حَدَّثَنِي عَمْرٌو النَّاقِدُ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، عَنْ سَعِيدٍ الْجُرَيْرِيِّ، عَنْ أَبِي نَضْرَةَ، قَالَ: سَأَلْتُ ابْنَ عَبَّاسٍ عَنِ الصَّرْفِ، فَقَالَ: أَيَدًا بِيَدٍ؟ قُلْتُ: نَعَمْ، قَالَ: فَلَا بَأْسَ بِهِ، فَأَخْبَرْتُ أَبَا سَعِيدٍ، فَقُلْتُ: إِنِّي سَأَلْتُ ابْنَ عَبَّاسٍ عَنِ الصَّرْفِ، فَقَالَ: أَيَدًا بِيَدٍ؟ قُلْتُ: نَعَمْ، قَالَ: فَلَا بَأْسَ بِهِ، قَالَ: أَوَ قَالَ ذَلِكَ؟ إِنَّا سَنَكْتُبُ إِلَيْهِ فَلَا يُفْتِيكُمُوهُ، قَالَ: فَوَاللهِ لَقَدْ جَاءَ بَعْضُ فِتْيَانِ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِتَمْرٍ، فَأَنْكَرَهُ، فَقَالَ: «كَأَنَّ هَذَا لَيْسَ مِنْ تَمْرِ أَرْضِنَا» قَالَ: كَانَ فِي تَمْرِ أَرْضِنَا، أَوْ فِي تَمْرِنَا الْعَامَ بَعْضُ الشَّيْءِ، فَأَخَذْتُ هَذَا وَزِدْتُ بَعْضَ الزِّيَادَةِ، فَقَالَ: «أَضْعَفْتَ، أَرْبَيْتَ، لَا تَقْرَبَنَّ هَذَا، إِذَا رَابَكَ مِنْ تَمْرِكَ شَيْءٌ فَبِعْهُ، ثُمَّ اشْتَرِ الَّذِي تُرِيدُ مِنَ التَّمْرِ»

  سعید جریری نے ابونضرہ سے روایت کی ، انہوں نے کہا : میں نے حضرت ابن عباس رضی اللہ عنہ سے دینار و درہم یا سونے چاندی کے تبادلے کے بارے میں سوال کیا تو انہوں نے کہا : کہا یہ دست بدست ہے؟ میں نے جواب دیا : جی ہاں ، انہوں نے کہا : اس میں کوئی حرج نہیں ۔ میں نے حضرت ابوسعید رضی اللہ عنہ کو خبر دی ، میں نے کہا : میں نے حضرت ابن عباس رضی اللہ عنہ سے دینار و درہم یا سونے چاندی کے تبادلے کے بارے میں سوال کیا تھا تو انہوں نے کہا تھا : کیا دست بدست ہے؟ میں نے جواب دیا تھا : ہاں ، تو انہوں نے کہا تھا : اس میں کوئی حرج نہیں ( انہوں نے ایک ہی جنس کی صورت میں مساوات کی شرط لگائے بغیر اسے علی الاطلاق جائز قرار دیا ۔ ) انہوں ( ابوسعید ) نے کہا : کیا انہوں نے یہ بات کہی ہے؟ ہم ان کی طرف لکھیں گے تو وہ تمہیں ( غیر مشروط جواز کا ) یہ فتویٰ نہیں دیں گے ۔ اللہ کی قسم! رسول اللہ صلی اللہ علیہ وسلم کے خدام سے کوئی کھجوریں لے کر آیا تو آپ نے انہیں نہ پہچانا اور فرمایا : " ایسا لگتا ہے کہ یہ ہماری سرزمین کی کھجوروں میں سے نہیں ہیں ۔ " اس نے کہا : اس سال ہماری زمین کی کھجوروں میں ۔ ۔ یا ہماری کھجوروں میں ۔ ۔ کوئی چیز ( خرابی ) تھی ، میں نے یہ ( عمدہ کھجوریں ) لے لیں اور بدلے میں کچھ زیادہ دے دیں ، تو آپ صلی اللہ علیہ وسلم نے فرمایا : " تم نے دوگنا دیں ، تم نے سود کا لین دین کیا ، اس کے قریب ( بھی ) مت جاؤ ، جب تمہیں اپنی کھجور کے بارے میں کسی چیز ( نقص وغیرہ ) کا شک ہو تو اسے فروخت کرو ، پھر کھجور میں سے تم جو چاہتے ہو ( نقدی کے عوج ) خرید لو ۔ "

