أَخْبَرَنَا مُحَمَّدُ بْنُ مَعْمَرٍ، قَالَ: حَدَّثَنَا أَبُو دَاوُدَ، قَالَ: حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ أَبِي سَلَمَةَ، وَإِبْرَاهِيمُ بْنُ سَعْدٍ، عَنْ الزُّهْرِيِّ، عَنْ سَهْلِ بْنِ سَعْدٍ، عَنْ عَاصِمِ بْنِ عَدِيٍّ، قَالَ: جَاءَنِي عُوَيْمِرٌ رَجُلٌ مِنْ بَنِي الْعَجْلَانِ، فَقَالَ: أَيْ عَاصِمُ، أَرَأَيْتُمْ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ، أَمْ كَيْفَ يَفْعَلُ يَا عَاصِمُ ؟ سَلْ لِي رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَ عَاصِمٌ عَنْ ذَلِكَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَعَابَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسَائِلَ، وَكَرِهَهَا، فَجَاءَهُ عُوَيْمِرٌ، فَقَالَ: مَا صَنَعْتَ يَا عَاصِمُ ؟ فَقَالَ: صَنَعْتُ أَنَّكَ لَمْ تَأْتِنِي بِخَيْرٍ، كَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسَائِلَ وَعَابَهَا، قَالَ عُوَيْمِرٌ: وَاللَّهِ لَأَسْأَلَنَّ عَنْ ذَلِكَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَانْطَلَقَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهُ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: قَدْ أَنْزَلَ اللَّهُ عَزَّ وَجَلَّ فِيكَ، وَفِي صَاحِبَتِكَ، فَأْتِ بِهَا، قَالَ سَهْلٌ: وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَجَاءَ بِهَا، فَتَلَاعَنَا، فَقَالَ: يَا رَسُولَ اللَّهِ، وَاللَّهِ لَئِنْ أَمْسَكْتُهَا لَقَدْ كَذَبْتُ عَلَيْهَا، فَفَارَقَهَا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِفِرَاقِهَا، فَصَارَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ .
سہل بن سعد رضی الله عنہ سے روایت ہے کہ عاصم بن عدی رضی اللہ عنہ کہتے ہیں کہ قبیلہ بنی عجلان کا ایک شخص عویمر میرے پاس آیا اور کہنے لگا: عاصم! بھلا بتاؤ تو صحیح؟ ایک آدمی اپنی بیوی کے ساتھ ایک غیر شخص کو دیکھتا ہے، اگر وہ اسے قتل کر دیتا ہے تو کیا تم لوگ اسے قتل کر دو گے یا وہ کیا کرے؟ عاصم میرے واسطے یہ مسئلہ رسول اللہ صلی اللہ علیہ وسلم سے پوچھو تو عاصم رضی اللہ عنہ نے اس کے متعلق نبی اکرم صلی اللہ علیہ وسلم سے پوچھا، رسول اللہ صلی اللہ علیہ وسلم نے اس طرح کے سوالات کو برا جانا اور ناپسند کیا، عویمر ان کے پاس آئے اور کہا: عاصم! کیا کیا تو نے؟ ( مسئلہ پوچھا یا نہیں؟ ) انہوں نے کہا: میں نے کیا تو ( یعنی پوچھا تو ) لیکن تو اچھا سوال لے کر نہیں آیا تھا ( جواب کیا ملتا ) رسول اللہ صلی اللہ علیہ وسلم نے اس طرح کے سوالات کو ناپسند کیا اور برا مانا۔ عویمر رضی اللہ عنہ نے کہا: قسم اللہ کی! میں تو ضرور رسول اللہ صلی اللہ علیہ وسلم سے یہ بات پوچھ کر رہوں گا ( یہ کوئی فرضی سوال نہیں امر واقع ہے ) پھر وہ رسول اللہ صلی اللہ علیہ وسلم کے پاس گئے اور آپ سے پوچھا: رسول اللہ صلی اللہ علیہ وسلم نے اس سے فرمایا: ”اللہ تعالیٰ نے تمہارے اور تمہاری بیوی کے معاملے میں حکم نازل فرما دیا ہے۔ تو ( جاؤ ) اسے لے کر آؤ“، سہل رضی اللہ عنہ کہتے ہیں: اس وقت میں بھی لوگوں کے ساتھ رسول اللہ صلی اللہ علیہ وسلم کے پاس موجود تھا، وہ اسے لے کر آئے اور دونوں نے لعان کیا ۱؎۔ پھر اس نے ( یعنی عویمر نے ) کہا: اللہ کے رسول! قسم اللہ کی اگر میں نے اسے اپنے پاس رکھا تو میں اس پر تہمت لگانے والا ٹھہروں گا ( یہ کہہ کر ) انہوں نے اسے طلاق دے کر چھوڑ دیا اس سے پہلے کہ رسول اللہ صلی اللہ علیہ وسلم اسے چھوڑ دینے کا حکم دیتے۔ ( راوی کہتے ہیں ) پھر لعان کرنے والوں میں یہی طریقہ رائج ہو گیا ( یعنی لعان کے بعد میاں بیوی دونوں جدا ہو جائیں ) ۔
It was narrated from Sahl bin Sa'd, from 'Asim bin 'Adiyy who said: Uwaimir, a man from Banu 'Ajlan, came and said: 'O 'Asim, what do you think if a man sees another man with his wife, should he kill him and be killed in retaliation, or what should he do? O 'Asim, ask the Messenger of Allah about that for me.' So 'Asim asked the Messenger of Allah about that, and the Messenger of Allah disapproved of the question and criticized the asking of too many questions. Then 'Uwaimir came to him and said: What happened, O 'Asim? 'Asim said to 'Uwaimir: What happened?! You have not brought me any good. The Messenger of Allah disapproved of the question I asked. 'Uwaimir said: By Allah, I will go and ask the Messenger of Allah. So he went to the Messenger of Allah and asked him. The Messenger of Allah said: Allah the Mighty and Sublime has revealed (something) concerning you and your wife, so bring her here. Sahl said: I was among the people in the presence of the Messenger of Allah and he brought her and they engaged in the procedure of Li'an. He said: 'O Messenger of Allah, by Allah! If I keep her I would have been telling lies about her.' So he parted from her before the Messenger of Allah told him to separate from her, and that became the way of Li'an.

