حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ ، حَدَّثَنَا اللَّيْثُ ، عَنْ جَعْفَرِ بْنِ رَبِيعَةَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ هُرْمُزَ الْأَعْرَجِ ، قَالَ : أَخْبَرَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ ، أَنَّ زَيْنَبَ بِنْتَ أَبِي سَلَمَةَ أَخْبَرَتْهُ ، عَنْ أُمِّهَا أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّ امْرَأَةً مِنْ أَسْلَمَ يُقَالُ لَهَا : سُبَيْعَةُ كَانَتْ تَحْتَ زَوْجِهَا تُوُفِّيَ عَنْهَا وَهِيَ حُبْلَى ، فَخَطَبَهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ ، فَأَبَتْ أَنْ تَنْكِحَهُ ، فَقَالَ : وَاللَّهِ مَا يَصْلُحُ أَنْ تَنْكِحِيهِ حَتَّى تَعْتَدِّي آخِرَ الْأَجَلَيْنِ ، فَمَكُثَتْ قَرِيبًا مِنْ عَشْرِ لَيَالٍ ، ثُمَّ جَاءَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : انْكِحِي .
ہم سے یحییٰ بن بکیر نے بیان کیا، کہا ہم سے لیث بن سعد نے بیان کیا، ان سے جعفر بن ربیعہ نے، ان سے عبدالرحمٰن بن ہرمز نے، کہا کہ مجھے خبر دی ابوسلمہ بن عبدالرحمٰن نے کہ زینب ام سلمہ رضی اللہ عنہا نے اپنی والدہ نبی کریم صلی اللہ علیہ وسلم کی زوجہ مطہرہ ام سلمہ رضی اللہ عنہا سے خبر دی کہ ایک خاتون جو اسلام لائی تھیں اور جن کا نام سبیعہ تھا، اپنے شوہر کے ساتھ رہتی تھیں، شوہر کا جب انتقال ہوا تو وہ حاملہ تھیں۔ ابوسنان بن بعکک رضی اللہ عنہ نے ان کے پاس نکاح کا پیغام بھیجا لیکن انہوں نے نکاح کرنے سے انکار کیا۔ ابوالسنابل نے کہا کہ اللہ کی قسم! جب تک عدت کی دو مدتوں میں سے لمبی نہ گزار لوں گی، تمہارے لیے اس سے ( جس سے نکاح وہ کرنا چاہتی تھیں ) نکاح کرنا صحیح نہیں ہو گا۔ پھر وہ ( وضع حمل کے بعد ) تقریباً دس دن تک رکی رہیں۔ اس کے بعد نبی کریم صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئیں تو نبی کریم صلی اللہ علیہ وسلم نے فرمایا کہ اب نکاح کر لو۔
Narrated Um Salama: (the wife of the Prophet) A lady from Bani Aslam, called Subai'a, become a widow while she was pregnant. Abu As-Sanabil bin Ba'kak demanded her hand in marriage, but she refused to marry him and said, By Allah, I cannot marry him unless I have completed one of the two prescribed periods. About ten days later (after having delivered her child), she went to the Prophet and he said (to her), You can marry now.

Hadith 5251
Narrated `Abdullah bin `Umar: that he had divorced his wife while she was menstruating during the lifetime of Allah's Apostle . `Umar bin Al-Khattab asked Allah's Apostle about that. Allah's Apostle said, Order him (your son) to take her back and keep her till she is clean and then to wait till she gets her next period and becomes clean again, whereupon, if he wishes to keep her, he can do so, and if he wishes to divorce her he can divorce her before having sexual intercourse with her; and that is the prescribed period which Allah has fixed for the women meant to be divorced.

Narrated Yunus bin Jubair: Ibn `Umar said, The Prophet said to `Umar, 'Order him (Ibn `Umar) to take her back.' I asked, Is such a divorce counted (as one legal divorce)? Ibn `Umar said, What do you think if someone becomes helpless and foolish?

He said, You have sought refuge with The Great; return to your family.

Narrated Abu Usaid: We went out with the Prophet to a garden called Ash-Shaut till we reached two walls between which we sat down. The Prophet said, Sit here, and went in (the garden). The Jauniyya (a lady from Bani Jaun) had been brought and lodged in a house in a date-palm garden in the home of Umaima bint An- Nu`man bin Sharahil, and her wet nurse was with her. When the Prophet entered upon her, he said to her, Give me yourself (in marriage) as a gift. She said, Can a princess give herself in marriage to an ordinary man? The Prophet raised his hand to pat her so that she might become tranquil. She said, I seek refuge with Allah from you. He said, You have sought refuge with One Who gives refuge. Then the Prophet came out to us and said, O Abu Usaid! Give her two white linen dresses to wear and let her go back to her family.
