أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، ‏‏‏‏‏‏وَالْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ وَاللَّفْظُ لِمُحَمَّدٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ أَنْبَأَنَا ابْنُ الْقَاسِمِ، ‏‏‏‏‏‏عَنْ مَالِكٍ، ‏‏‏‏‏‏عَنْ عَبْدِ رَبِّهِ بْنِ سَعِيدٍ، ‏‏‏‏‏‏عَنْ أَبِي سَلَمَةَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ سُئِلَ ابْنُ عَبَّاسٍ، ‏‏‏‏‏‏وَأَبُو هُرَيْرَةَ، ‏‏‏‏‏‏عَنِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا، ‏‏‏‏‏‏وَهِيَ حَامِلٌ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ ابْنُ عَبَّاسٍ:‏‏‏‏ آخِرُ الْأَجَلَيْنِ، ‏‏‏‏‏‏وَقَالَ أَبُو هُرَيْرَةَ:‏‏‏‏ إِذَا وَلَدَتْ فَقَدْ حَلَّتْ، ‏‏‏‏‏‏فَدَخَلَ أَبُو سَلَمَةَ إِلَى أُمِّ سَلَمَةَ فَسَأَلَهَا عَنْ ذَلِكَ فَقَالَتْ:‏‏‏‏ وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِنِصْفِ شَهْرٍ، ‏‏‏‏‏‏فَخَطَبَهَا رَجُلَانِ:‏‏‏‏ أَحَدُهُمَا شَابٌّ، ‏‏‏‏‏‏وَالْآخَرُ كَهْلٌ، ‏‏‏‏‏‏فَحَطَّتْ إِلَى الشَّابِّ، ‏‏‏‏‏‏فَقَالَ الْكَهْلُ:‏‏‏‏ لَمْ تَحْلِلْ، ‏‏‏‏‏‏وَكَانَ أَهْلُهَا غُيَّبًا، ‏‏‏‏‏‏فَرَجَا إِذَا جَاءَ أَهْلُهَا أَنْ يُؤْثِرُوهُ بِهَا، ‏‏‏‏‏‏فَجَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ:‏‏‏‏ قَدْ حَلَلْتِ، ‏‏‏‏‏‏فَانْكِحِي مَنْ شِئْتِ .

ابوسلمہ کہتے ہیں کہ   ابن عباس اور ابوہریرہ رضی اللہ عنہم سے اس عورت ( کی عدت ) کے بارے میں پوچھا گیا جس کا شوہر انتقال کر گیا ہو اور وہ ( انتقال کے وقت ) حاملہ رہی ہو۔ ابن عباس رضی اللہ عنہما نے کہا: دونوں عدتوں میں سے جو آخر میں ہو یعنی لمبی ہو اور دوسری کے مقابل میں بعد میں پوری ہوتی ہو ۱؎، اور ابوہریرہ رضی اللہ عنہ نے کہا: جس وقت عورت بچہ جنے اسی وقت اس کی عدت پوری ہو جائے گی۔ ( یہ اختلاف سن کر ) ابوسلمہ ام سلمہ رضی اللہ عنہا کے پاس گئے اور ان سے اس مسئلہ کے بارے میں پوچھا۔ تو انہوں نے کہا: سبیعہ اسلمیہ رضی اللہ عنہا نے اپنے شوہر کے انتقال کے پندرہ دن بعد بچہ جنا پھر دو آدمیوں نے اسے شادی کرنے کا پیغام دیا، ان دونوں میں سے ایک جوان تھا اور دوسرا ادھیڑ عمر کا، وہ جوان کی طرف مائل ہوئی اور اسے شادی کے لیے پسند کر لیا۔ ادھیڑ عمر والے نے اس سے کہا: تو تم ابھی حلال نہیں ہوئی ہو ( شادی کرنے کیسے جا رہی ہو ) ، اس کے گھر والے غیر موجود تھے ادھیڑ عمر والے نے امید لگائی ( کہ میرے ایسا کہنے سے شادی ابھی نہ ہو گی اور ) جب لڑکی کے گھر والے آ جائیں گے تو ہو سکتا ہے کہ وہ لوگ اس عورت کا اس کے ساتھ رشتہ کر دینے کو ترجیح دیں ( اور سبیعہ کو اس کے ساتھ شادی کر لینے پر راضی کر لیں ) ۔ لیکن وہ تو ( سیدھے ) رسول اللہ صلی اللہ علیہ وسلم کے پاس آئی، آپ صلی اللہ علیہ وسلم نے فرمایا: ”تو تم ( بچہ جن کر ) حلال ہو چکی ہو، تمہارا دل جس سے چاہے اس سے شادی کر لو“ ۲؎۔

