حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ ، حَدَّثَنَا سُفْيَانُ ، عَنْ عَمْرٍو ، عَنْ مُجَاهِدٍ ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، قَالَ : كَانَتْ فِي بَنِي إِسْرَائِيلَ قِصَاصٌ وَلَمْ تَكُنْ فِيهِمُ الدِّيَةُ ، فَقَالَ اللَّهُ لِهَذِهِ الْأُمَّةِ : كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى إِلَى هَذِهِ الْآيَةِ فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْءٌ سورة البقرة آية 178 ، قَالَ ابْنُ عَبَّاسٍ ، فَالْعَفْوُ أَنْ يَقْبَلَ الدِّيَةَ فِي الْعَمْدِ ، قَالَ : فَاتِّبَاعٌ بِالْمَعْرُوفِ أَنْ يَطْلُبَ بِمَعْرُوفٍ وَيُؤَدِّيَ بِإِحْسَانٍ .
ہم سے قتیبہ بن سعید نے بیان کیا، انہوں نے کہا ہم سے سفیان بن عیینہ نے بیان کیا، ان سے عمرو بن دینار نے بیان کیا، ان سے مجاہد بن جبیر نے بیان کیا، اور ان سے عبداللہ بن عباس رضی اللہ عنہما نے بیان کیا کہ بنی اسرائیل میں صرف قصاص کا رواج تھا، دیت کی صورت نہیں تھی۔ پھر اس امت کے لیے یہ حکم نازل ہوا «كتب عليكم القصاص في القتلى» الخ۔ ابن عباس نے کہا «فمن عفي له من أخيه شىء» سے یہی مراد ہے کہ مقتول کے وارث قتل عمد میں دیت پر راضی ہو جائیں اور «فاتباع بالمعروف» سے یہ مراد ہے کہ مقتول کے وارث دستور کے موافق قاتل سے دیت کا تقاضا کریں «وآداء اليه باحسان» سے یہ مراد ہے کہ قاتل اچھی طرح خوش دلی سے دیت ادا کرے۔
Narrated Ibn `Abbas: For the children of Israel the punishment for crime was Al-Qisas only (i.e., the law of equality in punishment) and the payment of Blood money was not permitted as an alternate. But Allah said to this nation (Muslims): 'O you who believe! Qisas is prescribed for you in case of murder, .....(up to) ...end of the Verse. (2.178) Ibn `Abbas added: Remission (forgiveness) in this Verse, means to accept the Blood-money in an intentional murder. Ibn `Abbas added: The Verse: 'Then the relatives should demand Blood-money in a reasonable manner.' (2.178) means that the demand should be reasonable and it is to be compensated with handsome gratitude.

Narrated `Abdullah: A man said, O Allah's Apostle! Which sin is the greatest in Allah's Sight? The Prophet said, To set up a rival unto Allah though He Alone created you . The man said, What is next? The Prophet said, To kill your son lest he should share your food with you. The man said, What is next? The Prophet said, To commit illegal sexual intercourse with the wife of your neighbor. So Allah revealed in confirmation of this narration:-- 'And those who invoke not with Allah, any other god. Nor kill, such life as Allah has forbidden except for just cause nor commit illegal sexual intercourse. And whoever does this shall receive the punishment.' (25.68)

Narrated Al-Miqdad bin `Amr Al-Kindi: An ally of Bani Zuhra who took part in the battle of Badr with the Prophet, that he said, O Allah's Apostle! If I meet an unbeliever and we have a fight, and he strikes my hand with the sword and cuts it off, and then takes refuge from me under a tree, and says, 'I have surrendered to Allah (i.e. embraced Islam),' may I kill him after he has said so? Allah's Apostle said, Do not kill him. Al- Miqdad said, But O Allah's Apostle! He had chopped off one of my hands and he said that after he had cut it off. May I kill him? The Prophet said. Do not kill him for if you kill him, he would be in the position in which you had been before you kill him, and you would be in the position in which he was before he said the sentence.
