حَدَّثَنَا هَنَّادُ بْنُ السَّرِيِّ، حَدَّثَنَا أَبُو الْأَحْوَصِ، عَنْ سِمَاكٍ، عَنْ عَلْقَمَةَ بْنِ وَائِلِ بْنِ حُجْرٍ الْحَضْرَمِيِّ، عَنْ أَبِيهِ، قَالَ: جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ، وَرَجُلٌ مِنْ كِنْدَةَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ الْحَضْرَمِيُّ: يَا رَسُولَ اللَّهِ، إِنَّ هَذَا غَلَبَنِي عَلَى أَرْضٍ كَانَتْ لِأَبِي، فَقَالَ الْكِنْدِيُّ: هِيَ أَرْضِي فِي يَدِي أَزْرَعُهَا لَيْسَ لَهُ فِيهَا حَقٌّ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْحَضْرَمِيِّ: أَلَكَ بَيِّنَةٌ ؟ قَالَ: لَا، قَالَ: فَلَكَ يَمِينُهُ، فَقَالَ: يَا رَسُولَ اللَّهِ، إِنَّهُ فَاجِرٌ لَيْسَ يُبَالِي مَا حَلَفَ لَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ، فَقَالَ: لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ .
وائل بن حجر حضرمی رضی اللہ عنہ کہتے ہیں ایک حضرمی اور ایک کندی رسول اللہ صلی اللہ علیہ وسلم کے پاس آئے تو حضرمی نے عرض کیا: اللہ کے رسول! اس شخص نے میرے والد کی زمین مجھ سے چھین لی ہے، کندی نے کہا: یہ تو میری زمین ہے میں اسے جوتتا ہوں اس میں اس کا حق نہیں ہے، نبی اکرم صلی اللہ علیہ وسلم نے حضرمی سے فرمایا: کیا تیرے پاس کوئی گواہ ہے؟ اس نے کہا: نہیں، تب آپ صلی اللہ علیہ وسلم نے ( کندی سے ) فرمایا: تو تیرے لیے قسم ہے تو حضرمی نے کہا: اللہ کے رسول! یہ تو ایک فاجر شخص ہے اسے قسم کی کیا پرواہ؟ وہ کسی چیز سے پرہیز نہیں کرتا، آپ صلی اللہ علیہ وسلم نے فرمایا: سوائے اس کے اس پر تیرا کوئی حق نہیں ۔
Alqamah bin Wail bin Hujr al-Hadrami said on the authority of the father: A man from Hadramaw and a man from kindah came to the Messenger of Allah صلی اللہ علیہ وسلم. The hadrami said: Messenger of Allah, this (man) has seized land which belonged to my father. Al-Kindi said: That is my land in my possession and I cultivate it; he has no right to it. The Holy prophet (may be peace upon him) said to the Hadrami: Have you any proof? We said: No. he (the Prophet)said: Then he will swear an oath for you. He said: Messenger of Allah, he is a reprobate and he would not care to swear to anything and stick at nothing. He said: That is only your recourse

Narrated Buraydah ibn al-Hasib: The Prophet صلی اللہ علیہ وسلم said: Judges are of three types, one of whom will go to Paradise and two to Hell. The one who will go to Paradise is a man who knows what is right and gives judgment accordingly; but a man who knows what is right and acts tyrannically in his judgment will go to Hell; and a man who gives judgment for people when he is ignorant will go to Hell. Abu Dawud said: On this subject this is the soundest tradition, that is, the tradition of Ibn Buraidah: Judges are of three types.
