حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، أَنَّ قُرَيْشًا أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ، فَقَالُوا: مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالُوا: مَنْ يَجْتَرِئُ عَلَيْهِ إِلَّا أُسَامَةُ بْنُ زَيْدٍ، حِبُّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَكَلَّمَهُ أُسَامَةُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ، ثُمَّ قَامَ فَاخْتَطَبَ، فَقَالَ: إِنَّمَا أَهْلَكَ الَّذِينَ مِنْ قَبْلِكُمْ، أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ، وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ، وَايْمُ اللَّهِ، لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ 55 سَرَقَتْ لَقَطَعْتُ يَدَهَا ، قَالَ: وَفِي الْبَاب، عَنْ مَسْعُودِ ابْنِ الْعَجْمَاءِ، وَابْنِ عُمَرَ، وَجَابِرٍ، قَالَ أَبُو عِيسَى: حَدِيثُ عَائِشَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ، وَيُقَالُ: مَسْعُودُ بْنُ الْأَعْجَمِ، وَلَهُ هَذَا الْحَدِيثُ.
ام المؤمنین عائشہ رضی الله عنہا سے روایت ہے کہ قریش قبیلہ بنو مخزوم کی ایک عورت ۱؎ کے معاملے میں جس نے چوری کی تھی، کافی فکرمند ہوئے، وہ کہنے لگے: اس کے سلسلے میں رسول اللہ صلی اللہ علیہ وسلم سے کون گفتگو کرے گا؟ لوگوں نے جواب دیا: رسول اللہ صلی اللہ علیہ وسلم کے چہیتے اسامہ بن زید کے علاوہ کون اس کی جرات کر سکتا ہے؟ چنانچہ اسامہ نے آپ سے گفتگو کی تو رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”کیا تم اللہ کی حدود میں سے ایک حد کے بارے میں سفارش کر رہے ہو؟“ پھر آپ کھڑے ہوئے اور خطبہ دیتے ہوئے آپ نے فرمایا: ”لوگو! تم سے پہلے کے لوگ اپنی اس روش کی بنا پر ہلاک ہوئے کہ جب کوئی اعلیٰ خاندان کا شخص چوری کرتا تو اسے چھوڑ دیتے، اور جب کمزور حال شخص چوری کرتا تو اس پر حد جاری کرتے، اللہ کی قسم! اگر محمد کی بیٹی فاطمہ چوری کرتی تو میں اس کا ( بھی ) ہاتھ کاٹ دیتا“ ۲؎۔ امام ترمذی کہتے ہیں: ۱- عائشہ رضی الله عنہا کی حدیث حسن صحیح ہے، ۲- اس باب میں مسعود بن عجماء، ابن عمر اور جابر رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- مسعود بن عجماء کو مسعود بن اعجم بھی کہا جاتا ہے، ان سے صرف یہی ایک حدیث آئی ہے۔
Narrated 'Aishah: The Quraish were troubled by the affair of a woman from the tribe of Makhzum who stole. So they said: 'Who will speak about her to the Messenger of Allah (ﷺ)?' They said: 'Who can do it other than Usamah bin Zaid, the one dear to the Messenger of Allah?' So Usamah spoke with him, the Messenger of Allah (ﷺ) said: 'Do you intercede about a penalty from Allah's penalties?' Then he stood up and adressed the people saying: 'Those before you were only destroyed because they used to leave a noble person if he stole. And if a weak person stole they would establish the penalty upon him. And by Allah! If Fatimah bint Muhammad stole, then I would cut off her hand.
