے منع فرمایا۔ زہری کہتے ہیں: اس کے بعد رافع رضی اللہ عنہ سے پوچھا گیا: وہ لوگ زمین کو کرائے پر کیوں کر اٹھاتے تھے؟ وہ بولے: غلے کی متعینہ مقدار کے بدلے میں اور اس بات کی شرط ہوتی تھی کہ ہمارے لیے وہ بھی ہو گا جو زمین میں کیاریوں اور نالیوں پر پیدا ہوتا ہے۔ اسے نافع نے بھی رافع بن خدیج رضی اللہ عنہ سے روایت کیا ہے اور اس کی روایت میں ان کے شاگردوں میں اختلاف ہوا ہے۔
It was narrated from Ibn Shihab that Rafi bin Khadij said: The Messenger of Allah forbade leasing land. Ibn Shihab said: Rafi was asked after that: 'How did they lease land?' He said: 'In return for a set amount of food (produce), and it was stipulated that we would have whatever grew on the banks of the streams and springs.'

He said: 'Do not hold me to account for what has passed.'
