حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي ابْنُ شِهَابٍ، قَالَ: حَدَّثَنِي سُلَيْمَانُ بْنُ يَسَارٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ، عَنْ الْفَضْلِ بْنِ عَبَّاسٍ، أَنَّ امْرَأَةً مِنْ خَثْعَمٍ، قَالَتْ: يَا رَسُولَ اللَّهِ إِنَّ أَبِي أَدْرَكَتْهُ فَرِيضَةُ اللَّهِ فِي الْحَجِّ، وَهُوَ شَيْخٌ كَبِيرٌ لَا يَسْتَطِيعُ أَنْ يَسْتَوِيَ عَلَى ظَهْرِ الْبَعِيرِ. قَالَ: حُجِّي عَنْهُ . قَالَ: وَفِي الْبَاب عَنْ عَلِيٍّ، وَبُرَيْدَةَ، وَحُصَيْنِ بْنِ عَوْفٍ، وَأَبِي رَزِينٍ الْعُقَيْلِيِّ، وَسَوْدَةَ بِنْتِ زَمْعَةَ، وَابْنِ عَبَّاسٍ. قَالَ أَبُو عِيسَى: حَدِيثُ الْفَضْلِ بْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ، وَرُوِيَ عَنْ ابْنِ عَبَّاسٍ، عَنْ حُصَيْنِ بْنِ عَوْفٍ الْمُزَنِيِّ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَرُوِيَ عَنْ ابْنِ عَبَّاسٍ أَيْضًا، عَن سِنَانِ بْنِ عَبْدِ اللَّهِ الْجُهَنِيِّ، عَنْ عَمَّتِه، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَرُوِيَ عَنْ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: وَسَأَلْتُ مُحَمَّدًا عَنْ هَذِهِ الرِّوَايَاتِ، فَقَالَ: أَصَحُّ شَيْءٍ فِي هَذَا الْبَاب مَا رَوَى ابْنُ عَبَّاسٍ، عَنْ الْفَضْلِ بْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ مُحَمَّدٌ: وَيُحْتَمَلُ أَنْ يَكُونَ ابْنُ عَبَّاسٍ سَمِعَهُ مِنْ الْفَضْلِ وَغَيْرِهِ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ رَوَى هَذَا عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَأَرْسَلَهُ وَلَمْ يَذْكُرِ الَّذِي سَمِعَهُ مِنْهُ. قَالَ أَبُو عِيسَى: وَقَدْ صَحَّ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي هَذَا الْبَاب غَيْرُ حَدِيثٍ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، وَبِهِ يَقُولُ: الثَّوْرِيُّ، وَابْنُ الْمُبَارَكِ، وَالشَّافِعِيُّ، وَأَحْمَدُ، وَإِسْحَاق: يَرَوْنَ أَنْ يُحَجَّ عَنِ الْمَيِّتِ، وقَالَ مَالِكٌ: إِذَا أَوْصَى أَنْ يُحَجَّ عَنْهُ حُجَّ عَنْهُ، وَقَدْ رَخَّصَ بَعْضُهُمْ أَنْ يُحَجَّ عَنِ الْحَيِّ إِذَا كَانَ كَبِيرًا، أَوْ بِحَالٍ لَا يَقْدِرُ أَنْ يَحُجَّ، وَهُوَ قَوْلُ ابْنِ الْمُبَارَكِ، وَالشَّافِعِيِّ.
