قَالَ يَحْيَى بْنُ سُلَيْمَانَ ، حَدَّثَنَا ابْنُ وَهْبٍ ، عَنْ يُونُسَ . ح وحَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ ، حَدَّثَنَا عَنْبَسَةُ ، حَدَّثَنَا يُونُسُ ، عَنْ ابْنِ شِهَابٍ ، قَالَ :أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ ، أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَخْبَرَتْهُ ، أَنَّ النِّكَاحَ فِي الْجَاهِلِيَّةِ كَانَ عَلَى أَرْبَعَةِ أَنْحَاءٍ : فَنِكَاحٌ مِنْهَا نِكَاحُ النَّاسِ ، الْيَوْمَ يَخْطُبُ الرَّجُلُ إِلَى الرَّجُلِ وَلِيَّتَهُ أَوِ ابْنَتَهُ فَيُصْدِقُهَا ثُمَّ يَنْكِحُهَا ، وَنِكَاحٌ آخَرُ كَانَ الرَّجُلُ يَقُولُ لِامْرَأَتِهِ إِذَا طَهُرَتْ مِنْ طَمْثِهَا : أَرْسِلِي إِلَى فُلَانٍ فَاسْتَبْضِعِي مِنْهُ ، وَيَعْتَزِلُهَا زَوْجُهَا وَلَا يَمَسُّهَا أَبَدًا حَتَّى يَتَبَيَّنَ حَمْلُهَا مِنْ ذَلِكَ الرَّجُلِ الَّذِي تَسْتَبْضِعُ مِنْهُ ، فَإِذَا تَبَيَّنَ حَمْلُهَا أَصَابَهَا زَوْجُهَا إِذَا أَحَبَّ ، وَإِنَّمَا يَفْعَلُ ذَلِكَ رَغْبَةً فِي نَجَابَةِ الْوَلَدِ ، فَكَانَ هَذَا النِّكَاحُ نِكَاحَ الِاسْتِبْضَاعِ ، وَنِكَاحٌ آخَرُ يَجْتَمِعُ الرَّهْطُ مَا دُونَ الْعَشَرَةِ فَيَدْخُلُونَ عَلَى الْمَرْأَةِ كُلُّهُمْ يُصِيبُهَا فَإِذَا حَمَلَتْ وَوَضَعَتْ وَمَرَّ عَلَيْهَا لَيَالٍ بَعْدَ أَنْ تَضَعَ حَمْلَهَا أَرْسَلَتْ إِلَيْهِمْ فَلَمْ يَسْتَطِعْ رَجُلٌ مِنْهُمْ أَنْ يَمْتَنِعَ حَتَّى يَجْتَمِعُوا عِنْدَهَا تَقُولُ لَهُمْ قَدْ عَرَفْتُمُ الَّذِي كَانَ مِنْ أَمْرِكُمْ وَقَدْ وَلَدْتُ فَهُوَ ابْنُكَ يَا فُلَانُ تُسَمِّي مَنْ أَحَبَّتْ بِاسْمِهِ فَيَلْحَقُ بِهِ وَلَدُهَا لَا يَسْتَطِيعُ أَنْ يَمْتَنِعَ بِهِ الرَّجُلُ ، وَنِكَاحُ الرَّابِعِ يَجْتَمِعُ النَّاسُ الْكَثِيرُ فَيَدْخُلُونَ عَلَى الْمَرْأَةِ لَا تَمْتَنِعُ مِمَّنْ جَاءَهَا وَهُنَّ الْبَغَايَا كُنَّ يَنْصِبْنَ عَلَى أَبْوَابِهِنَّ رَايَاتٍ تَكُونُ عَلَمًا فَمَنْ أَرَادَهُنَّ دَخَلَ عَلَيْهِنَّ فَإِذَا حَمَلَتْ إِحْدَاهُنَّ وَوَضَعَتْ حَمْلَهَا جُمِعُوا لَهَا وَدَعَوْا لَهُمُ الْقَافَةَ ثُمَّ أَلْحَقُوا وَلَدَهَا بِالَّذِي يَرَوْنَ فَالْتَاطَ بِهِ وَدُعِيَ ابْنَهُ لَا يَمْتَنِعُ مِنْ ذَلِكَ ، فَلَمَّا بُعِثَ مُحَمَّدٌ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْحَقِّ هَدَمَ نِكَاحَ الْجَاهِلِيَّةِ كُلَّهُ إِلَّا نِكَاحَ النَّاسِ الْيَوْمَ .

