أَخْبَرَنَا كَثِيرُ بْنُ عُبَيْدٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ حَدَّثَنَا مُحَمَّدُ بْنُ حَرْبٍ، ‏‏‏‏‏‏عَنْ الزُّبَيْدِيِّ، ‏‏‏‏‏‏عَنْ الزُّهْرِيِّ، ‏‏‏‏‏‏عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، ‏‏‏‏‏‏أَنَّ عَبْدَ اللَّهِ بْنَ عُتْبَةَ كَتَبَ إِلَى عُمَرَ بْنِ عَبْدِ اللَّهِ بْنِ الْأَرْقَمِ الزُّهْرِيِّ:‏‏‏‏ أَنِ ادْخُلْ عَلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ الْأَسْلَمِيَّةِ، ‏‏‏‏‏‏فَاسْأَلْهَا عَمَّا أَفْتَاهَا بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي حَمْلِهَا، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَدَخَلَ عَلَيْهَا عُمَرُ بْنُ عَبْدِ اللَّهِ، ‏‏‏‏‏‏فَسَأَلَهَا، ‏‏‏‏‏‏فَأَخْبَرَتْهُ:‏‏‏‏ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ بْنِ خَوْلَةَ، ‏‏‏‏‏‏وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِمَّنْ شَهِدَ بَدْرًا، ‏‏‏‏‏‏فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ، ‏‏‏‏‏‏فَوَلَدَتْ قَبْلَ أَنْ تَمْضِيَ لَهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا مِنْ وَفَاةِ زَوْجِهَا، ‏‏‏‏‏‏فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا، ‏‏‏‏‏‏دَخَلَ عَلَيْهَا أَبُو السَّنَابِلِ رَجُلٌ مِنْ بَنِي عَبْدِ الدَّارِ، ‏‏‏‏‏‏فَرَآهَا مُتَجَمِّلَةً، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ لَعَلَّكِ تُرِيدِينَ النِّكَاحَ قَبْلَ أَنْ تَمُرَّ عَلَيْكِ أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ فَلَمَّا سَمِعْتُ ذَلِكَ مِنْ أَبِي السَّنَابِلِ، ‏‏‏‏‏‏جِئْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَحَدَّثْتُهُ حَدِيثِي، ‏‏‏‏‏‏فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ قَدْ حَلَلْتِ حِينَ وَضَعْتِ حَمْلَكِ .

عبیداللہ بن عبداللہ سے روایت ہے کہ   عبداللہ بن عتبہ نے عمر بن عبداللہ بن ارقم زہری کو لکھا کہ تم سبیعہ بنت الحارث اسلمی رضی اللہ عنہا کے پاس جاؤ اور ان سے پوچھو کہ رسول اللہ صلی اللہ علیہ وسلم نے ان کے حمل کے سلسلے میں انہیں کیا فتویٰ دیا تھا؟ عبیداللہ بن عبداللہ کہتے ہیں ( اس خط کے بعد ) عمر بن عبداللہ نے سبیعہ رضی اللہ عنہا کے پاس جا کر ان سے پوچھا تو انہوں نے انہیں بتایا کہ وہ سعد بن خولہ رضی اللہ عنہ کی بیوی تھیں اور وہ رسول اللہ صلی اللہ علیہ وسلم کے ان صحابہ میں سے تھے جو غزوہ بدر میں شریک تھے، وہ حجۃ الوداع میں وفات پا گئے اور شوہر کی وفات سے لے کر چار مہینہ دس دن پورا ہونے سے پہلے ہی ان کے یہاں بچہ پیدا ہو گیا، پھر جب وہ نفاس سے فارغ ہو گئیں تو بنو عبدالدار کے ایک شخص ابوالسنابل رضی اللہ عنہ ان کے پاس آئے اور انہیں زیب و زینت میں دیکھا تو کہا ( عدت کے ) چار ماہ دس دن پورا ہونے سے پہلے ہی غالباً تم شادی کرنے کا ارادہ کر رہی ہو؟ وہ ( سبیعہ ) کہتی ہیں: جب میں نے ابوالسنابل سے یہ بات سنی تو میں رسول اللہ صلی اللہ علیہ وسلم کے پاس آئی، میں نے آپ کو اپنی ( اور ان کی ) بات چیت بتائی۔ آپ نے فرمایا: ”تم تو اسی وقت سے حلال ہو گئی ہو جب تم نے بچہ جنا“ ۱؎۔