Abu Nadra reported: I asked Ibn Abbas (Allah be pleased with them) about the conversion (of gold and silver for silver and gold). We said: Is it hand to hand exchange? I said: Yes. whereupon he said: There is no harm in it. I informed Abu Sa'id about it, telling him that I had asked Ibn 'Abbas about it and he said: Is it hand to hand exchange? I said: Yes, whereupon he said: There is no harm in it. He (the narrator) said, or he said like it: We will soon write to him, and he will not give you this fatwa (religious verdict). He said: By Allah, someone of the boy-servants of Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) brought dates, but he refused to accept them (on the plea) that those did not seem to be of the dates of our land. He said: Something had happened to the dates of our land, or our dates. So I got these dates (in exchange by giving) excess (of the dates of our land), whereupon he said: You made an addition for getting the fine dates (in exchange) which tantamounts, to interest; don't do that (in future). Whenever you find some doubt (as regards the deteriorating quality of) your dates, sell them, and then buy the dates that you like.

Hadith 3963

Ibn Umar (Allah be pleased with them) reported: Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) handed over the land of Khaibar (on the condition) of the share of produce of fruits and harvest, and he also gave to his wives every year one hundred wasqs: eighty wasqs of dates and twenty wasqs of barley. When 'Umar became the caliph he distributed the (lands and trees) of Khaibar, and gave option to the wives of Allah's Apostle ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) to earmark for themselves the land and water or stick to the wasqs (that they got) every year. They differed in this matter. Some of them opted for land and water, and some of them opted for wasqs every year. 'A'isha and Hafsa were among those who opted for land and water.

Hadith 3964

Abdullah b. Umar (Allah be pleased with them) reported that Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) contracted with the people of Khaibar (land and trees on the condition that they should give) half of the yield from land and trees. The rest of the hadith is the same. In the hadith transmitted on the authority of AIi b. Mushir there is no mention of it, but that A'isha and Hafsa were those who opted for land and water, but he (the narrator) said: He (Hadrat 'Umar, gave option to the wives of Allah's Apostle ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) that land would be earmarked for them, but he made no mention of water.

Hadith 3965

Abdullah b. Umar (Allah be pleased with them) reported that when Khaibar had been conquered, the Jews asked Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) to let them continue (cultivation in those lands) on half of the share of yield in fruits and crop, whereupon Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) said: I will allow you to continue here, so long as we would desire. The rest of the hadith is the same, but with this addition: The fruit would be distributed equal to the half of Khaibar. And out of hall of the produce of the land, Allah's Apostle (may peace be be upon him) got the fifth part.

Hadith 3966

Abdullah b. Umar (Allah be pleased with them) reported that Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) returned to the Jews of Khaibar the date-palms of Khaibar and its land on the condition that they should work upon them with their own wealth (seeds, implements), and give half of the yield to Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ).

Hadith 3967

Ibn Umar reported that 'Umar b. al-Khattab (Allah be pleased with him) expelled the Jews and Christians from the land of Hijaz, and that when Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) conquered Khaibar he made up his mind to expel the Jews from it (the territory of Khaibar) because, when that land was conquered, it came under the sway of Allah, that of His Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) and that of the Muslims. The jews asked Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) to let them continue there on the condition that they would work on it, and would get in turn half of the fruit (of the trees), whereupon Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) said: We would let you continue there so long as we will desire. So they continued (to cultivate the lands) till 'Umar externed them to Taima' ang Ariha (two villages in Arabia, but out of Hijaz).