ہم سے یحییٰ بن سلیمان نے بیان کیا، کہا ہم سے عبداللہ بن وہب نے بیان کیا، ان سے یونس نے (دوسری سند) امام بخاری رحمہ اللہ نے کہا ہم سے احمد بن صالح نے بیان کیا، کہا ہم سے عنبسہ بن خالد نے بیان کیا، کہا ہم سے یونس نے بیان کیا، ان سے ابن شہاب نے، کہا کہ مجھے عروہ بن زبیر نے خبر دی   اور انہیں نبی کریم صلی اللہ علیہ وسلم کی زوجہ مطہرہ عائشہ رضی اللہ عنہا نے خبر دی کہ زمانہ جاہلیت میں نکاح چار طرح ہوتے تھے۔ ایک صورت تو یہی تھی جیسے آج کل لوگ کرتے ہیں، ایک شخص دوسرے شخص کے پاس اس کی زیر پرورش لڑکی یا اس کی بیٹی کے نکاح کا پیغام بھیجتا اور اس کا مہر دے کر اس سے نکاح کر لیتا۔ دوسرا نکاح یہ تھا کہ کوئی شوہر اپنی بیوی سے جب وہ حیض سے پاک ہو جاتی تو کہتا تو فلاں شخص کے پاس چلی جا اور اس سے منہ کالا کرا لے اس مدت میں شوہر اس سے جدا رہتا اور اسے چھوتا بھی نہیں۔ پھر جب اس غیر مرد سے اس کا حمل ظاہر ہو جاتا جس سے وہ عارضی طور پر صحبت کرتی رہتی، تو حمل کے ظاہر ہونے کے بعد اس کا شوہر اگر چاہتا تو اس سے صحبت کرتا۔ ایسا اس لیے کرتے تھے تاکہ ان کا لڑکا شریف اور عمدہ پیدا ہو۔ یہ نکاح ”استبضاع“ کہلاتا تھا۔ تیسری قسم نکاح کی یہ تھی کہ چند آدمی جو تعداد میں دس سے کم ہوتے کسی ایک عورت کے پاس آنا جانا رکھتے اور اس سے صحبت کرتے۔ پھر جب وہ عورت حاملہ ہوتی اور بچہ جنتی تو وضع حمل پر چند دن گزرنے کے بعد وہ عورت اپنے ان تمام مردوں کو بلاتی۔ اس موقع پر ان میں سے کوئی شخص انکار نہیں کر سکتا تھا۔ چنانچہ وہ سب اس عورت کے پاس جمع ہو جاتے اور وہ ان سے کہتی کہ جو تمہارا معاملہ تھا وہ تمہیں معلوم ہے اور اب میں نے یہ بچہ جنا ہے۔ پھر وہ کہتی کہ اے فلاں! یہ بچہ تمہارا ہے۔ وہ جس کا چاہتی نام لے دیتی اور وہ لڑکا اسی کا سمجھا جاتا، وہ شخص اس سے انکار کی جرات نہیں کر سکتا تھا۔ چوتھا نکاح اس طور پر تھا کہ بہت سے لوگ کسی عورت کے پاس آیا جایا کرتے تھے۔ عورت اپنے پاس کسی بھی آنے والے کو روکتی نہیں تھی۔ یہ کسبیاں ہوتی تھیں۔ اس طرح کی عورتیں اپنے دروازوں پر جھنڈے لگائے رہتی تھیں جو نشانی سمجھے جاتے تھے۔ جو بھی چاہتا ان کے پاس جاتا۔ اس طرح کی عورت جب حاملہ ہوتی اور بچہ جنتی تو اس کے پاس آنے جانے والے جمع ہوتے اور کسی قیافہ جاننے والے کو بلاتے اور بچہ کا ناک نقشہ جس سے ملتا جلتا ہوتا اس عورت کے اس لڑکے کو اسی کے ساتھ منسوب کر دیتے اور وہ بچہ اسی کا بیٹا کہا جاتا، اس سے کوئی انکار نہیں کرتا تھا۔ پھر جب محمد صلی اللہ علیہ وسلم حق کے ساتھ رسول ہو کر تشریف لائے آپ نے جاہلیت کے تمام نکاحوں کو باطل قرار دے دیا صرف اس نکاح کو باقی رکھا جس کا آج کل رواج ہے۔

