حَدَّثَنَا مُحَمَّدُ بْنُ عَوْفٍ الطَّائِيُّ، ‏‏‏‏‏‏حَدَّثَنَا الرَّبِيعُ بْنُ رَوْحِ بْنِ خُلَيْدٍ، ‏‏‏‏‏‏حَدَّثَنَا مُحَمَّدُ بْنُ خَالِدٍ يَعْنِي الْوَهْبِيَّ، ‏‏‏‏‏‏حَدَّثَنَا الْفَضْلُ بْنُ دَلْهَمٍ، ‏‏‏‏‏‏عَنِ الْحَسَنِ، ‏‏‏‏‏‏عَنْ سَلَمَةَ بْنِ الْمُحَبَّقِ، ‏‏‏‏‏‏عَنْ عُبَادَةَ بْنِ الصَّامِت، ‏‏‏‏‏‏عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِهَذَا الْحَدِيثِ، ‏‏‏‏‏‏فَقَالَ نَاسٌ لِسَعْدِ بْنِ عُبَادَةَ:‏‏‏‏ يَا أَبَا ثَابِتٍ قَدْ نَزَلَتِ الْحُدُودُ لَوْ أَنَّكَ وَجَدْتَ مَعَ امْرَأَتِكَ رَجُلًا كَيْفَ كُنْتَ صَانِعًا ؟ قَالَ:‏‏‏‏ كُنْتُ ضَارِبَهُمَا بِالسَّيْفِ حَتَّى يَسْكُتَا أَفَأَنَا أَذْهَبُ فَأَجْمَعُ أَرْبَعَةَ شُهَدَاءٍ فَإِلَى ذَلِكَ قَدْ قَضَى الْحَاجَةَ فَانْطَلَقُوا فَاجْتَمَعُوا عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَقَالُوا:‏‏‏‏ يَا رَسُولَ اللَّهِ أَلَمْ تَرَ إِلَى أَبِي ثَابِتٍ ؟ قَالَ:‏‏‏‏ كَذَا وَكَذَا، ‏‏‏‏‏‏فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ كَفَى بِالسَّيْفِ شَاهِدًا، ‏‏‏‏‏‏ثُمَّ قَالَ:‏‏‏‏ لَا لَا أَخَافُ أَنْ يَتَتَابَعَ فِيهَا السَّكْرَانُ وَالْغَيْرَانُ، ‏‏‏‏‏‏قَالَ أَبُو دَاوُد:‏‏‏‏ رَوَى وَكِيعٌ أَوَّلَ هَذَا الْحَدِيثِ، ‏‏‏‏‏‏عَنِ الْفَضْلِ بْنِ دَلْهَمٍ، ‏‏‏‏‏‏عَنْ الْحَسَنِ، ‏‏‏‏‏‏عَنْ قَبِيصَةَ بْنِ حُرَيْثٍ، ‏‏‏‏‏‏عَنْ سَلَمَةَ بْنِ الْمُحَبَّقِ، ‏‏‏‏‏‏عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏وَإِنَّمَا هَذَا إِسْنَادُ حَدِيثِ ابْنِ الْمُحَبَّقِ:‏‏‏‏ أَنَّ رَجُلًا وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ، ‏‏‏‏‏‏قَالَ أَبُو دَاوُد:‏‏‏‏ الْفَضْلُ بْنُ دَلْهَمٍ لَيْسَ بِالْحَافِظِ كَانَ قَصَّابًا بِوَاسِطَ.

عبادہ بن صامت رضی اللہ عنہ نبی اکرم صلی اللہ علیہ وسلم سے یہی حدیث روایت کرتے ہیں اس میں ہے کہ   کچھ لوگوں نے سعد بن عبادہ سے کہا: اے ابوثابت! حدود نازل ہو چکے ہیں اگر آپ اپنی بیوی کے ساتھ کسی مرد کو پائیں تو کیا کریں، انہوں نے کہا: ان دونوں کا کام تلوار سے تمام کر دوں گا، کیا میں چار گواہ جمع کرنے جاؤں گا تب تک تو وہ اپنا کام پورا کر چکے گا، چنانچہ وہ چلے اور رسول اللہ صلی اللہ علیہ وسلم کے پاس پہنچے اور ان لوگوں نے عرض کیا: اللہ کے رسول! کیا آپ نے ابوثابت کو نہیں سنا وہ ایسا ایسا کہہ رہے ہیں تو رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ازروئے گواہ تلوار ہی کافی ہے پھر آپ صلی اللہ علیہ وسلم نے فرمایا: نہیں، نہیں، اسے قتل مت کرنا کیونکہ مجھے اندیشہ ہے کہ غصہ ور، اور غیرت مند پیچھے پڑ کر ( بغیر اس کی تحقیق کئے کہ اس سے زنا سرزد ہوا ہے یا نہیں محض گمان ہی پر ) اسے قتل نہ کر ڈالیں ۔ ابوداؤد کہتے ہیں: اس حدیث کا ابتدائی حصہ وکیع نے فضل بن دلہم سے، فضل نے حسن سے، حسن نے قبیصہ بن حریث سے، قبیصہ نے سلمہ بن محبق سے سلمہ نے نبی اکرم صلی اللہ علیہ وسلم سے مرفوعاً روایت کیا ہے، یہ سند جس کا ذکر وکیع نے کیا ہے ابن محبق والی روایت کی سند ہے جس میں ہے کہ ایک شخص نے اپنی بیوی کی لونڈی سے مجامعت کر لی۔ ابوداؤد کہتے ہیں: فضل بن دلہم حافظ حدیث نہیں تھے، وہ واسط میں ایک قصاب تھے۔

