حَدَّثَنِي يَحْيَى بْنُ بُكَيْرٍ ، حَدَّثَنَا اللَّيْثُ ، عَنْ عُقَيْلٍ ، عَنِ ابْنِ شِهَابٍ ، قَالَ : أَخْبَرَنِي عُرْوَةُ ، أَنَّهُ سَأَلَ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا : وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى سورة النساء آية 3 ، قَالَتْ : يَا ابْنَ أُخْتِي ، هَذِهِ الْيَتِيمَةُ تَكُونُ فِي حَجْرِ وَلِيِّهَا فَيَرْغَبُ فِي جَمَالِهَا وَمَالِهَا وَيُرِيدُ أَنْ يَنْتَقِصَ صَدَاقَهَا ، فَنُهُوا عَنْ نِكَاحِهِنَّ إِلَّا أَنْ يُقْسِطُوا فِي إِكْمَالِ الصَّدَاقِ ، وَأُمِرُوا بِنِكَاحِ مَنْ سِوَاهُنَّ ، قَالَتْ : وَاسْتَفْتَى النَّاسُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعْدَ ذَلِكَ فَأَنْزَلَ اللَّهُ : وَيَسْتَفْتُونَكَ فِي النِّسَاءِ إِلَى وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ سورة النساء آية 127 ، فَأَنْزَلَ اللَّهُ لَهُمْ : أَنَّ الْيَتِيمَةَ إِذَا كَانَتْ ذَاتَ جَمَالٍ وَمَالٍ رَغِبُوا فِي نِكَاحِهَا وَنَسَبِهَا وَسُنَّتِهَا فِي إِكْمَالِ الصَّدَاقِ ، وَإِذَا كَانَتْ مَرْغُوبَةً عَنْهَا فِي قِلَّةِ الْمَالِ وَالْجَمَالِ تَرَكُوهَا وَأَخَذُوا غَيْرَهَا مِنَ النِّسَاءِ ، قَالَتْ : فَكَمَا يَتْرُكُونَهَا حِينَ يَرْغَبُونَ عَنْهَا ، فَلَيْسَ لَهُمْ أَنْ يَنْكِحُوهَا إِذَا رَغِبُوا فِيهَا إِلَّا أَنْ يُقْسِطُوا لَهَا وَيُعْطُوهَا حَقَّهَا الْأَوْفَى فِي الصَّدَاقِ .

مجھ سے یحییٰ بن بکیر نے بیان کیا، کہا ہم سے لیث بن سعد نے، ان سے عقیل نے، ان سے ابن شہاب نے، انہیں عروہ بن زبیر نے خبر دی کہ   انہوں نے عائشہ رضی اللہ عنہا سے آیت «وإن خفتم أن لا تقسطوا في اليتامى‏» ”اور اگر تمہیں خوف ہو کہ یتیم لڑکیوں کے بارے میں تم انصاف نہیں کر سکو گے۔“ کے متعلق سوال کیا۔ عائشہ رضی اللہ عنہا نے کہا میرے بھانجے! اس آیت میں اس یتیم لڑکی کا حکم بیان ہوا ہے جو اپنے ولی کی پرورش میں ہو اور اس کا ولی اس کی خوبصورتی اور مالداری پر ریجھ کر یہ چاہے کہ اس سے نکاح کرے لیکن اس کے مہر میں کمی کرنے کا بھی ارادہ ہو۔ ایسے ولی کو اپنی زیر پرورش یتیم لڑکی سے نکاح کرنے سے منع کیا گیا ہے جب وہ ان کا مہر انصاف سے پورا ادا کریں گے اگر وہ ایسا نہ کریں تو پھر آیت میں ایسے ولیوں کو حکم دیا گیا کہ وہ اپنی زیر پرورش یتیم لڑکی کے سوا کسی اور سے نکاح کر لیں۔ عائشہ رضی اللہ عنہا نے بیان کیا کہ لوگوں نے رسول اللہ صلی اللہ علیہ وسلم سے اس کے بعد سوال کیا تو اللہ تعالیٰ نے سورۃ نساء میں آیت «ويستفتونك في النساء‏» سے «وترغبون أن تنكحوهن‏» تک نازل کی۔ اس آیت میں اللہ تعالیٰ نے یہ حکم دیا کہ یتیم لڑکیاں اگر خوبصورت اور صاحب مال ہوں تو ان کے ولی بھی ان کے ساتھ نکاح کر لینا چاہتے ہیں، اس کا خاندان پسند کرتے ہیں اور مہر پورا ادا کر کے ان سے نکاح کر لیتے ہیں۔ لیکن ان میں حسن کی کمی ہو اور مال بھی نہ ہو تو پھر ان کی طرف رغبت نہیں ہو گی اور وہ انہیں چھوڑ کر دوسری عورتوں سے نکاح کر لیتے ہیں۔ عائشہ رضی اللہ عنہا نے کہا کہ آیت کا مطلب یہ ہے کہ جیسے اس وقت یتیم لڑکی کو چھوڑ دیتے ہیں جب وہ نادار ہو اور خوبصورت نہ ہو ایسے ہی اس وقت بھی چھوڑ دینا چاہئے جب وہ مالدار اور خوبصورت ہو البتہ اگر اس کے حق میں انصاف کریں اور اس کا مہر پورا ادا کریں تب اس سے نکاح کر سکتے ہیں۔

