حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، قَالَ: قُلْتُ لِمَالِكٍ: حَدَّثَكَ نَافِعٌ، عَنِ ابْنِ عُمَرَ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ، فَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ، قُوِّمَ عَلَيْهِ قِيمَةَ الْعَدْلِ، فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ، وَعَتَقَ عَلَيْهِ الْعَبْدُ، وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ

  امام مالک نے نافع سے اور انہوں نے حضرت ابن عمر رضی اللہ عنہ سے روایت کی ، انہوں نے کہا : رسول اللہ صلی اللہ علیہ وسلم نے فرمایا : " جس نے کسی ( مشترکہ ) غلام ( کی ملکیت میں ) سے اپنا حصہ آزاد کیا اور اس کے پاس اتنا مال ہے جو غلام کی قیمت کو پہنچتا ہے تو اس کی مصفانہ قیمت لگائی جائے گی اور اس کے شریکوں کو ان کے حصے دیے جائیں گے اور غلام اس کی طرف سے آزاد ہو جائے گا ورنہ وہ اتنا ہی آزاد رہے گا جتنا پہلے ہو گیا ہے

Ibn 'Umar reported Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) as saying: He who gives up his share in a slave, and has enough money to pay the full price of the slave, then full emancipation devolves upon him; but if he has not the money, then he emancipated what he emancipated.

Umar) reported that Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) found, Umar b. al-Khattab amongst the riders and he was taking oath by his father Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) called them (saying) ; Our Allah, the Exated and Majestic, has forbidden you that you take oath by your father. He who bag to take an oath, he must take it by Allah or keep quiet.

Hadith 4259

Ibn 'Umar heard Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) as saying: He who has to take an oath, he must not take oath but by Allah. The Quraish used to take oath by their fathers. So he (the Holy Prophet) said: Do not take oath by your fathers.
