حَدَّثَنَا الرَّبِيعُ بْنُ نَافِعٍ أَبُو تَوْبَةَ، حَدَّثَنَا ابْنُ الْمُبَارَكِ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، عَنْ عَبْدِ اللَّهِ بْنِ رَافِعٍ مَوْلَى أُمِّ سَلَمَةَ، عَنْأُمِّ سَلَمَةَ، قَالَتْ: أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَجُلَانِ يَخْتَصِمَانِ فِي مَوَارِيثَ لَهُمَا لَمْ تَكُنْ لَهُمَا بَيِّنَةٌ إِلَّا دَعْوَاهُمَا، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: فَذَكَرَ مِثْلَهُ، فَبَكَى الرَّجُلَانِ، وَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا: حَقِّي لَكَ، فَقَالَ لَهُمَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَمَّا إِذْ فَعَلْتُمَا مَا فَعَلْتُمَا، فَاقْتَسِمَا وَتَوَخَّيَا الْحَقَّ، ثُمَّ اسْتَهَمَا، ثُمَّ تَحَالَّا.
ام المؤمنین ام سلمہ رضی اللہ عنہا کہتی ہیں کہ رسول اللہ صلی اللہ علیہ وسلم کے پاس دو شخص اپنے میراث کے مسئلے میں جھگڑتے ہوئے آئے اور ان دونوں کے پاس بجز دعویٰ کے کوئی دلیل نہیں تھی، تو نبی اکرم صلی اللہ علیہ وسلم نے فرمایا۔ ۔ ۔ ( پھر راوی نے اسی کے مثل حدیث ذکر کی ) تو دونوں رو پڑے اور ان میں سے ہر ایک دوسرے سے کہنے لگا: میں نے اپنا حق تجھے دے دیا، آپ صلی اللہ علیہ وسلم نے ان دونوں سے فرمایا: جب تم ایسا کر رہے ہو تو حق کو پیش نظر رکھ کر ( مال ) کو تقسیم کر لو، پھر قرعہ اندازی کر لو اور ایک دوسرے کو معاف کر دو ۔
Umm Salamah said: Two men came to the Messenger of Allah صلی اللہ علیہ وسلم who were disputing over their inheritance. They had no evidence except their claim. The Prophet صلی اللہ علیہ وسلم then said in a similar way. Thereupon both the men wept and each of them said: This right of mine go to you. The Prophet صلی اللہ علیہ وسلم then said: Now you have done whatever you have done ; do divide it up, aiming at what is right, then drew lots, and let each of you consider the other to have what is legitimately his

Narrated Buraydah ibn al-Hasib: The Prophet صلی اللہ علیہ وسلم said: Judges are of three types, one of whom will go to Paradise and two to Hell.
