أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلَانَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ حَدَّثَنَا أَبُو دَاوُدَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ حَدَّثَنَا شُعْبَةُ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ أَخْبَرَنِي عَبْدُ رَبِّهِ بْنُ سَعِيدٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ سَمِعْتُ أَبَا سَلَمَةَ، ‏‏‏‏‏‏يَقُولُ:‏‏‏‏ اخْتَلَفَ أَبُو هُرَيْرَةَ، ‏‏‏‏‏‏وَابْنُ عَبَّاسٍ فِي الْمُتَوَفَّى عَنْهَا زَوْجُهَا إِذَا وَضَعَتْ حَمْلَهَا، ‏‏‏‏‏‏قَالَ أَبُو هُرَيْرَةَ:‏‏‏‏ تُزَوَّجُ، ‏‏‏‏‏‏وَقَالَ ابْنُ عَبَّاسٍ:‏‏‏‏ أَبْعَدَ الْأَجَلَيْنِ، ‏‏‏‏‏‏فَبَعَثُوا إِلَى أُمِّ سَلَمَةَ، ‏‏‏‏‏‏فَقَالَتْ:‏‏‏‏ تُوُفِّيَ زَوْجُ سُبَيْعَةَ، ‏‏‏‏‏‏فَوَلَدَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِخَمْسَةَ عَشَرَ نِصْفِ شَهْرٍ، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ فَخَطَبَهَا رَجُلَانِ، ‏‏‏‏‏‏فَحَطَّتْ بِنَفْسِهَا إِلَى أَحَدِهِمَا، ‏‏‏‏‏‏فَلَمَّا خَشُوا أَنْ تَفْتَاتَ بِنَفْسِهَا، ‏‏‏‏‏‏قَالُوا:‏‏‏‏ إِنَّكِ لَا تَحِلِّينَ، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ فَانْطَلَقْتُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ:‏‏‏‏ قَدْ حَلَلْتِ، ‏‏‏‏‏‏فَانْكِحِي مَنْ شِئْتِ .

ابوسلمہ کہتے ہیں کہ   ابوہریرہ اور ابن عباس رضی اللہ عنہم میں اس عورت کی عدت کے بارے میں اختلاف ہو گیا جس کا شوہر انتقال کر گیا ہو اور اس نے بچہ جن دیا ہو۔ ابوہریرہ رضی اللہ عنہ نے کہا: ( وضع حمل کے بعد نفاس سے فارغ ہو کر ) وہ شادی کر سکتی ہے اور ابن عباس رضی اللہ عنہما نے کہا: دونوں عدتوں ( یعنی وضع حمل اور عدت طلاق ) میں سے جس عدت کی مدت لمبی ہو گی اسے وہ عدت پوری کرنی ہو گی ( یعنی چار ماہ دس دن، اس کے بعد ہی وہ شادی کر سکے گی ) آخر کار ان لوگوں نے کسی کو ام المؤمنین ام سلمہ رضی اللہ عنہا کے پاس بھیج کر اس بارے میں سوال کیا تو انہوں نے کہا سبیعہ رضی اللہ عنہا کے شوہر انتقال کر گئے اور ان کے انتقال کے پندرہ دن بعد اس نے بچہ جنا۔ پھر اسے دو آدمیوں نے شادی کا پیغام دیا، جن میں سے ایک کی طرف وہ مائل ہو گئی ( اور اس کا بھی خیال اس سے شادی کر ڈالنے کا ہو گیا ) تو جب ( دوسرا شادی کا خواہشمند اور اس کے ساتھی ) لوگ ڈرے کہ یہ تو ہاتھ سے نکلی جا رہی ہے تو انہوں نے ( شادی روکنے اور رکاوٹ ڈالنے کی خاطر ) کہا: ابھی تو تم حلال ہی نہیں ہوئی ہو ( تمہاری عدت پوری نہیں ہوئی ہے تم شادی رچانے کیسے جا رہی ہو ) وہ کہتی ہیں ( جب ان لوگوں نے یہ بات کہی ) تو میں رسول اللہ صلی اللہ علیہ وسلم کے پاس گئی، آپ نے فرمایا: ”بلاشبہ تم حلال ہو گئی ہو تو جس سے بھی چاہو اس سے نکاح کر سکتی ہو“۔

Abu Salamah said: Abu Hurairah and Ibn 'Abbas differed concerning the widow who gives birth after her husband's death. Abu Hurairah said: 'She may be married.' Ibn 'Abbas said: '(She has to wait) for the longer of the two periods.' They sent word to Umm Salamah and she said: 'The husband of Subai'ah died and she gave birth fifteen days -half a month- after her husband died.' She said: 'Two men proposed marriage to her, and she was inclined toward one of them. When they feared that she was becoming single-minded (on this issue, and not consulting her family), they said: It is not permissible for you to marry. She went to the Messenger of Allah and he said: 'It is permissible for you to marry, so marry whomever you want.''

Hadith 3418

Nafi' narrated from 'Abdullah, that he divorced his wife while she was menstruating. 'Umar asked the Messenger of Allah about that and said: Abdullah has divorced his wife while she was menstruating. He said: Tell 'Abdullah to take her back, then leave her until she becomes pure from this menstrual period, then menstruates again, then when she becomes pure again, if he wishes he may separate from her before having intercourse with her, or if he wishes he may keep her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

Hadith 3419

It was narrated from Ibn 'Umar that he divorced his wife while she was menstruating, during the time of the Messenger of Allah. 'Umar bin Al-Khattab, may Allah be pleased with him, asked the Messenger of Allah about that, and the Messenger of Allah said: Tell him to take her back and keep her until she becomes pure, then menstruates again and becomes pure again. Then if he wishes he may keep her, or if he wishes, he may divorce her before he touches (has intercourse with) her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

Hadith 3420

Salim bin 'Abdullah bin 'Umar narrated that 'Abdullah bin 'Umar said: I divorced my wife during the lifetime of the Messenger of Allah while she was menstruating. 'Umar mentioned that to the Messenger of Allah, and the Messenger of Allah got angry about that and said: 'Let him take her back, then keep her until she has menstruated again and become pure again. Then if he wants to divorce her when she is pure and before he touches her (has intercourse with her), then that is divorce at the prescribed time as Allah, the Mighty and Sublime, has revealed.' 'Abdullah bin 'Umar said: So I took her back, but I still counted the divorce that I had issued to her.

Hadith 3421

Abdullah bin Ayman asked Ibn 'Umar while Abu Az-Zubair was listening: What did you think about a man who divorces his wife when she is menstruating? He said to him: Abdullah bin 'Umar divorced his wife when she was menstruating during the time of the Messenger of Allah. 'Umar asked the Messenger of Allah (about that) and said: 'Abdullah bin 'Umar has divorced his wife while she was menstruating.' The Messenger of Allah said: 'Let him take her back.' So he made me take her back. He said: 'When she becomes pure, let him divorce her or keep her.' Ibn 'Umar said: 'The Prophet said: 'O Prophet! When you divorce women, divorce them before their 'Iddah (prescribed period) elapses.'

Hadith 3422

It was narrated from Ibn 'Abbas, concerning the saying of Allah, the Mighty and Sublime: O Prophet! When you divorce women, divorce them at their 'Iddah (prescribed periods). Ibn 'Abbas, may Allah be pleased with him, said: Before their 'Iddah elapses.