Narrated 'Urwa: that he asked `Aisha regarding the Verse: 'If you fear that you shall not be able to deal justly with the orphans (4.3) She said, O my nephew! This Verse refers to the orphan girl who is under the guardianship of her guardian who likes her beauty and wealth and wishes to (marry her and) curtails her Mahr. Such guardians have been forbidden to marry them unless they do justice by giving them their full Mahr, and they have been ordered to marry other than them. The people asked for the verdict of Allah's Apostle after that, so Allah revealed: 'They ask your instruction concerning the women . . . whom you desire to marry.' (4.127) So Allah revealed to them that if the orphan girl had beauty and wealth, they desired to marry her and for her family status. They can only marry them if they give them their full Mahr. And if they had no desire to marry them because of their lack of wealth and beauty, they would leave them and marry other women. So, as they used to leave them, when they had no interest, in them, they were forbidden to marry them when they had such interest, unless they treated them justly and gave them their full Mahr Apostle said, 'If at all there is evil omen, it is in the horse, the woman and the house. a lady is to be warded off. And the Statement of Allah: 'Truly, among your wives and your children, there are enemies for you (i.e may stop you from the obedience of Allah)' (64.14)

Hadith 5063

Narrated Anas bin Malik: A group of three men came to the houses of the wives of the Prophet asking how the Prophet worshipped (Allah), and when they were informed about that, they considered their worship insufficient and said, Where are we from the Prophet as his past and future sins have been forgiven. Then one of them said, I will offer the prayer throughout the night forever. The other said, I will fast throughout the year and will not break my fast. The third said, I will keep away from the women and will not marry forever. Allah's Apostle came to them and said, Are you the same people who said so-and-so? By Allah, I am more submissive to Allah and more afraid of Him than you; yet I fast and break my fast, I do sleep and I also marry women. So he who does not follow my tradition in religion, is not from me (not one of my followers).

Hadith 5064

Narrated 'Urwa: that he asked `Aisha about the Statement of Allah: 'If you fear that you shall not be able to deal justly with the orphan girls, then marry (other) women of your choice, two or three or four; but if you fear that you shall not be able to deal justly (with them), then only one, or (the captives) that your right hands possess. That will be nearer to prevent you from doing injustice.' (4.3) `Aisha said, O my nephew! (This Verse has been revealed in connection with) an orphan girl under the guardianship of her guardian who is attracted by her wealth and beauty and intends to marry her with a Mahr less than what other women of her standard deserve. So they (such guardians) have been forbidden to marry them unless they do justice to them and give them their full Mahr, and they are ordered to marry other women instead of them.

Hadith 5065

Narrated 'Alqama: While I was with `Abdullah, `Uthman met him at Mina and said, O Abu `Abdur-Rahman ! I have something to say to you. So both of them went aside and `Uthman said, O Abu `Abdur-Rah. man! Shall we marry you to a virgin who will make you remember your past days? When `Abdullah felt that he was not in need of that, he beckoned me (to join him) saying, O 'Alqama! Then I heard him saying (in reply to `Uthman), As you have said that, (I tell you that) the Prophet once said to us, 'O young people! Whoever among you is able to marry, should marry, and whoever is not able to marry, is recommended to fast, as fasting diminishes his sexual power.

Hadith 5066

Narrated `Abdullah: We were with the Prophet while we were young and had no wealth whatever. So Allah's Apostle said, O young people! Whoever among you can marry, should marry, because it helps him lower his gaze and guard his modesty (i.e. his private parts from committing illegal sexual intercourse etc.), and whoever is not able to marry, should fast, as fasting diminishes his sexual power.

Hadith 5067

Narrated 'Ata: We presented ourselves along with Ibn `Abbas at the funeral procession of Maimuna at a place called Sarif. Ibn `Abbas said, This is the wife of the Prophet so when you lift her bier, do not Jerk it or shake it much, but walk smoothly because the Prophet had nine wives and he used to observe the night turns with eight of them, and for one of them there was no night turn.
