حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى بْنِ فَارِسٍ، حَدَّثَنَا الْفِّرْيَابِيُّ، حَدَّثَنَا إِسْرَائِيلُ، حَدَّثَنَا سِمَاكُ بْنُ حَرْبٍ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ، عَنْ أَبِيهِ، أَنَّ امْرَأَةً خَرَجَتْ عَلَى عَهْدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ تُرِيدُ الصَّلَاةَ فَتَلَقَّاهَا رَجُلٌ فَتَجَلَّلَهَا فَقَضَى حَاجَتَهُ مِنْهَا فَصَاحَتْ وَانْطَلَقَ فَمَرَّ عَلَيْهَا رَجُلٌ، فَقَالَتْ: إِنَّ ذَاكَ فَعَلَ بِي كَذَا وَكَذَا، وَمَرَّتْ عِصَابَةٌ مِنْ الْمُهَاجِرِينَ فَقَالَتْ: إِنَّ ذَلِكَ الرَّجُلَ فَعَلَ بِي كَذَا وَكَذَا فَانْطَلَقُوا فَأَخَذُوا الرَّجُلَ الَّذِي ظَنَّتْ أَنَّهُ وَقَعَ عَلَيْهَا فَأَتَوْهَا بِهِ فَقَالَتْ: نَعَمْ هُوَ هَذَا، فَأَتَوْا بِهِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَمَّا أَمَرَ بِهِ قَامَ صَاحِبُهَا الَّذِي وَقَعَ عَلَيْهَا، فَقَالَ: يَا رَسُولَ اللَّهِ أَنَا صَاحِبُهَا، فَقَالَ لَهَا: اذْهَبِي فَقَدْ غَفَرَ اللَّهُ لَكِ، وَقَالَ لِلرَّجُلِ قَوْلًا حَسَنًا ، قَالَ أَبُو دَاوُد: يَعْنِي الرَّجُلَ الْمَأْخُوذَ، وَقَالَ لِلرَّجُلِ الَّذِي وَقَعَ عَلَيْهَا ارْجُمُوهُ، فَقَالَ: لَقَدْ تَابَ تَوْبَةً لَوْ تَابَهَا أَهْلُ الْمَدِينَةِ لَقُبِلَ مِنْهُمْ، قَالَ أَبُو دَاوُد: رَوَاهُ أَسْبَاطُ بْنُ نَصْرٍ أَيْضًا، عَنْ سِمَاكٍ.
وائل رضی اللہ عنہ کہتے ہیں کہ ایک عورت رسول اللہ صلی اللہ علیہ وسلم کے زمانہ میں نماز پڑھنے کے ارادہ سے نکلی تو اس سے ایک مرد ملا اور اسے دبوچ لیا، اور اس سے اپنی خواہش پوری کی تو وہ چلائی، وہ جا چکا تھا، اتنے میں اس کے پاس سے ایک اور شخص گزرا تو وہ کہنے لگی کہ اس ( فلاں ) نے میرے ساتھ ایسا ایسا کیا ہے، اتنے میں مہاجرین کی ایک جماعت بھی آ گئی ان سے بھی اس نے یہی کہا کہ اس نے اس کے ساتھ ایسا ایسا کیا ہے، تو وہ سب گئے اور اس شخص کو پکڑا جس کے متعلق اس نے کہا تھا کہ اس نے اس کے ساتھ زنا کیا ہے، اور اسے لے کر آئے، تو اس نے کہا: ہاں اسی نے کیا ہے، چنانچہ وہ لوگ اسے لے کر نبی اکرم صلی اللہ علیہ وسلم کے پاس آئے، تو آپ صلی اللہ علیہ وسلم نے اس کے سلسلہ میں حکم دیا ( کہ اس پر حد جاری کی جائے ) یہ دیکھ کر اصل شخص جس نے اس سے صحبت کی تھی کھڑا ہو گیا، اور کہنے لگا: اللہ کے رسول! فی الواقع یہ کام میں نے کیا ہے، تو آپ صلی اللہ علیہ وسلم نے اس عورت سے فرمایا: تم جاؤ اللہ تعالیٰ نے تمہیں بخش دیا ( کیونکہ یہ تیری رضا مندی سے نہیں ہوا تھا ) اور اس آدمی سے بھلی بات کہی ۔ ابوداؤد کہتے ہیں: مراد وہ آدمی ہے ( ناحق ) جو پکڑا گیا تھا، اور اس آدمی کے متعلق جس نے زنا کیا تھا فرمایا: اس کو رجم کر دو پھر آپ صلی اللہ علیہ وسلم نے فرمایا: اس نے ایسی توبہ کی ہے کہ سارے مدینہ کے لوگ ایسی توبہ کریں تو ان کی طرف سے وہ قبول ہو جائے ۔
Narrated Wail ibn Hujr: When a woman went out in the time of the Prophet صلی اللہ علیہ وسلم for prayer, a man attacked her and overpowered (raped) her. She shouted and he went off, and when a man came by, she said: That (man) did such and such to me. And when a company of the Emigrants came by, she said: That man did such and such to me. They went and seized the man whom they thought had had intercourse with her and brought him to her. She said: Yes, this is he. Then they brought him to the Messenger of Allah صلی اللہ علیہ وسلم. When he (the Prophet) was about to pass sentence, the man who (actually) had assaulted her stood up and said: Messenger of Allah, I am the man who did it to her. He (the Prophet) said to her: Go away, for Allah has forgiven you. But he told the man some good words (Abu Dawud said: meaning the man who was seized), and of the man who had had intercourse with her, he said: Stone him to death. He also said: He has repented to such an extent that if the people of Madina had repented similarly, it would have been accepted from them. Abu Dawud said: Asbat bin Nasr has also transmitted it from Simak.

