حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ هِلَالِ بْنِ خَبَّابٍ، عَنْ مَيْسَرَةَ أَبِي صَالِحٍ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ، قَالَ: سِرْتُ، أَوْ قَالَ: أَخْبَرَنِي مَنْ سَارَ مَعَ مُصَدِّقِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَإِذَا فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ: لَا تَأْخُذَ مِنْ رَاضِعِ لَبَنٍ، وَلَا تَجْمَعَ بَيْنَ مُفْتَرِقٍ، وَلَا تُفَرِّقَ بَيْنَ مُجْتَمِعٍ، وَكَانَ إِنَّمَا يَأْتِي الْمِيَاهُ حِينَ تَرِدُ الْغَنَمُ، فَيَقُولُ: أَدُّوا صَدَقَاتِ أَمْوَالِكُمْ ، قَالَ: فَعَمَدَ رَجُلٌ مِنْهُمْ إِلَى نَاقَةٍ كَوْمَاءَ، قَالَ: قُلْتُ: يَا أَبَا صَالِحٍ، مَا الْكَوْمَاءُ ؟ قَالَ: عَظِيمَةُ السَّنَامِ، قَالَ: فَأَبَى أَنْ يَقْبَلَهَا، قَالَ: إِنِّي أُحِبُّ أَنْ تَأْخُذَ خَيْرَ إِبِلِي، قَالَ: فَأَبَى أَنْ يَقْبَلَهَا، قَالَ: فَخَطَمَ لَهُ أُخْرَى دُونَهَا، فَأَبَى أَنْ يَقْبَلَهَا، ثُمَّ خَطَمَ لَهُ أُخْرَى دُونَهَا فَقَبِلَهَا، وَقَالَ: إِنِّي آخِذُهَا وَأَخَافُ أَنْ يَجِدَ عَلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ لِي: عَمَدْتَ إِلَى رَجُلٍ فَتَخَيَّرْتَ عَلَيْهِ إِبِلَهُ . قَالَ أَبُو دَاوُد: وَرَوَاهُ هُشَيْمٌ، عَنْ هِلَالِ بْنِ خَبَّابٍ نَحْوَهُ، إِلَّا أَنَّهُ قَالَ: لَا يُفَرَّقُ.
سوید بن غفلہ رضی اللہ عنہ کہتے ہیں کہ میں خود گیا، یا یوں کہتے ہیں: جو رسول اللہ صلی اللہ علیہ وسلم کے محصل کے ساتھ گیا تھا اس نے مجھ سے بیان کیا کہ آپ کی کتاب میں لکھا تھا: ہم زکاۃ میں دودھ والی بکری یا دودھ پیتا بچہ نہ لیں، نہ جدا مال اکٹھا کیا جائے اور نہ اکٹھا مال جدا کیا جائے ، رسول اللہ صلی اللہ علیہ وسلم کا مصدق اس وقت آتا جب بکریاں پانی پر جاتیں اور وہ کہتا: اپنے مالوں کی زکاۃ ادا کرو، ایک شخص نے اپنا کوبڑے کوہان والا اونٹ کو دینا چاہا تو مصدق نے اسے لینے سے انکار کر دیا، اس شخص نے کہا: نہیں، میری خوشی یہی ہے کہ تو میرا بہتر سے بہتر اونٹ لے، مصدق نے پھر لینے سے انکار کر دیا، اب اس نے تھوڑے کم درجے کا اونٹ کھینچا، مصدق نے اس کے لینے سے بھی انکار کر دیا، اس نے اور کم درجے کا اونٹ کھینچا تو مصدق نے اسے لے لیا اور کہا: میں لے لیتا ہوں لیکن مجھے ڈر لگتا ہے کہ کہیں رسول اللہ صلی اللہ علیہ وسلم مجھ پر غصہ نہ ہوں اور آپ مجھ سے کہیں: تو نے ایک شخص کا بہترین اونٹ لے لیا۔ ابوداؤد کہتے ہیں: اسے ہشیم نے ہلال بن خباب سے اسی طرح روایت کیا ہے، مگر اس میں «لا تفرق» کی بجائے «لا يفرق» ہے۔
Suwayd ibn Ghaflah said: I went myself or someone who accompanied the collector of the Prophet صلی اللہ علیہ وسلم told me: It was recorded in the document written by the Messenger of Allah صلی اللہ علیہ وسلم not to accept a milking goat or she-camel or a (suckling) baby (as zakat on animals); and those which are in separate flocks are not to be brought together, and those which are in one flock are not to be separated. The collector used to visit the water-hole when the sheep went there and say: Pay the sadaqah (zakat) on your property. The narrator said: A man wanted to give him his high-humped camel (kawma'). The narrator (Hilal) asked: What is kawma', Abu Salih? He said: A camel a high hump. The narrator continued: He (the collector) refused to accept it. He said: I wish you could take the best of my camels. He refused to accept it. He then brought another camel lower in quality than the previous one. He refused to accept it too. He then brought another camel lower in quality than the previous one. He accepted it, saying: I shall take it, but I am afraid the Messenger of Allah صلی اللہ علیہ وسلم might be angry with me, saying to me: You have purposely taken from a man a camel of your choice. Abu Dawud said: This tradition has also been narrated by Hushaim from Hilal bin Khabbab to the same effect. But he said: Those which are in one flock are not to be separated.

Hadith 1556
Abu Hurairah said When the Messenger of Allah صلی اللہ علیہ وسلم died and Abu Bakr was made his successor after him and certain Arab clans apostatized. Umar bin Al Khattab said to Abu Bakr How can you fight with the people until they say “There is no God but Allah” so whoever says “There is no God but Allah”, he has protected his property and his person from me except for what is due from him, and his reckoning is left to allah. Abu Bak replied I swear by Allah that I will certainly fight with those who make a distinction between prayer and zakat, for zakat is what is due from property. I swear by Allah that if they were to refuse me a rope of camel (or a female kid, according to another version)which they used to pay the Messenger of Allah, I will fight with them over the refusal of it. Umar bin Al Khattab said I swear by Allah, I clearly saw Allah had made Abu Bakr feel justified in tighting and I recognized that it was right. Abu Dawud said This tradition has been transmitted by Rabah bin Zaid from Mamar and Al Zaubaidi from Al Zuhri has “If they were to refuse me a female kid. ” The version transmitted by ‘Anbasah from Yunus on the authority of Al Zuhri has “a female kid”.
