حَدَّثَنَا بِذَلِكَ قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنْ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ، وَعَمْرَةَ، عَنْ عَائِشَةَ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ إِذَا اعْتَكَفَ الرَّجُلُ أَنْ لَا يَخْرُجَ مِنَ اعْتِكَافِهِ إِلَّا لِحَاجَةِ الْإِنْسَانِ، وَاجْتَمَعُوا عَلَى هَذَا أَنَّهُ يَخْرُجُ لِقَضَاءِ حَاجَتِهِ لِلْغَائِطِ وَالْبَوْلِ، ثُمَّ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي عِيَادَةِ الْمَرِيضِ وَشُهُودِ الْجُمُعَةِ وَالْجَنَازَةِ لِلْمُعْتَكِفِ، فَرَأَى بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، أَنْ يَعُودَ الْمَرِيضَ وَيُشَيِّعَ الْجَنَازَةَ وَيَشْهَدَ الْجُمُعَةَ إِذَا اشْتَرَطَ ذَلِكَ، وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ، وَابْنِ الْمُبَارَكِ، وقَالَ بَعْضُهُمْ: لَيْسَ لَهُ أَنْ يَفْعَلَ شَيْئًا مِنْ هَذَا، وَرَأَوْا لِلْمُعْتَكِفِ إِذَا كَانَ فِي مِصْرٍ يُجَمَّعُ فِيهِ أَنْ لَا يَعْتَكِفَ إِلَّا فِي مَسْجِدِ الْجَامِعِ، لِأَنَّهُمْ كَرِهُوا الْخُرُوجَ لَهُ مِنْ مُعْتَكَفِهِ إِلَى الْجُمُعَةِ، وَلَمْ يَرَوْا لَهُ أَنْ يَتْرُكَ الْجُمُعَةَ، فَقَالُوا: لَا يَعْتَكِفُ إِلَّا فِي مَسْجِدِ الْجَامِعِ حَتَّى لَا يَحْتَاجَ أَنْ يَخْرُجَ مِنْ مُعْتَكَفِهِ لِغَيْرِ قَضَاءِ حَاجَةِ الْإِنْسَانِ، لِأَنَّ خُرُوجَهُ لِغَيْرِ حَاجَةِ الْإِنْسَانِ قَطْعٌ عِنْدَهُمْ لِلِاعْتِكَافِ، وَهُوَ قَوْلُ مَالِكٍ، وَالشَّافِعِيِّ، وقَالَ أَحْمَدُ: لَا يَعُودُ الْمَرِيضَ وَلَا يَتْبَعُ الْجَنَازَةَ عَلَى حَدِيثِ عَائِشَةَ، وقَالَ إِسْحَاق: إِنِ اشْتَرَطَ ذَلِكَ فَلَهُ أَنْ يَتْبَعَ الْجَنَازَةَ وَيَعُودَ الْمَرِيضَ.
ہم سے اسے قتیبہ نے بسند «الليث بن سعد عن ابن شهاب عن عروة وعمرة عن عائشة» روایت کیا ہے۔ امام ترمذی کہتے ہیں: ۱- اور اہل علم کے نزدیک اسی پر عمل ہے کہ جب آدمی اعتکاف کرے تو انسانی ضرورت کے بغیر اپنے معتکف سے نہ نکلے، اور ان کا اس بات پر اتفاق ہے کہ وہ پاخانہ پیشاب جیسی اپنی ضرورتوں کو پورا کرنے کے لیے نکل سکتا ہے، ۲- پھر معتکف کے لیے مریض کی عیادت کرنے، جمعہ اور جنازہ میں شریک ہونے میں اہل علم کا اختلاف ہے، صحابہ کرام وغیرہم میں سے بعض اہل علم کی رائے ہے کہ وہ مریض کی عیادت کر سکتا ہے، جنازہ کے ساتھ جا سکتا ہے اور جمعہ میں شریک ہو سکتا ہے جب کہ اس نے اس کی شرط لگا لی ہو۔ یہ سفیان ثوری اور ابن مبارک کا قول ہے، ۳- اور بعض لوگ کہتے ہیں کہ اسے ان میں سے کوئی بھی چیز کرنے کی اجازت نہیں، ان کا خیال ہے کہ معتکف کے لیے ضروری ہے کہ جب وہ کسی ایسے شہر میں ہو جہاں جمعہ ہوتا ہو تو مسجد جامع میں ہی اعتکاف کرے۔ اس لیے کہ یہ لوگ جمعہ کے لیے اپنے معتکف سے نکلنا اس کے لیے مکروہ قرار دیتے ہیں اور اس کے لیے جمعہ چھوڑنے کو بھی جائز نہیں سمجھتے، اس لیے ان کا کہنا ہے کہ وہ جامع مسجد ہی میں اعتکاف کرے تاکہ اسے انسانی حاجتوں کے علاوہ کسی اور حاجت سے باہر نکلنے کی ضرورت نہ باقی رہے، اس لیے کہ بغیر کسی انسانی ضرورت کے مسجد سے نکلنے سے اعتکاف ٹوٹ جاتا ہے، یہی مالک اور شافعی کا قول ہے۔ ۴- اور احمد کہتے ہیں: عائشہ رضی الله عنہا کی حدیث کی رو سے نہ وہ مریض کی عیادت کرے گا، نہ جنازہ کے ساتھ جائے گا۔ ۵- اسحاق بن راہویہ کہتے ہیں: اگر وہ ان چیزوں کی شرط کر لے تو اسے جنازے کے ساتھ جانے اور مریض کی عیادت کرنے کی اجازت ہے۔

Hadith 682
Abu Hurairah narrated that : the Messenger of Allah said: On the first night of the month of Ramadan, the Shayatin are shackled, the jinns are restrained, the gates of the Fires are shut such that no gate among them would be opened. The gates of Paradise are opened such that no gate among them would be closed, and a caller calls: 'O seeker of the good; come near!' and 'O seeker of evil; stop!
