حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلَابَةَ، عَنْ أَبِي الْمُهَلَّبِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ سِتَّةَ أَعْبُدٍ لَهُ عِنْدَ مَوْتِهِ، وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُمْ، فَبَلَغَ ذَلِكَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ لَهُ قَوْلًا شَدِيدًا، ثُمَّ دَعَاهُمْ فَجَزَّأَهُمْ، ثُمَّ أَقْرَعَ بَيْنَهُمْ، فَأَعْتَقَ اثْنَيْنِ، وَأَرَقَّ أَرْبَعَةً . قَالَ: وَفِي الْبَاب، عَنْ أَبِي هُرَيْرَةَ. قَالَ أَبُو عِيسَى: حَدِيثُ عِمْرَانَ بْنِ حُصَيْنٍ حَدِيثٌ حَسَنٌ صَحِيحٌ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، وَهُوَ قَوْلُ: مَالِكٍ، وَالشَّافِعِيِّ، وَأَحْمَدَ، وَإِسْحَاق، يَرَوْنَ اسْتِعْمَالَ الْقُرْعَةِ فِي هَذَا وَفِي غَيْرِهِ، وَأَمَّا بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ، فَلَمْ يَرَوْا الْقُرْعَةَ، وَقَالُوا: يُعْتَقُ مِنْ كُلِّ عَبْدٍ الثُّلُثُ، وَيُسْتَسْعَى فِي ثُلُثَيْ قِيمَتِهِ، وَأَبُو الْمُهَلَّبِ اسْمُهُ: عَبْدُ الرَّحْمَنِ بْنُ عَمْرٍو الْجَرْمِيُّ وَهُوَ غَيْرُ أَبِي قِلَابَةَ، وَيُقَالُ: مُعَاوِيَةُ بْنُ عَمْرٍو، وَأَبُو قِلَابَةَ الْجَرْمِيُّ: اسْمُهُ عَبْدُ اللَّهِ بْنُ زَيْدٍ.
عمران بن حصین رضی الله عنہ کہتے ہیں کہ ایک انصاری شخص نے مرتے وقت اپنے چھ غلاموں کو آزاد کر دیا جبکہ اس کے پاس ان کے علاوہ کوئی اور مال نہ تھا، نبی اکرم صلی اللہ علیہ وسلم کو یہ خبر ملی تو آپ نے اس آدمی کو سخت بات کہی، پھر ان غلاموں کو بلایا اور دو دو کر کے ان کے تین حصے کئے، پھر ان کے درمیان قرعہ اندازی کی اور جن ( دو غلاموں ) کے نام قرعہ نکلا ان کو آزاد کر دیا اور چار کو غلام ہی رہنے دیا۔ امام ترمذی کہتے ہیں: ۱- عمران بن حصین رضی الله عنہ کی حدیث حسن صحیح ہے، ۲- اور یہ اور بھی سندوں سے عمران بن حصین سے مروی ہے، ۳- اس باب میں ابوہریرہ رضی الله عنہ سے بھی روایت ہے، ۴- صحابہ کرام وغیرہم میں سے بعض اہل علم کا اسی پر عمل ہے۔ اور یہی مالک، شافعی، احمد اور اسحاق بن راہویہ کا بھی قول ہے۔ یہ لوگ یہ اور اس طرح کے دوسرے مواقع پر قرعہ اندازی کو درست کہتے ہیں، ۵- اور اہل کوفہ وغیرہم میں سے بعض اہل علم قرعہ اندازی کو جائز نہیں سمجھتے، اس موقع پر لوگ کہتے ہیں کہ ہر غلام سے ایک تہائی آزاد کیا جائے گا اور دو تہائی قیمت کی آزادی کے لیے کسب ( کمائی ) کرایا جائے گا۔
Narrated 'Imran bin Husain: A Man from the Ansar freed six slaves of his upon his death, and he did not have any wealth aside from them. That was conveyed to the Prophet (ﷺ), and he said some harsh words about him. He said: Then he called for them and he divided them and had them draw lots. So he freed two of them and left four as slaves.

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
