Wills (Kitab Al-Wasaya)

عبداللہ بن عمر رضی اللہ عنہما کہتے ہیں کہ   عمر رضی اللہ عنہ کو خیبر میں ایک زمین ملی، وہ نبی اکرم صلی اللہ علیہ وسلم کے پاس آئے اور انہوں نے عرض کیا: اللہ کے رسول! مجھے ایک ایسی زمین ملی ہے، مجھے کبھی کوئی مال نہیں ملا تو اس کے متعلق مجھے آپ کیا حکم فرماتے ہیں؟ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: اگر تم چاہو تو زمین کی اصل ( ملکیت ) کو روک لو اور اس کے منافع کو صدقہ کر دو ۱؎، عمر رضی اللہ عنہ نے ایسا ہی کیا کہ نہ زمین بیچی جائے گی، نہ ہبہ کی جائے گی، اور نہ میراث میں تقسیم ہو گی ( بلکہ ) اس سے فقراء، قرابت دار، غلام، مجاہدین اور مسافر فائدہ اٹھائیں گے۔ بشر کی روایت میں مہمان کا اضافہ ہے ، باقی میں سارے راوی متفق ہیں: جو اس کا والی ہو گا دستور کے مطابق اس کے منافع سے اس کے خود کھانے اور دوستوں کو کھلانے میں کوئی حرج نہیں جب کہ وہ مال جمع کر کے رکھنے والا نہ ہو ۔ بشر کی روایت میں اتنا زیادہ ہے کہ محمد ( ابن سیرین ) کہتے ہیں: مال جوڑنے والا نہ ہو ۔

Narrated Ibn Umar: Umar got some land in Khaibar, and when to the Prophet صلی ‌اللہ ‌علیہ ‌وسلم and said: I have acquired land in Khaibar which I consider to be more valuable than any I have acquired ; so what do you command me to do with it ? He replied: If you wish, you may make the property as inalienable possession, and give its produce as sadaqah (charity). So Umar gave it as a sadaqah declaring that the property must not be sold, given away, or inherited: (and gave its produce as sadaqah to be devoted) to poor, relatives, the emancipation of slaves, Allah's path, travellers. The narrator Bishr added: and guests . Then the agreed version goes: No sin being committed by the one who administers it if he eats something from it in a reasonable manner, or gives something to a friend, who does not make his own property. The narrator Bishr added: (provided) he is not storing-up goods (for himself) .
