حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ، بِإِسْنَادِ ابْنِ مِنْهَالٍ مِثْلَهُ، قَالَ: فِي دَابَّةٍ وَلَيْسَ لَهُمَا بَيِّنَةٌ، فَأَمَرَهُمَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَسْتَهِمَا عَلَى الْيَمِينِ.
سعید بن ابی عروبہ سے ابن منہال کی سند سے اسی کے مثل مروی ہے اس میں «في متاع» کے بجائے «في دابة» کے الفاظ ہیں یعنی دو شخصوں نے ایک چوپائے کے سلسلہ میں جھگڑا کیا اور ان کے پاس کوئی گواہ نہیں تھا، تو رسول اللہ صلی اللہ علیہ وسلم نے انہیں قسم پر قرعہ اندازی کا حکم دیا۔