Narrated Ubadah ibn as-Samit: The tradition mentioned above (No. 4401) has also been transmitted by Ubadah ibn as-Samit through a different chain of narrators. This version has: The people said to Saad ibn Ubadah: Abu Thabit, the prescribed punishments have been revealed: if you find a man with your wife, what will you do? He said: I shall strike them with a sword so much that they become silent (i. e. die). Should I go and gather four witnesses? Until that (time) the need would be fulfilled. So they went away and gathered with the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم and said: Messenger of Allah! did you not see Abu Thabit. He said so-and-so. The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم said: The sword is a sufficient witness. He then said: No, no, a furious and a jealous man may follow this course. Abu Dawud said: This tradition has been transmitted by Waki from al-Fadl bin Dilham from al-Hasan, from Qabisah bin Huraith, from Salamah bin al-Muhabbaq, from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم. And this is the chain of the tradition narrated by Ibn al-Muhabbaq to the effect that a man had sexual intercourse with a slave girl of his wife. Abu Dawud said: Al-Fadl bin Dilham was not the memoriser of traditions. He was a butcher in Wasit.

Hadith 4351

Ikrimah said: Ali burned some people who retreated from islam. When Ibn Abbas was informed of it, he said: If it had been I, I would not have then burned, for the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم said: Do not inflict Allah’s punishment on anyone, but would have had killed them on account of the statement of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم. The Messenger said: Kill those who change their religion. When ‘All was informed about it he said: How truly Ibn Abbas said!

Hadith 4352

Abdullah (bin Masud) reported the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم as saying: The blood of a Muslim man who testifies that there is no god but Allah and that I am the Messenger of Allah should not be lawfully shed but only for one of three reasons: married fornicator, soul for soul, and one who deserts his religion separating himself from the community.

Hadith 4353

Narrated Aishah, Ummul Muminin: The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم Said: The blood of a Muslim man who testifies that there is no god but Allah and that Muhammad is Allah's Messenger should not lawfully be shed except only for one of three reasons: a man who committed fornication after marriage, in which case he should be stoned; one who goes forth to fight with Allah and His Messenger, in which case he should be killed or crucified or exiled from the land; or one who commits murder for which he is killed.

Hadith 4354

Abu Burdah said on the authority of Abu Musa: I went to the Prophet صلی ‌اللہ ‌علیہ ‌وسلم while two men who were Ash’ arIs were with me. One of them was on my right and the other on my left side. Bothe of them asked him for employment. The prophet صلی ‌اللہ ‌علیہ ‌وسلم was silent. He asked: What do you say Abu Musa, or Abdullah bin Qais (Abu Musa’s name)? I replied: By him who has sent you with truth, they did not inform me of what they had in their hearts, and I did not know that they would ask for an employment. He said: I have the scene before my eyes that he had his toothstick below his lip which receded. He (the prophet) said: We will never or will not put in charge of our work anyone who asks for it. But go, ye, Abu Musa, or Abdullah bin Qais. He then sent him as a Governor of the Yemen, After him he sent Muadh bin Jabal. When Muadh came to him, he said: come down, and he put a cushion for him. He saw that a man was chained with him. He asked: What is this? He replied: He was a Jew and he accepted Islam. He then converted to his religion, an evil religion. He said: I will not sit until he is killed according to the decision of Allah and his Messenger صلی ‌اللہ ‌علیہ ‌وسلم. He said: Yes, be seated. He said: I will not sit until he is killed according to the decision of Allah and his Messenger صلی ‌اللہ ‌علیہ ‌وسلم. He said it three times. He then commanded for it and he was killed. Both of them then discussed the question of prayer and vigilance at night. One of them, probably Muadh, said: So far as I am concerned, I sleep and I keep vigilance: I keep vigilance and I sleep: I hope for the same reward for my sleep as for my vigilance.

Hadith 4355

Narrated Muadh ibn Jabal: Abu Musa said: Muadh came to me when I was in the Yemen. A man who was Jew embraced Islam and then retreated from Islam. When Muadh came, he said: I will not come down from my mount until he is killed. He was then killed. One of them said: He was asked to repent before that.
