حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا شَرِيكٌ، عَنْ سِمَاكِ بْنِ حَرْبٍ، عَنْ جَابِرِ بْنِ سَمُرَةَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَجَمَ يَهُودِيًّا وَيَهُودِيَّةً . قَالَ: وَفِي الْبَاب، عَنْ ابْنِ عُمَرَ، وَالْبَرَاءِ، وَجَابِرٍ، وَابْنِ أَبِي أَوْفَى، وَعَبْدِ اللَّهِ بْنِ الْحَارِثِ بْنِ جَزْءٍ، وَابْنِ عَبَّاسٍ. قَالَ أَبُو عِيسَى: حَدِيثُ جَابِرِ بْنِ سَمُرَةَ حَدِيثٌ حَسَنٌ غَرِيبٌ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ، قَالُوا: إِذَا اخْتَصَمَ أَهْلُ الْكِتَابِ، وَتَرَافَعُوا إِلَى حُكَّامِ الْمُسْلِمِينَ، حَكَمُوا بَيْنَهُمْ بِالْكِتَابِ وَالسُّنَّةِ وَبِأَحْكَامِ الْمُسْلِمِينَ، وَهُوَ قَوْلُ: أَحْمَدَ، وَإِسْحَاق، وقَالَ بَعْضُهُمْ: لَا يُقَامُ عَلَيْهِمُ الْحَدُّ فِي الزِّنَا، وَالْقَوْلُ الْأَوَّلُ أَصَحُّ.
جابر بن سمرہ رضی الله عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے ایک یہودی مرد اور ایک یہودی عورت کو رجم کیا۔ امام ترمذی کہتے ہیں: ۱- جابر بن سمرہ رضی الله عنہ کی حدیث حسن غریب ہے، ۲- اس باب میں ابن عمر، براء، جابر، ابن ابی اوفی، عبداللہ بن حارث بن جزء اور ابن عباس رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- اکثر اہل علم کا اسی پر عمل ہے، وہ کہتے ہیں: جب اہل کتاب آپس میں جھگڑیں اور مسلم حکمرانوں کے پاس اپنا مقدمہ پیش کریں تو ان پر لازم ہے کہ وہ کتاب و سنت اور مسلمانوں کے احکام کے مطابق فیصلہ کریں، احمد اور اسحاق بن راہویہ کا یہی قول ہے، ۴- بعض لوگ کہتے ہیں: اہل کتاب پر زنا کی حد نہ قائم کی جائے، لیکن پہلا قول زیادہ صحیح ہے ۱؎۔