فضل بن عباس رضی الله عنہما کہتے ہیں کہ قبیلہ خثعم کی ایک عورت نے عرض کیا: اللہ کے رسول! میرے والد کو اللہ کے فریضہ حج نے پا لیا ہے لیکن وہ اتنے بوڑھے ہیں کہ اونٹ کی پیٹھ پر بیٹھ نہیں سکتے ( تو کیا کیا جائے؟ ) ۔ آپ نے فرمایا: ”تو ان کی طرف سے حج کر لے“۔ امام ترمذی کہتے ہیں: ۱- فضل بن عباس رضی الله عنہما کی حدیث حسن صحیح ہے، ۲- ابن عباس رضی الله عنہما سے حصین بن عوف مزنی رضی الله عنہ نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کی ہے، ۳- ابن عباس رضی الله عنہما سے مروی ہے کہ سنان بن عبداللہ جہنی رضی الله عنہ نے اپنی پھوپھی سے اور ان کی پھوپھی نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کی ہے، ۴- ابن عباس رضی الله عنہما نے براہ راست نبی اکرم صلی اللہ علیہ وسلم سے بھی روایت کی ہے، ۵- امام ترمذی کہتے ہیں: میں نے ان روایات کے بارے میں محمد بن اسماعیل بخاری سے پوچھا تو انہوں نے کہا: اس باب میں سب سے صحیح روایت وہ ہے جسے ابن عباس نے فضل بن عباس سے اور فضل نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کی ہے ۶- محمد بن اسماعیل بخاری کہتے ہیں کہ اس کا بھی احتمال ہے کہ ابن عباس نے اسے ( اپنے بھائی ) فضل سے اور ان کے علاوہ دوسرے لوگوں سے بھی سنا ہو اور ان لوگوں نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کی ہو، اور پھر ابن عباس رضی الله عنہما نے اسے نبی اکرم صلی اللہ علیہ وسلم سے مرسلاً روایت کی ہو اور جس سے انہوں نے اسے سنا ہو اس کا نام ذکر نہ کیا ہو، نبی اکرم صلی اللہ علیہ وسلم سے اس باب میں کئی اور بھی احادیث ہیں، ۷- اس باب میں علی، بریدہ، حصین بن عوف، ابورزین عقیلی، سودہ بنت زمعہ اور ابن عباس رضی الله عنہم سے بھی احادیث آئی ہیں، ۸- صحابہ کرام وغیرہم میں سے اہل علم کا اسی پر عمل ہے، اور یہی ثوری، ابن مبارک، شافعی، احمد اور اسحاق بن راہویہ بھی کہتے ہیں کہ میت کی طرف سے حج کیا جا سکتا ہے، ۹- مالک کہتے ہیں: میت کی طرف سے حج اس وقت کیا جائے گا جب وہ حج کرنے کی وصیت کر گیا ہو، ۱۰- بعض لوگوں نے زندہ شخص کی طرف سے جب وہ بہت زیادہ بوڑھا ہو گیا ہو یا ایسی حالت میں ہو کہ وہ حج پر قدرت نہ رکھتا ہو حج کرنے کی اجازت دی ہے۔ یہی ابن مبارک اور شافعی کا بھی قول ہے۔
Al-Fadl bin Abbas narrated: A woman from Khath'am said: 'O Messenger of Allah! My father has lived until Allah has made Hajj obligatory, and he is an elderly man who is not able to sit on the back of a camel.' So he (pbuh) said: 'Perform Hajj for him.'

Sa'eed bin Abi Sa'eed Al Maqbury narrated: Abu Shuraih Al-Adawi said tat when Amr bin Sa'eed was sending troops to Makkah he said to him: 'O Amr! Allow me to tell you what the Messenger of Allah said on the day following the Conquest of Makkah. My ears heard it, my heard understood it thoroughly, and with my own eyes, I saw the Prophet when he - after glorifying and praising Allah - said: Indeed Allah, the Most High, made Makkah a sanctuary, it was not made a sanctuary by the people. So it is not lawful for a man who believes in Allah and the Last Day to shed blood it, nor to cut down its trees. If anybody tries to use the Messenger of Allah to make an excuse for fighting in it, then say to him: 'Indeed Allah permitted His Messenger and He did not permit you.' Allah only allowed it for me for a few hours of one day, and today its sanctity has returned as it was before. So let the one who is present convey to the one who is absent. Abu Shuraih was asked: What was Amr bin Sa'eeds reply to you? He said: I am more knowledgeable about that than you Abu Shuraih! The Haram does not give protection to a disobedient person, nor a person fleeing for murder, nor fleeing for (Kharbah) lawlessness.