Hadith 4351
Ikrimah said: Ali burned some people who retreated from islam. When Ibn Abbas was informed of it, he said: If it had been I, I would not have then burned, for the Messenger of Allah صلی اللہ علیہ وسلم said: Do not inflict Allah’s punishment on anyone, but would have had killed them on account of the statement of the Messenger of Allah صلی اللہ علیہ وسلم. The Messenger said: Kill those who change their religion. When ‘All was informed about it he said: How truly Ibn Abbas said!

Abu Burdah said on the authority of Abu Musa: I went to the Prophet صلی اللہ علیہ وسلم while two men who were Ash’ arIs were with me. One of them was on my right and the other on my left side. Bothe of them asked him for employment. The prophet صلی اللہ علیہ وسلم was silent. He asked: What do you say Abu Musa, or Abdullah bin Qais (Abu Musa’s name)? I replied: By him who has sent you with truth, they did not inform me of what they had in their hearts, and I did not know that they would ask for an employment. He said: I have the scene before my eyes that he had his toothstick below his lip which receded. He (the prophet) said: We will never or will not put in charge of our work anyone who asks for it. But go, ye, Abu Musa, or Abdullah bin Qais. He then sent him as a Governor of the Yemen, After him he sent Muadh bin Jabal. When Muadh came to him, he said: come down, and he put a cushion for him. He saw that a man was chained with him. He asked: What is this? He replied: He was a Jew and he accepted Islam. He then converted to his religion, an evil religion. He said: I will not sit until he is killed according to the decision of Allah and his Messenger صلی اللہ علیہ وسلم. He said: Yes, be seated. He said: I will not sit until he is killed according to the decision of Allah and his Messenger صلی اللہ علیہ وسلم. He said it three times. He then commanded for it and he was killed. Both of them then discussed the question of prayer and vigilance at night. One of them, probably Muadh, said: So far as I am concerned, I sleep and I keep vigilance: I keep vigilance and I sleep: I hope for the same reward for my sleep as for my vigilance.

Narrated Muadh ibn Jabal: Abu Musa said: Muadh came to me when I was in the Yemen. A man who was Jew embraced Islam and then retreated from Islam. When Muadh came, he said: I will not come down from my mount until he is killed. He was then killed. One of them said: He was asked to repent before that.
