وَقَالَ لَنَا أَحْمَدُ بْنُ حَنْبَلٍ : حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنْ سُفْيَانَ ، حَدَّثَنِي حَبِيبٌ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، عَنْ ابْنِ عَبَّاسٍ ، حَرُمَ مِنَ النَّسَبِ سَبْعٌ ، وَمِنَ الصِّهْرِ سَبْعٌ ، ثُمَّ قَرَأَ : حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ سورة النساء آية 23 الْآيَةَ ، وَجَمَعَ عَبْدُ اللَّهِ بْنُ جَعْفَرٍ بَيْنَ ابْنَةِ عَلِيٍّ وَامْرَأَةِ عَلِيٍّ ، وَقَالَ ابْنُ سِيرِينَ : لَا بَأْسَ بِهِ ، وَكَرِهَهُ الْحَسَنُ مَرَّةً ، ثُمَّ قَالَ : لَا بَأْسَ بِهِ ، وَجَمَعَ الْحَسَنُ بْنُ الْحَسَنِ بْنِ عَلِيٍّ بَيْنَ ابْنَتَيْ عَمٍّ فِي لَيْلَةٍ ، وَكَرِهَهُ جَابِرُ بْنُ زَيْدٍ لِلْقَطِيعَةِ ، وَلَيْسَ فِيهِ تَحْرِيمٌ لِقَوْلِهِ تَعَالَى : وَأُحِلَّ لَكُمْ مَا وَرَاءَ ذَلِكُمْ سورة النساء آية 24 ، وَقَالَ عِكْرِمَةُ : عَنْ ابْنِ عَبَّاسٍ ، إِذَا زَنَى بِأُخْتِ امْرَأَتِهِ ، لَمْ تَحْرُمْ عَلَيْهِ امْرَأَتُهُ ، وَيُرْوَى عَنْ يَحْيَى الْكِنْدِيِّ ، عَنْ الشَّعْبِيِّ ، وأَبِي جَعْفَرٍ ، فِيمَنْ يَلْعَبُ بِالصَّبِيِّ ، إِنْ أَدْخَلَهُ فِيهِ ، فَلَا يَتَزَوَّجَنَّ أُمَّهُ ، ويَحْيَى هَذَا غَيْرُ مَعْرُوفٍ وَلَمْ يُتَابَعْ عَلَيْهِ ، وَقَالَ عِكْرِمَةُ : عَنْ ابْنِ عَبَّاسٍ : إِذَا زَنَى بِهَا لَمْ تَحْرُمْ عَلَيْهِ امْرَأَتُهُ ، وَيُذْكَرُ عَنْ أَبِي نَصْرٍ ، أَنَّ ابْنَ عَبَّاسٍ حَرَّمَهُ ، وأَبُو نَصْرٍ هَذَا لَمْ يُعْرَفْ بِسَمَاعِهِ مِنْ ابْنِ عَبَّاسٍ ، وَيُرْوَى عَنْ عِمْرَانَ بْنِ حُصَيْنٍ ، وجَابِرِ بْنِ زَيْدٍ ، والْحَسَنِ ، وَبَعْضِ أَهْلِ الْعِرَاقِ تَحْرُمُ عَلَيْهِ ، وَقَالَ أَبُو هُرَيْرَةَ : لَا تَحْرُمُ حَتَّى يُلْزِقَ بِالْأَرْضِ يَعْنِي يُجَامِعَ وَجَوَّزَهُ ابْنُ الْمُسَيَّبِ ، وعُرْوَةُ ، والزُّهْرِيُّ ، وَقَالَ الزُّهْرِيُّ : قَالَ عَلِيٌّ : لَا تَحْرُمُ ، وَهَذَا مُرْسَلٌ.

