حَدَّثَنَا الْأَنْصَارِيُّ، حَدَّثَنَا مَعْنٌ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ الْفُضَيْلِ بْنِ أَبِي عَبْدِ اللَّهِ، عَنْ عَبْدِ اللَّهِ بْنِ نِيَارٍ الْأَسْلَمِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ:‏‏‏‏ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ إِلَى بَدْرٍ، ‏‏‏‏‏‏حَتَّى إِذَا كَانَ بِحَرَّةِ الْوَبَرَةِ، ‏‏‏‏‏‏لَحِقَهُ رَجُلٌ مِنَ الْمُشْرِكِينَ يَذْكُرُ مِنْهُ جُرْأَةً وَنَجْدَةً، ‏‏‏‏‏‏فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ أَلَسْتَ تُؤْمِنُ بِاللَّهِ وَرَسُولِهِ ؟ ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ لَا، ‏‏‏‏‏‏قَالَ:‏‏‏‏ ارْجِعْ، ‏‏‏‏‏‏فَلَنْ أَسْتَعِينَ بِمُشْرِكٍ ، ‏‏‏‏‏‏وَفِي الْحَدِيثِ كَلَامٌ أَكْثَرُ مِنْ هَذَا، ‏‏‏‏‏‏هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏قَالُوا:‏‏‏‏ لَا يُسْهَمُ لِأَهْلِ الذِّمَّةِ وَإِنْ قَاتَلُوا مَعَ الْمُسْلِمِينَ الْعَدُوَّ، ‏‏‏‏‏‏وَرَأَى بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ أَنْ يُسْهَمَ لَهُمْ إِذَا شَهِدُوا الْقِتَالَ مَعَ الْمُسْلِمِينَ. (حديث مرفوع) وَيُرْوَى عَنْ الزُّهْرِيِّ، ‏‏‏‏‏‏أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ أَسْهَمَ لِقَوْمٍ مِنَ الْيَهُودِ قَاتَلُوا مَعَهُ ، ‏‏‏‏‏‏حَدَّثَنَا بِذَلِكَ قُتَيْبَةُ بْنُ سَعِيدٍ، أَخْبَرَنَا عَبْدُ الْوَارِثِ بْنُ سَعِيدٍ، عَنْ عَزْرَةَ بْنِ ثَابِتٍ، عَنْ الزُّهْرِيِّ، بِهَذَا.

ام المؤمنین عائشہ رضی الله عنہا کہتی ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم بدر کے لیے نکلے، جب آپ حرۃ الوبرہ ۱؎ پہنچے تو آپ کے ساتھ ایک مشرک ہو لیا جس کی جرات و دلیری مشہور تھی نبی اکرم صلی اللہ علیہ وسلم نے اس سے پوچھا: تم اللہ اور اس کے رسول پر ایمان رکھتے ہو؟ اس نے جواب دیا: نہیں، آپ نے فرمایا: ”لوٹ جاؤ، میں کسی مشرک سے ہرگز مدد نہیں لوں گا“ ۲؎۔ امام ترمذی کہتے ہیں: ۱- حدیث میں اس سے بھی زیادہ کچھ تفصیل ہے، ۲- یہ حدیث حسن غریب ہے، ۳- بعض اہل علم کا اسی پر عمل ہے، وہ کہتے ہیں کہ ذمی کو مال غنیمت سے حصہ نہیں ملے گا اگرچہ وہ مسلمانوں کے ہمراہ دشمن سے جنگ کریں، ۴- کچھ اہل علم کا خیال ہے کہ جب ذمی مسلمانوں کے ہمراہ جنگ میں شریک ہوں تو ان کو حصہ دیا جائے گا، ۵- زہری سے مروی ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے یہود کی ایک جماعت کو حصہ دیا جو آپ کے ہمراہ جنگ میں شریک تھی۔

Narrated 'Aishah: That the Messenger of Allah (ﷺ) advanced towards Badr till he reached Harrah Al-Wabr where he was met by a man from the idolaters, about whom it was said he was brave and courageous. The Prophet (ﷺ) said to him: Do you believe in Allah and his Messenger? He said: No. He said: Then return, because we do not seek aid from an idolater. The Hadith has more dialogue than this. And this is a Hasan Gharib Hadith. This is acted upon according to some of the people of knowledge. They say that the people of Adh-Dhimmah do not recieve a share, even it they were to fight along with the Muslims against the enemy. Some of the people of knowledge said that they are given a share when they attend the battle with the Muslims. It has been related by Az-Zuhri, that the Prophet (ﷺ) gave a portion to some people among the Jews who fought along with him. This was narrated to us by Qutaibah (who said): Abdul-Warith bin Sa'eed narrated to us from 'Urwah bin Thabit, from Az-Zuhri. This Hadith is Hasan Gharib.

Hadith 1548

Narrated Abu Al-Bakhtari: An Army from the armies of the Muslims, whose commander was Salman Al-Farisi, besieged one of the Persian castles. They said: 'O Abu 'Abdullah! Should we charge them?' He said: 'Leave me to call them (to Islam) as I heard the Messenger of Allah (ﷺ) call them.' So Salman went to them and said: 'I am only a man from among you, a Persian, and you see that the Arabs obey me. If you become Muslims then you will have the likes of what we have, and from you will be required that which is required from us. If you refuse, and keep your religion, then we will leave you to it, and you will give us the Jizyah from your hands while you are submissive.' He said to them in Persian: 'And you are other than praiseworthy and if you refuse then we will equally resist you.' They said: 'We will not give you the Jizyah, we will fight you instead.' So they said: 'O Abu 'Abdullah! Should we charge them?' He said: 'No.' He said: So for three days he called them to the same (things), and then he said: 'Charge them.' He said: So we charged them, and we conquered the castle.

Narrated Ibn 'Asim Al-Muzani: From his father and he was a Companion who said: When the Messenger of Allah (ﷺ) dispatched any army or battalion, he would say to them: 'If you see a Masjid, or hear someone calling the Adhan, then do not kill anyone.'

Narrated Anas: When the Messenger of Allah (ﷺ) set out for Khaibar, he approached it at night and when he came to a people during the night, he would not attack them until morning. So when the morning came, the Jews came out with their shovels and baskets, then when they saw him, they said: 'Muhammad! By Allah Muhammad has come with the Khamis (an army).' So the Messenger of Allah (ﷺ) said: 'Allahu Akbar! Khaibar is destroyed, for whenever we approach the land of people - then what an evil morning for those who have been warned.'

Hadith 1552

Narrated Ibn 'Umar: The Messenger of Allah (ﷺ) burnt the palm trees of Bani Nadir and cut them down at Al-Buwairah. So Allah revealed: Whatever you cut down of their palm trees, or you left them standing on their trunks, then it was by the permission of Allah, and in the order to disgrace the rebellious.(59:5)