Hadith 3418
Nafi' narrated from 'Abdullah, that he divorced his wife while she was menstruating. 'Umar asked the Messenger of Allah about that and said: Abdullah has divorced his wife while she was menstruating. He said: Tell 'Abdullah to take her back, then leave her until she becomes pure from this menstrual period, then menstruates again, then when she becomes pure again, if he wishes he may separate from her before having intercourse with her, or if he wishes he may keep her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

It was narrated from Ibn 'Umar that he divorced his wife while she was menstruating, during the time of the Messenger of Allah. 'Umar bin Al-Khattab, may Allah be pleased with him, asked the Messenger of Allah about that, and the Messenger of Allah said: Tell him to take her back and keep her until she becomes pure, then menstruates again and becomes pure again. Then if he wishes he may keep her, or if he wishes, he may divorce her before he touches (has intercourse with) her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced.

Salim bin 'Abdullah bin 'Umar narrated that 'Abdullah bin 'Umar said: I divorced my wife during the lifetime of the Messenger of Allah while she was menstruating. 'Umar mentioned that to the Messenger of Allah, and the Messenger of Allah got angry about that and said: 'Let him take her back, then keep her until she has menstruated again and become pure again. Then if he wants to divorce her when she is pure and before he touches her (has intercourse with her), then that is divorce at the prescribed time as Allah, the Mighty and Sublime, has revealed.' 'Abdullah bin 'Umar said: So I took her back, but I still counted the divorce that I had issued to her.

Abdullah bin Ayman asked Ibn 'Umar while Abu Az-Zubair was listening: What did you think about a man who divorces his wife when she is menstruating? He said to him: Abdullah bin 'Umar divorced his wife when she was menstruating during the time of the Messenger of Allah. 'Umar asked the Messenger of Allah (about that) and said: 'Abdullah bin 'Umar has divorced his wife while she was menstruating.' The Messenger of Allah said: 'Let him take her back.' So he made me take her back. He said: 'When she becomes pure, let him divorce her or keep her.' Ibn 'Umar said: 'The Prophet said: 'O Prophet! When you divorce women, divorce them before their 'Iddah (prescribed period) elapses.'
