حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا سُفْيَانُ ، قَالَ عَمْرٌو : سَمِعْتُ سَعِيدَ بْنَ جُبَيْرٍ ، قَالَ : سَأَلْتُ ابْنَ عُمَرَ عَنْ حَدِيثِ الْمُتَلَاعِنَيْنِ ، فَقَالَ : قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْمُتَلَاعِنَيْنِ : حِسَابُكُمَا عَلَى اللَّهِ ، أَحَدُكُمَا كَاذِبٌ لَا سَبِيلَ لَكَ عَلَيْهَا ، قَالَ : مَالِي ؟ قَالَ : لَا مَالَ لَكَ إِنْ كُنْتَ صَدَقْتَ عَلَيْهَا فَهُوَ بِمَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا ، وَإِنْ كُنْتَ كَذَبْتَ عَلَيْهَا فَذَاكَ أَبْعَدُ لَكَ ، قَالَ سُفْيَانُ : حَفِظْتُهُ مِنْ عَمْرٍو . وَقَالَ أَيُّوبُ : سَمِعْتُ سَعِيدَ بْنَ جُبَيْرٍ ، قَالَ : قُلْتُ لِابْنِ عُمَرَ : رَجُلٌ لَاعَنَ امْرَأَتَهُ ، فَقَالَ بِإِصْبَعَيْهِ ، وَفَرَّقَ سُفْيَانُ بَيْنَ إِصْبَعَيْهِ السَّبَّابَةِ وَالْوُسْطَى ، فَرَّقَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَ أَخَوَيْ بَنِي الْعَجْلَانِ ، وَقَالَ : اللَّهُ يَعْلَمُ إِنَّ أَحَدَكُمَا كَاذِبٌ ، فَهَلْ مِنْكُمَا تَائِبٌ ؟ ثَلَاثَ مَرَّاتٍ ، قَالَ سُفْيَانُ : حَفِظْتُهُ مِنْ عَمْرٍو وأَيُّوبَ كَمَا أَخْبَرْتُكَ .
ہم سے علی بن عبداللہ مدینی نے بیان کیا، کہا ہم سے سفیان بن عیینہ نے بیان کیا کہ عمرو نے کہا کہ میں نے سعید بن جبیر سے سنا، انہوں نے بیان کیا کہ میں نے ابن عمر رضی اللہ عنہما سے لعان کرنے والوں کا حکم پوچھا تو انہوں نے بیان کیا کہ ان کے متعلق رسول اللہ صلی اللہ علیہ وسلم نے فرمایا تھا کہ تمہارا حساب تو اللہ تعالیٰ کے ذمہ ہے۔ تم میں سے ایک جھوٹا ہے۔ اب تمہیں تمہاری بیوی پر کوئی اختیار نہیں۔ ان صحابی نے عرض کیا کہ میرا مال واپس کرا دیجئیے ( جو مہر میں دیا گیا تھا ) ۔ نبی کریم صلی اللہ علیہ وسلم نے فرمایا کہ اب وہ تمہارا مال نہیں ہے۔ اگر تم اس کے معاملہ میں سچے ہو تو تمہارا یہ مال اس کے بدلہ میں ختم ہو چکا کہ تم نے اس کی شرمگاہ کو حلال کیا تھا اور اگر تم نے اس پر جھوٹی تہمت لگائی تھی پھر تو وہ تم سے بعید تر ہے۔ سفیان نے بیان کیا کہ یہ حدیث میں نے عمرو سے یاد کی اور ایوب نے بیان کیا کہ میں نے سعید بن جبیر سے سنا، کہا کہ میں نے ابن عمر رضی اللہ عنہما سے ایسے شخص کے متعلق پوچھا جس نے اپنی بیوی سے لعان کیا ہو تو آپ نے اپنی دو انگلیوں سے اشارہ کیا۔ سفیان نے اس اشارہ کو اپنی دو شہادت اور بیچ کی انگلیوں کو جدا کر کے بتایا کہ نبی کریم صلی اللہ علیہ وسلم نے قبیلہ بنی عجلان کے میاں بیوی کے درمیان جدائی کرائی تھی اور فرمایا تھا کہ اللہ جانتا ہے کہ تم میں سے ایک جھوٹا ہے، تو کیا وہ رجوع کر لے گا؟ آپ نے تین مرتبہ یہ فرمایا۔ علی بن عبداللہ مدینی نے کہا کہ سفیان بن عیینہ نے مجھ سے کہا، میں نے یہ حدیث جیسے عمرو بن دینار اور ایوب سے سن کر یاد رکھی تھی ویسی ہی تجھ سے بیان کر دی۔
Narrated Sa`id bin Jubair: I asked Ibn `Umar about those who were involved in a case of Lien. He said, The Prophet said to those who were involved in a case of Lien, 'Your accounts are with Allah. One of you two is a liar, and you (the husband) have no right over her (she is divorced). The man said, 'What about my property (Mahr) ?' The Prophet said, 'You have no right to get back your property. If you have told the truth about her then your property was for the consummation of your marriage with her; and if you told a lie about her, then you are less rightful to get your property back.' Sufyan, a sub-narrator said: I learned the Hadith from `Amr. Narrated Aiyub: I heard Sa`id bin Jubair saying, I asked Ibn `Umar, 'If a man (accuses his wife for an illegal sexual intercourse and) carries out the process of Lian (what will happen)?' Ibn `Umar set two of his fingers apart. (Sufyan set his index finger and middle finger apart.) Ibn `Umar said, 'The Prophet separated the couple of Bani Al-Ajlan by divorce and said thrice, Allah knows that one of you two is a liar; so will one of you repent (to Allah)?'

Hadith 5251
Narrated `Abdullah bin `Umar: that he had divorced his wife while she was menstruating during the lifetime of Allah's Apostle . `Umar bin Al-Khattab asked Allah's Apostle about that. Allah's Apostle said, Order him (your son) to take her back and keep her till she is clean and then to wait till she gets her next period and becomes clean again, whereupon, if he wishes to keep her, he can do so, and if he wishes to divorce her he can divorce her before having sexual intercourse with her; and that is the prescribed period which Allah has fixed for the women meant to be divorced.

Narrated Abu Usaid: We went out with the Prophet to a garden called Ash-Shaut till we reached two walls between which we sat down. The Prophet said, Sit here, and went in (the garden). The Jauniyya (a lady from Bani Jaun) had been brought and lodged in a house in a date-palm garden in the home of Umaima bint An- Nu`man bin Sharahil, and her wet nurse was with her. When the Prophet entered upon her, he said to her, Give me yourself (in marriage) as a gift. She said, Can a princess give herself in marriage to an ordinary man? The Prophet raised his hand to pat her so that she might become tranquil. She said, I seek refuge with Allah from you. He said, You have sought refuge with One Who gives refuge. Then the Prophet came out to us and said, O Abu Usaid! Give her two white linen dresses to wear and let her go back to her family.
