حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا لَيْثٌ، ح وحَدَّثَنَا مُحَمَّدُ بْنُ رُمْحٍ، أَخْبَرَنَا اللَّيْثُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنْ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: «إِذَا تَبَايَعَ الرَّجُلَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا، وَكَانَا جَمِيعًا، أَوْ يُخَيِّرُ أَحَدُهُمَا الْآخَرَ، فَإِنْ خَيَّرَ أَحَدُهُمَا الْآخَرَ فَتَبَايَعَا عَلَى ذَلِكِ، فَقَدْ وَجَبَ الْبَيْعُ، وَإِنْ تَفَرَّقَا بَعْدَ أَنْ تَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ، فَقَدْ وَجَبَ الْبَيْعُ

  لیث نے ہمیں نافع سے خبر دی ، انہوں نے حضرت ابن عمر رضی اللہ عنہ سے اور انہوں نے رسول اللہ صلی اللہ علیہ وسلم سے روایت کی کہ آپ نے فرمایا : " جب دو آدمی باہم بیع کریں تو دونوں میں سے ہر ایک کو ( سودا ختم کرنے کا ) اختیار ہے جب تک وہ دونوں جدا نہ ہو جائیں اور اکٹھے ہوں ۔ یا ان دونوں میں سے ایک دوسرے کو اختیار دے ، اگر ان میں سے ایک دوسرے کو اختیار دے اور اسی پر دونوں بیع کر لیں تو بیع لازم ہو گئی ، اور اگر باہم بیع کرنے کے بعد دونوں جدا ہوئے اور ان میں سے کسی نے بیع کو ترک نہیں کیا تو بھی بیع لازم ہو گئی

Ibn 'Umar (Allah be pleased with thcm) reported Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) as saying: When two persons enter into a transaction, each of them has the right to annul it so long as they are not separated and are together (at the place of transaction) ; or if one gives the other the right (to annul the transaction) But if one gives the other the option, the transaction is made on this condition (i. e. one has the right to annul the transaction), it becomes binding. And if they are separated after they have made the bargain and none of them annulled it, even then the transaction is binding.

Hadith 3805

Abu Huraira (Allah be pleased with him) reported: Two types of trarisactions have been forbidden (by the Holy Prophet), al-Mlulamasa and al-Munabadha. As far as Mulamasa transaction is concerned, it is that every one of them (the parties entering into transaction) should touch the garment of the other without careful consideration, and al-Munabadha is that every one of them should throw his cloth to the other and one of them should not see the cloth of his friend.

Hadith 3806

Abu Sa'id al-Khudri (Allah be pleased with him) reported: Allah's Messenger ( ‌صلی ‌اللہ ‌علیہ ‌وسلم ‌ ) forbade us (from), two types of business transactions and two ways of dressing. He forbade Mulamasa and Munabadha in transactions. Mulamasa means the touching of another's garment with his hand, whether at night or by day, without turning it over except this much. Munabadha means that a man throws his garment to another and the other throws his garment, and thus confirming their contract without the inspection of mutual agreement.
