أَخْبَرَنَا إِسْمَاعِيل بْنُ مَسْعُودٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، ‏‏‏‏‏‏عَنْ سَعِيدٍ، ‏‏‏‏‏‏عَنْ يَعْلَى بْنِ حَكِيمٍ، ‏‏‏‏‏‏عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، ‏‏‏‏‏‏أَنَّ رَافِعَ بْنَ خَدِيجٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ كُنَّا نُحَاقِلُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ،‏‏‏‏ فَزَعَمَ أَنَّ بَعْضَ عُمُومَتِهِ أَتَاهُ،‏‏‏‏ فَقَالَ:‏‏‏‏ نَهَانِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ أَمْرٍ كَانَ لَنَا نَافِعًا وَطَوَاعِيَةُ اللَّهِ وَرَسُولِهِ أَنْفَعُ لَنَا، ‏‏‏‏‏‏قُلْنَا:‏‏‏‏ وَمَا ذَاكَ ؟ قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا، ‏‏‏‏‏‏أَوْ لِيُزْرِعْهَا أَخَاهُ، ‏‏‏‏‏‏وَلَا يُكَارِيهَا بِثُلُثٍ، ‏‏‏‏‏‏وَلَا رُبُعٍ، ‏‏‏‏‏‏وَلَا طَعَامٍ مُسَمًّى . رَوَاهُ حَنْظَلَةُ بْنُ قَيْسٍ، ‏‏‏‏‏‏عَنْ رَافِعٍ فَاخْتَلَفَ عَلَى رَبِيعَةَ فِي رِوَايَتِهِ.

رافع بن خدیج رضی اللہ عنہ کہتے ہیں کہ   ہم رسول اللہ صلی اللہ علیہ وسلم کے زمانے میں بٹائی کا معاملہ کرتے تھے، پھر کہتے ہیں کہ ان کے ایک چچا ان کے پاس آئے اور بولے: مجھے رسول اللہ صلی اللہ علیہ وسلم نے ایک ایسی چیز سے روک دیا ہے جو ہمارے لیے نفع بخش اور مفید تھی لیکن اللہ اور اس کے رسول کی اطاعت ہمارے لیے زیادہ نفع بخش اور مفید ہے۔ ہم نے کہا: وہ کیا چیز ہے؟ کہا: رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ہے:  جس کی کوئی زمین ہو تو وہ اس میں کھیتی کرے یا اسے اپنے بھائی کو کھیتی کرنے کے لیے  ( بلا کرایہ )  دیدے، لیکن اسے تہائی، چوتھائی اور معینہ مقدار غلہ کے بدلے کرائے پر نہ دے ۔ اسے حنظلہ بن قیس نے بھی رافع رضی اللہ عنہ سے روایت کیا ہے اور  ( حنظلہ سے روایت کرنے والے )  ربیعہ کے تلامذہ نے ربیعہ سے روایت کرنے میں اختلاف کیا ہے۔

It was narrated that Rafi' bin Khadij said: We used to lease land on the basis of Al-Muhaqalah during the time of the Messenger of Allah. He said that one of his paternal uncles came to them and said: The Messenger of Allah has forbidden me to do something that was beneficial for us, but obedience to Allah and His Messenger is more beneficial. We said: What is that? He said: The Messenger of Allah said: 'Whoever has land, let him cultivate it (himself) or give it to his brother to cultivate, and not lease it in return for one-third or one-quarter of the yield nor a specified amount of food (produce).'

It was narrated from Hammad and Qatadah, concerning a man who said to another man: I will lease (something) from you until I reach Makkah for such and such a payment, and if I travel for a month or such and such -something that he named- I will give you such and such in addition. They did not see anything wrong with that, but they did not like it if he said: If I travel for more than a month I will deduct such and such from your lease.

Hadith 3892

It was narrated that Ibn Juraij said: I said to 'Ata': 'What if I hire a slave for a year in return for his food, and for another year, in return for such and such?' He said: 'There is nothing wrong with that, and you may stipulate your conditions of hiring even for a few days.' 'How about if I make a deal to hire him when part of the year has passed?' He said: 'Do not hold me to account for what has passed.'
