حَدَّثَنِي مُحَمَّدُ بْنُ مِنْهَالٍ الضَّرِيرُ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، حَدَّثَنَا سُفْيَانُ الثَّوْرِيُّ، عَنْ أَبِي حَصِينٍ، عَنْ عُمَيْرِ بْنِ سَعِيدٍ، عَنْ عَلِيٍّ، قَالَ: «مَا كُنْتُ أُقِيمُ عَلَى أَحَدٍ حَدًّا، فَيَمُوتَ فِيهِ، فَأَجِدَ مِنْهُ فِي نَفْسِي، إِلَّا صَاحِبَ الْخَمْرِ، لِأَنَّهُ إِنْ مَاتَ وَدَيْتُهُ، لِأَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لَمْ يَسُنَّهُ
یزید بن زریع نے کہا : ہمیں سفیان ثوری نے ابوحصین سے حدیث بیان کی ، انہوں نے عمیر بن سعد سے اور انہوں نے حضرت علی رضی اللہ عنہ سے روایت کی ، انہوں نے کہا : میں کسی شخص پر حد نہیں لگاتا کہ وہ اس میں مر جائے تو میں اس سے اپنے دل میں کوئی ملال محسوس کروں ، سوائے شراب پینے والے کے ، وہ اگر مر جائے تو میں اس کی دیت ادا کروں گا کیونکہ رسول اللہ صلی اللہ علیہ وسلم نے اس طریقے ( اسی کوڑوں کی سزا ) کو جاری نہیں کیا
Ali reported: If I impose Hadd on anyone, and he (in course of punish ment) dies, I would not mind except in case of a drunkard. If he dies. I would pay indemnity for him because the Messenger of Allah ( صلی اللہ علیہ وسلم ) has laid down no rule for it.