It was narrated that Abu Salamah said: Ibn 'Abbas and Abu Hurairah were asked about the woman whose husband dies when she is pregnant. Ibn 'Abbas said: '(She should wait) for the longer of the two periods.' Abu Hurairah said: 'When she gives birth it becomes permissible for her to marry.' Abu Salamah went to Umm Salamah and asked her about that, and she said: 'Subai'ah Al-Aslamiyyah gave birth half a month after her husband died, and two men proposed to her. One was young and one was old, and she was inclined toward the young one. So the old one said: It is not permissible for you to marry. Her family was not there, and he hoped that if he went to her family they would marry her to him. She went to the Messenger of Allah and he said: It is permissible for you to marry, so marry whomever you want.'

Hadith 3418

Nafi' narrated from 'Abdullah, that he divorced his wife while she was menstruating. 'Umar asked the Messenger of Allah about that and said: Abdullah has divorced his wife while she was menstruating. He said: Tell 'Abdullah to take her back, then leave her until she becomes pure from this menstrual period, then menstruates again, then when she becomes pure again, if he wishes he may separate from her before having intercourse with her, or if he wishes he may keep her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

Hadith 3419

It was narrated from Ibn 'Umar that he divorced his wife while she was menstruating, during the time of the Messenger of Allah. 'Umar bin Al-Khattab, may Allah be pleased with him, asked the Messenger of Allah about that, and the Messenger of Allah said: Tell him to take her back and keep her until she becomes pure, then menstruates again and becomes pure again. Then if he wishes he may keep her, or if he wishes, he may divorce her before he touches (has intercourse with) her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

Hadith 3420

Salim bin 'Abdullah bin 'Umar narrated that 'Abdullah bin 'Umar said: I divorced my wife during the lifetime of the Messenger of Allah while she was menstruating. 'Umar mentioned that to the Messenger of Allah, and the Messenger of Allah got angry about that and said: 'Let him take her back, then keep her until she has menstruated again and become pure again. Then if he wants to divorce her when she is pure and before he touches her (has intercourse with her), then that is divorce at the prescribed time as Allah, the Mighty and Sublime, has revealed.' 'Abdullah bin 'Umar said: So I took her back, but I still counted the divorce that I had issued to her.

Hadith 3421

Abdullah bin Ayman asked Ibn 'Umar while Abu Az-Zubair was listening: What did you think about a man who divorces his wife when she is menstruating? He said to him: Abdullah bin 'Umar divorced his wife when she was menstruating during the time of the Messenger of Allah. 'Umar asked the Messenger of Allah (about that) and said: 'Abdullah bin 'Umar has divorced his wife while she was menstruating.' The Messenger of Allah said: 'Let him take her back.' So he made me take her back. He said: 'When she becomes pure, let him divorce her or keep her.' Ibn 'Umar said: 'The Prophet said: 'O Prophet! When you divorce women, divorce them before their 'Iddah (prescribed period) elapses.'

Hadith 3422

It was narrated from Ibn 'Abbas, concerning the saying of Allah, the Mighty and Sublime: O Prophet! When you divorce women, divorce them at their 'Iddah (prescribed periods). Ibn 'Abbas, may Allah be pleased with him, said: Before their 'Iddah elapses.