اور امام احمد بن حنبل نے مجھ سے کہا کہ ہم سے یحییٰ بن سعید قطان نے بیان کیا، انہوں نے سفیان ثوری سے، کہا مجھ سے حبیب بن ابی ثابت نے بیان کیا، انہوں نے سعید بن جبیر سے، انہوں نے ابن عباس رضی اللہ عنہما سے، انہوں نے کہا   خون کی رو سے تم پر سات رشتے حرام ہیں اور شادی کی وجہ سے ( یعنی سسرال کی طرف سے ) سات رشتے بھی۔ انہوں نے یہ آیت پڑھی «حرمت عليكم أمهاتكم‏» آخر تک۔ اور عبداللہ بن جعفر بن ابی طالب نے علی رضی اللہ عنہ کی صاحبزادی زینب اور علی کی بی بی ( لیلٰی بنت مسعود ) دونوں سے نکاح کیا، ان کو جمع کیا اور ابن سیرین نے کہا اس میں کوئی قباحت نہیں ہے اور امام حسن بصری نے ایک بار تو اسے مکروہ کہا پھر کہنے لگے اس میں کوئی قباحت نہیں ہے اور حسن بن حسن بن علی بن ابی طالب نے اپنے دونوں چاچاؤں ( یعنی محمد بن علی اور عمرو بن علی ) کی بیٹیوں کو ایک ساتھ میں نکاح میں لے لیا اور جابر بن زید تابعی نے اس کو مکروہ جانا، اس خیال سے کہ بہنوں میں جلاپا نہ پیدا ہو مگر یہ کچھ حرام نہیں ہے کیونکہ اللہ تعالیٰ نے فرمایا «وأحل لكم ما وراء ذلكم‏» کہ ان کے سوا اور سب عورتیں تم کو حلال ہیں۔ اور عکرمہ نے ابن عباس رضی اللہ عنہما سے روایت کیا کہ اگر کسی نے اپنی سالی سے زنا کیا تو اس کی بیوی ( سالی کی بہن ) اس پر حرام نہ ہو گی۔ اور یحییٰ بن قیس کندی سے روایت ہے، انہوں نے شعبی اور جعفر سے، دونوں نے کہا اگر کوئی شخص لواطت کرے اور کسی لونڈے کے دخول کر دے تو اب اس کی ماں سے نکاح نہ کرے۔ اور یحییٰ راوی مشہور شخص نہیں ہے اور نہ کسی اور نے اس کے ساتھ ہو کر یہ روایت کی ہے اور عکرمہ نے ابن عباس رضی اللہ عنہما سے روایت کی کہ اگر کسی نے اپنی ساس سے زنا کیا تو اس کی بیوی اس پر حرام نہ ہو گی۔ اور ابونصر نے ابن عباس رضی اللہ عنہما سے روایت کی کہ حرام ہو جائے گی اور اس راوی ابونصر کا حال معلوم نہیں۔ اس نے ابن عباس رضی اللہ عنہما سے سنا ہے یا نہیں ( لیکن ابوزرعہ نے اسے ثقہ کہا ہے ) اور عمران بن حصین اور جابر بن زید اور حسن بصری اور بعض عراق والوں ( امام ثوری اور امام ابوحنیفہ رحمہ اللہ ) کا یہی قول ہے کہ حرام ہو جائے گی۔ اور ابوہریرہ رضی اللہ عنہ نے کہا حرام نہ ہو گی جب تک اس کی ماں ( اپنی خوشدامن ) کو زمین سے نہ لگا دے ( یعنی اس سے جماع نہ کرے ) اور سعید بن مسیب اور عروہ اور زہری نے اس کے متعلق کہا ہے کہ اگر کوئی ساس سے زنا کرے تب بھی اس کی بیٹی یعنی زنا کرنے والے کی بیوی اس پر حرام نہ ہو گی ( اس کو رکھ سکتا ہے ) اور زہری نے کہا علی رضی اللہ عنہ نے فرمایا کہ اس کی جورو اس پر حرام نہ ہو گی اور یہ روایت منقطع ہے۔

