5 أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، حَدَّثَنَا اللَّيْثُ ، حَدَّثَنِي ابْنُ شِهَابٍ ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ ، عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلْبَائِعِ ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ ، وَمَنِ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ . وَعَنْ مَالِكٍ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنْ عُمَرَ فِي الْعَبْدِ .

ہم سے عبداللہ بن یوسف نے بیان کیا، کہا کہ ہم سے لیث نے بیان کیا، ان سے ابن شہاب نے بیان کیا، ان سے سالم بن عبداللہ نے اور ان سے ان کے باپ نے بیان کیا کہ   میں نے رسول اللہ صلی اللہ علیہ وسلم سے سنا، آپ صلی اللہ علیہ وسلم نے فرمایا تھا کہ پیوندکاری کے بعد اگر کسی شخص نے اپنا کھجور کا درخت بیچا تو ( اس سال کی فصل کا ) پھل بیچنے والے ہی کا رہتا ہے۔ ہاں اگر خریدار شرط لگا دے ( کہ پھل بھی خریدار ہی کا ہو گا ) تو یہ صورت الگ ہے۔ اور اگر کسی شخص نے کوئی مال والا غلام بیچا تو وہ مال بیچنے والے کا ہوتا ہے۔ ہاں اگر خریدار شرط لگا دے تو یہ صورت الگ ہے۔ یہ حدیث امام مالک سے، انہوں نے نافع سے، انہوں نے ابن عمر رضی اللہ عنہما سے بھی مروی ہے اس میں صرف غلام کا ذکر ہے۔

Narrated 'Abdullah (ra) said, I heard the Messenger of Allah (saws) say If somebody buys date-palms after they have been pollinated, the fruits will belong to the seller unless the buyer stipulates the contrary. If somebody buys a slave having some property, the property will belong to the seller unless the buyer stipulate that it should belong to him.

Hadith 2351

Narrated Sahl bin Sa`d: A tumbler (full of milk or water) was brought to the Prophet who drank from it, while on his right side there was sitting a boy who was the youngest of those who were present and on his left side there were old men. The Prophet asked, O boy, will you allow me to give it (i.e. the rest of the drink) to the old men? The boy said, O Allah's Apostle! I will not give preference to anyone over me to drink the rest of it from which you have drunk. So, the Prophet gave it to him.

Hadith 2352

Narrated Az-Zuhri: Anas bin Malik said, that once a domestic sheep was milked for Allah's Apostle while he was in the house of Anas bin Malik. The milk was mixed with water drawn from the well in Anas's house. A tumbler of it was presented to Allah's Apostle who drank from it. Then Abu Bakr was sitting on his left side and a bedouin on his right side. When the Prophet removed the tumbler from his mouth, `Umar was afraid that the Prophet might give it to the bedouin, so he said. O Allah's Apostle! Give it to Abu Bakr who is sitting by your side. But the Prophet gave it to the bedouin, who was to his right and said, You should start with the one on your right side.

Narrated Abu Huraira: Allah's Apostle said, Do not withhold the superfluous water, for that will prevent people from grazing their cattle.