Narrated 'Urwa bin Az-Zubair: 'Aishah, the wife of the Prophet (saws) told him that there were four types of marriage during Pre-Islamic period of Ignorance. One type was similar to that of the present day i.e. a man used to ask somebody else for the hand of a girl under his guardianship or for his daughter's hand, and give her Mahr and then marry her. The second type was that a man would say to his wife after she had become clean from her period. Send for so-and-so and have sexual intercourse with him. Her husband would then keep awy from her and would never sleep with her till she got pregnant from the other man with whom she was sleeping. When her pregnancy became evident, he husband would sleep with her if he wished. Her husband did so (i.e. let his wife sleep with some other man) so that he might have a child of noble breed. Such marriage was called as Al-Istibda'. Another type of marriage was that a group of less than ten men would assemble and enter upon a woman, and all of them would have sexual relation with her. If she became pregnant and delivered a child and some days had passed after delivery, she would sent for all of them and none of them would refuse to come, and when they all gathered before her, she would say to them, You (all) know waht you have done, and now I have given birth to a child. So, it is your child so-and-so! naming whoever she liked, and her child would follow him and he could not refuse to take him. The fourth type of marriage was that many people would enter upon a lady and she would never refuse anyone who came to her. Those were the prostitutes who used to fix flags at their doors as sign, and he who would wished, could have sexual intercourse with them. If anyone of them got pregnant and delivered a child, then all those men would be gathered for her and they would call the Qa'if (persons skilled in recognizing the likeness of a child to his father) to them and would let the child follow the man (whom they recognized as his father) and she would let him adhere to him and be called his son. The man would not refuse all that. But when Muhammad (saws) was sent with the Truth, he abolished all the types of marriages observed in pre-Islamic period of Ignorance except the type of marriage the people recognize today.

Hadith 5063

Narrated Anas bin Malik: A group of three men came to the houses of the wives of the Prophet asking how the Prophet worshipped (Allah), and when they were informed about that, they considered their worship insufficient and said, Where are we from the Prophet as his past and future sins have been forgiven. Then one of them said, I will offer the prayer throughout the night forever. The other said, I will fast throughout the year and will not break my fast. The third said, I will keep away from the women and will not marry forever. Allah's Apostle came to them and said, Are you the same people who said so-and-so? By Allah, I am more submissive to Allah and more afraid of Him than you; yet I fast and break my fast, I do sleep and I also marry women. So he who does not follow my tradition in religion, is not from me (not one of my followers).

Hadith 5064

Narrated 'Urwa: that he asked `Aisha about the Statement of Allah: 'If you fear that you shall not be able to deal justly with the orphan girls, then marry (other) women of your choice, two or three or four; but if you fear that you shall not be able to deal justly (with them), then only one, or (the captives) that your right hands possess. That will be nearer to prevent you from doing injustice.' (4.3) `Aisha said, O my nephew! (This Verse has been revealed in connection with) an orphan girl under the guardianship of her guardian who is attracted by her wealth and beauty and intends to marry her with a Mahr less than what other women of her standard deserve. So they (such guardians) have been forbidden to marry them unless they do justice to them and give them their full Mahr, and they are ordered to marry other women instead of them.

Hadith 5065

Narrated 'Alqama: While I was with `Abdullah, `Uthman met him at Mina and said, O Abu `Abdur-Rahman ! I have something to say to you. So both of them went aside and `Uthman said, O Abu `Abdur-Rah. man! Shall we marry you to a virgin who will make you remember your past days? When `Abdullah felt that he was not in need of that, he beckoned me (to join him) saying, O 'Alqama! Then I heard him saying (in reply to `Uthman), As you have said that, (I tell you that) the Prophet once said to us, 'O young people! Whoever among you is able to marry, should marry, and whoever is not able to marry, is recommended to fast, as fasting diminishes his sexual power.

Hadith 5066

Narrated `Abdullah: We were with the Prophet while we were young and had no wealth whatever. So Allah's Apostle said, O young people! Whoever among you can marry, should marry, because it helps him lower his gaze and guard his modesty (i.e. his private parts from committing illegal sexual intercourse etc.), and whoever is not able to marry, should fast, as fasting diminishes his sexual power.

Hadith 5067

Narrated 'Ata: We presented ourselves along with Ibn `Abbas at the funeral procession of Maimuna at a place called Sarif. Ibn `Abbas said, This is the wife of the Prophet so when you lift her bier, do not Jerk it or shake it much, but walk smoothly because the Prophet had nine wives and he used to observe the night turns with eight of them, and for one of them there was no night turn.