Ibn 'Abbas further said, Seven types of marriages are unlawful because of blood relations, and seven because of marriage relations. Then Ibn 'Abbas recited the Verse: Forbidden for you (for marriages) are your mothers... (4:23). 'Abdullah bin Ja'far married the daughter and wife of 'Ali at the same time (they were step-daughter and mother). Ibn Sirin said, There is no harm in that. But Al-Hasan Al-Basri disapproved of it at first, but then said that there was no harm in it. Al-Hasan bin Al-Hasan bin 'Ali married two of his cousins in one night. Ja'far bin Zaid disapproved of that because of it would bring hatred (between the two cousins), but it is not unlawful, as Allah said, Lawful to you are all others [beyond those (mentioned)]. (4:24).Ibn 'Abbas said: If somebody commits illegal sexual intercourse with his wife's sister, his wife does not become unlawful for him. And narrated Abu Ja'far, If a person commits homosexuality with a boy, then the mother of that boy is unlawful for him to marry. Narrated Ibn 'Abbas, If one commits illegal sexual intercourse with his mother in law, then his married relation to his wife does not become unlawful. Abu Nasr reported to have said that Ibn 'Abbas in the above case, regarded his marital relation to his wife unlawful, but Abu Nasr is not known well for hearing Hadith from Ibn 'Abbas.Imran bin Hussain, Jabir b. Zaid, Al-Hasan and some other Iraqi's, are reported to have judged that his marital relations to his wife would be unlawful. In the above case Abu Hurairah said, The marital relation to one's wife does not become unlawful except if one as had sexual intercourse (with her mother). Ibn Al-Musaiyab, 'Urwa, and Az-Zuhri allows such person to keep his wife. 'Ali said, His marital relations to his wife does not become unlawful.

Hadith 5063

Narrated Anas bin Malik: A group of three men came to the houses of the wives of the Prophet asking how the Prophet worshipped (Allah), and when they were informed about that, they considered their worship insufficient and said, Where are we from the Prophet as his past and future sins have been forgiven. Then one of them said, I will offer the prayer throughout the night forever. The other said, I will fast throughout the year and will not break my fast. The third said, I will keep away from the women and will not marry forever. Allah's Apostle came to them and said, Are you the same people who said so-and-so? By Allah, I am more submissive to Allah and more afraid of Him than you; yet I fast and break my fast, I do sleep and I also marry women. So he who does not follow my tradition in religion, is not from me (not one of my followers).

Hadith 5064

Narrated 'Urwa: that he asked `Aisha about the Statement of Allah: 'If you fear that you shall not be able to deal justly with the orphan girls, then marry (other) women of your choice, two or three or four; but if you fear that you shall not be able to deal justly (with them), then only one, or (the captives) that your right hands possess. That will be nearer to prevent you from doing injustice.' (4.3) `Aisha said, O my nephew! (This Verse has been revealed in connection with) an orphan girl under the guardianship of her guardian who is attracted by her wealth and beauty and intends to marry her with a Mahr less than what other women of her standard deserve. So they (such guardians) have been forbidden to marry them unless they do justice to them and give them their full Mahr, and they are ordered to marry other women instead of them.

Hadith 5065

Narrated 'Alqama: While I was with `Abdullah, `Uthman met him at Mina and said, O Abu `Abdur-Rahman ! I have something to say to you. So both of them went aside and `Uthman said, O Abu `Abdur-Rah. man! Shall we marry you to a virgin who will make you remember your past days? When `Abdullah felt that he was not in need of that, he beckoned me (to join him) saying, O 'Alqama! Then I heard him saying (in reply to `Uthman), As you have said that, (I tell you that) the Prophet once said to us, 'O young people! Whoever among you is able to marry, should marry, and whoever is not able to marry, is recommended to fast, as fasting diminishes his sexual power.

Hadith 5066

Narrated `Abdullah: We were with the Prophet while we were young and had no wealth whatever. So Allah's Apostle said, O young people! Whoever among you can marry, should marry, because it helps him lower his gaze and guard his modesty (i.e. his private parts from committing illegal sexual intercourse etc.), and whoever is not able to marry, should fast, as fasting diminishes his sexual power.

Hadith 5067

Narrated 'Ata: We presented ourselves along with Ibn `Abbas at the funeral procession of Maimuna at a place called Sarif. Ibn `Abbas said, This is the wife of the Prophet so when you lift her bier, do not Jerk it or shake it much, but walk smoothly because the Prophet had nine wives and he used to observe the night turns with eight of them, and for one of them there was no night turn.