It was narrated from 'Ubaidullah bin 'Abdullah that 'Abdullah bin 'Utbah wrote to 'Umar bin 'Abdullah bin Al-Arqam Az-Zuhri, telling him: Go to Subai'ah bint Al-Harith Al-Aslamiyyah, and ask her about the ruling of the Messenger of Allah concerning her pregnancy. He said: So 'Umar bin 'Abdullah went to her and asked her. She told him that she was married to Sa'd bin Khawlah, who was one of the Companions of the Messenger of Allah who had been present at Badr. He died during the Farewell Pilgrimage, and she gave birth before four months and ten days had passed since her husband's death. When her Nifas ended, Abu As-Sanabil -a man from Banu 'Abd Ad-Dar- went to her and saw that she had adorned herself. He said: 'Perhaps you want to get married before four months and ten days has passed?' She said: 'When I heard that from Abu As-Sanabil, I went to the Messenger of Allah and told him my story. The Messenger of Allah said: 'It is permissible for you to marry when you gave birth.''

Hadith 3418

Nafi' narrated from 'Abdullah, that he divorced his wife while she was menstruating. 'Umar asked the Messenger of Allah about that and said: Abdullah has divorced his wife while she was menstruating. He said: Tell 'Abdullah to take her back, then leave her until she becomes pure from this menstrual period, then menstruates again, then when she becomes pure again, if he wishes he may separate from her before having intercourse with her, or if he wishes he may keep her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

Hadith 3419

It was narrated from Ibn 'Umar that he divorced his wife while she was menstruating, during the time of the Messenger of Allah. 'Umar bin Al-Khattab, may Allah be pleased with him, asked the Messenger of Allah about that, and the Messenger of Allah said: Tell him to take her back and keep her until she becomes pure, then menstruates again and becomes pure again. Then if he wishes he may keep her, or if he wishes, he may divorce her before he touches (has intercourse with) her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

Hadith 3420

Salim bin 'Abdullah bin 'Umar narrated that 'Abdullah bin 'Umar said: I divorced my wife during the lifetime of the Messenger of Allah while she was menstruating. 'Umar mentioned that to the Messenger of Allah, and the Messenger of Allah got angry about that and said: 'Let him take her back, then keep her until she has menstruated again and become pure again. Then if he wants to divorce her when she is pure and before he touches her (has intercourse with her), then that is divorce at the prescribed time as Allah, the Mighty and Sublime, has revealed.' 'Abdullah bin 'Umar said: So I took her back, but I still counted the divorce that I had issued to her.

Hadith 3421

Abdullah bin Ayman asked Ibn 'Umar while Abu Az-Zubair was listening: What did you think about a man who divorces his wife when she is menstruating? He said to him: Abdullah bin 'Umar divorced his wife when she was menstruating during the time of the Messenger of Allah. 'Umar asked the Messenger of Allah (about that) and said: 'Abdullah bin 'Umar has divorced his wife while she was menstruating.' The Messenger of Allah said: 'Let him take her back.' So he made me take her back. He said: 'When she becomes pure, let him divorce her or keep her.' Ibn 'Umar said: 'The Prophet said: 'O Prophet! When you divorce women, divorce them before their 'Iddah (prescribed period) elapses.'

Hadith 3422

It was narrated from Ibn 'Abbas, concerning the saying of Allah, the Mighty and Sublime: O Prophet! When you divorce women, divorce them at their 'Iddah (prescribed periods). Ibn 'Abbas, may Allah be pleased with him, said: Before their 'Iddah elapses.
