حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ، وَسَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ الْمَخْزُومِيُّ الْمَعْنَى وَاحِدٌ، قَالَا: حَدَّثَنَا سُفْيَانُ، عَنْ الزُّهْرِيِّ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ، وَعَنْ مُحَمَّدِ بْنِ النُّعْمَانِ بْنِ بَشِيرٍ يُحَدِّثَانِ، عَنْ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّ أَبَاهُ نَحَلَ ابْنًا لَهُ غُلَامًا، فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُشْهِدُهُ، فَقَالَ: أَكُلَّ وَلَدِكَ نَحَلْتَهُ مِثْلَ مَا نَحَلْتَ هَذَا ، قَالَ: لَا، قَالَ: فَارْدُدْهُ . قَالَ أَبُو عِيسَى: هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ، عَنْ النُّعْمَانِ بْنِ بَشِيرٍ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ، يَسْتَحِبُّونَ التَّسْوِيَةَ بَيْنَ الْوَلَدِ، حَتَّى قَالَ بَعْضُهُمْ: يُسَوِّي بَيْنَ وَلَدِهِ حَتَّى فِي الْقُبْلَةِ، وَقَالَ بَعْضُهُمْ: يُسَوِّي بَيْنَ وَلَدِهِ فِي النُّحْلِ وَالْعَطِيَّةِ، يَعْنِي: الذَّكَرُ وَالْأُنْثَى سَوَاءٌ، وَهُوَ قَوْلُ: سُفْيَانَ الثَّوْرِيِّ، وَقَالَ بَعْضُهُمْ: التَّسْوِيَةُ بَيْنَ الْوَلَدِ أَنْ يُعْطَى الذَّكَرُ مِثْلَ حَظِّ الْأُنْثَيَيْنِ مِثْلَ قِسْمَةِ الْمِيرَاثِ وَهُوَ قَوْلُ: أَحْمَدَ، وَإِسْحَاق.
نعمان بن بشیر رضی الله عنہما سے روایت ہے کہ ان کے باپ ( بشیر ) نے اپنے ایک بیٹے کو ایک غلام دیا، وہ نبی اکرم صلی اللہ علیہ وسلم کی خدمت میں آئے تاکہ آپ کو اس پر گواہ بنائیں، تو آپ نے ان سے پوچھا: کیا تم نے اپنے تمام لڑکوں کو ایسا ہی غلام عطیہ میں دیا ہے ۱؎ جیسا اس کو دیا ہے؟“ کہا: نہیں، آپ نے فرمایا: ”تو اسے واپس لے لو“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے۔ ۲- یہ اور بھی سندوں سے نعمان بن بشیر رضی الله عنہما سے مروی ہے۔ ۳- بعض اہل علم کا اسی پر عمل ہے۔ یہ لوگ اولاد کے درمیان ( عطیہ دینے میں ) برابری کو ملحوظ رکھنے کو مستحب سمجھتے ہیں، یہاں تک کہ بعض لوگوں نے تو کہا ہے کہ بوسہ لینے میں بھی اپنی اولاد کے درمیان برابری برقرار رکھے، ۴- اور بعض اہل علم کہتے ہیں: بخشش اور عطیہ میں اپنی اولاد یعنی بیٹا اور بیٹی کے درمیان بھی برابری برقرار رکھے۔ یہی سفیان ثوری کا قول ہے، ۵- اور بعض اہل علم کہتے ہیں: اولاد کے درمیان برابری یہی ہے کہ میراث کی طرح لڑکے کو لڑکی کے دوگنا دیا جائے۔
Narrated An-Nu'man bin Bashir: That his father gave a slave to a son of his. So he went to the Prophet (ﷺ) to have him witness it. He (ﷺ) said: 'Have you given a gift similar to this one to all of your sons?' He replied: 'No'. So he said: 'Then take him back.'

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
