أَخْبَرَنَا قُتَيْبَةُ، قَالَ: حَدَّثَنَا أَبُو الْأَحْوَصِ، عَنْ طَارِقٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْمُحَاقَلَةِ، وَالْمُزَابَنَةِ، وَقَالَ: إِنَّمَا يَزْرَعُ ثَلَاثَةٌ رَجُلٌ لَهُ أَرْضٌ فَهُوَ يَزْرَعُهَا أَوْ رَجُلٌ مُنِحَ أَرْضًا فَهُوَ يَزْرَعُ مَا مُنِحَ، أَوْ رَجُلٌ اسْتَكْرَى أَرْضًا بِذَهَبٍ أَوْ فِضَّةٍ . مَيَّزَهُ إِسْرَائِيلُ، عَنْ طَارِقٍ، فَأَرْسَلَ الْكَلَامَ الْأَوَّلَ، وَجَعَلَ الْأَخِيرَ مِنْ قَوْلِ سَعِيدٍ.
رافع بن خدیج رضی اللہ عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے بیع محاقلہ اور مزابنہ سے منع فرمایا ہے۔ ۱؎ اور فرمایا: کھیتی تین طرح کے لوگ کرتے ہیں: ایک وہ شخص جس کی اپنی ذاتی زمین ہو تو وہ اس میں کھیتی کرتا ہے، دوسرا وہ شخص جسے عاریۃً ( بلامعاوضہ ) زمین دے دی گئی ہو تو وہ دی ہوئی زمین میں کھیتی کرتا ہے۔ تیسرا وہ شخص جس نے سونا چاندی ( نقد ) دے کر زمین کرایہ پر لی ہو ۔ اس حدیث کو اسرائیل نے طارق سے روایت کرتے ہوئے دونوں ٹکڑوں کو الگ الگ کر دیا ہے، پہلے ٹکڑے ۲؎ کو مرسلاً ( بطور کلام نبی اکرم صلی اللہ علیہ وسلم ) روایت کیا اور دوسرے ٹکڑے کو سعید بن مسیب کا قول بتایا ہے۔
It was narrated that Rafi' bin Khadij said: The Messenger of Allah forbade Al-Muhaqalah and Al-Muzabanah, and said: 'Only three may cultivate: A man who has land which he cultivates; a man who was given some land and cultivates what he was given; and a man who takes land on lease for gold or silver.'
