حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا سُفْيَانُ ، عَنْ يَحْيَى ، عَنْ عَمْرَةَ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : أَتَتْهَا بَرِيرَةُ تَسْأَلُهَا فِي كِتَابَتِهَا ، فَقَالَتْ : إِنْ شِئْتِ أَعْطَيْتُ أَهْلَكِ وَيَكُونُ الْوَلَاءُ لِي ، فَلَمَّا جَاءَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ذَكَّرْتُهُ ذَلِكَ ، قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ابْتَاعِيهَا فَأَعْتِقِيهَا ، فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ ، ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْمِنْبَرِ ، فَقَالَ : مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ ، مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللَّهِ فَلَيْسَ لَهُ وَإِنِ اشْتَرَطَ مِائَةَ شَرْطٍ .
ہم سے علی بن عبداللہ مدینی نے بیان کیا۔ کہا ہم سے سفیان بن عیینہ نے بیان کیا ‘ یحییٰ بن سعید انصاری سے ‘ ان سے عمرہ نے اور ان سے عائشہ رضی اللہ عنہا نے بیان کیا کہ بریرہ رضی اللہ عنہا اپنے مکاتبت کے سلسلے میں ان سے مدد مانگنے آئیں تو انہوں نے کہا کہ اگر تم چاہو تو تمہارے مالکوں کو ( پوری قیمت ) دے دوں اور تمہاری ولاء میرے ہو گی۔ پھر جب رسول اللہ صلی اللہ علیہ وسلم تشریف لائے تو آپ صلی اللہ علیہ وسلم سے میں نے اس کا ذکر کیا۔ آپ صلی اللہ علیہ وسلم نے فرمایا انہیں تو خرید لے اور آزاد کر دے۔ ولاء تو بہرحال اسی کی ہو گی جو آزاد کر دے۔ پھر رسول اللہ صلی اللہ علیہ وسلم منبر پر تشریف لائے اور فرمایا ان لوگوں کو کیا ہو گیا ہے جو ایسی شرطیں لگاتے ہیں جن کا کوئی پتہ ( دلیل، سند ) کتاب اللہ میں نہیں ہے ‘ جس نے بھی کوئی ایسی شرط لگائی جس کا پتہ ( دلیل، سند ) کتاب اللہ میں نہ ہو تو خواہ ایسی سو شرطیں لگا لے ان سے کچھ فائدہ نہ اٹھائے گا۔
Narrated `Amra: Aisha said that Buraira came to seek her help in the writing of her emancipation. `Aisha said to her, If you wish, I will pay your masters (your price) and the wala' will be for me. When Allah's Apostle came, she told him about it. The Prophet said to her, Buy her (i.e. Buraira) and manumit her, for the Wala is for the one who manumits. Then Allah's Apostle ascended the pulpit and said, What about those people who stipulate conditions which are not in Allah's Laws? Whoever stipulates such conditions as are not in Allah's Laws, then those conditions are invalid even if he stipulated a hundred such conditions.

Hadith 2711
Narrated Marwan and al-Miswar bin Makhrama: (from the companions of Allah's Apostle) When Suhail bin `Amr agreed to the Treaty (of Hudaibiya), one of the things he stipulated then, was that the Prophet should return to them (i.e. the pagans) anyone coming to him from their side, even if he was a Muslim; and would not interfere between them and that person. The Muslims did not like this condition and got disgusted with it. Suhail did not agree except with that condition. So, the Prophet agreed to that condition and returned Abu Jandal to his father Suhail bin `Amr. Thenceforward the Prophet returned everyone in that period (of truce) even if he was a Muslim. During that period some believing women emigrants including Um Kulthum bint `Uqba bin Abu Muait who came to Allah's Apostle and she was a young lady then. Her relative came to the Prophet and asked him to return her, but the Prophet did not return her to them for Allah had revealed the following Verse regarding women: O you who believe! When the believing women come to you as emigrants. Examine them, Allah knows best as to their belief, then if you know them for true believers, Send them not back to the unbelievers, (for) they are not lawful (wives) for the disbelievers, Nor are the unbelievers lawful (husbands) for them (60.10)

Narrated `Urwa: Aisha told me, Allah's Apostle used to examine them according to this Verse: O you who believe! When the believing women come to you, as emigrants test them . . . for Allah is Oft- Forgiving, Most Merciful. (60.10-12) Aisha said, When any of them agreed to that condition Allah's Apostle would say to her, 'I have accepted your pledge of allegiance.' He would only say that, but, by Allah he never touched the hand of any women (i.e. never shook hands with them) while taking the pledge of allegiance and he never took their pledge of allegiance except by his words (only).
