حَدَّثَنَا سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ الْمَخْزُومِيُّ،‏‏‏‏ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ،‏‏‏‏ عَنْ الزُّهْرِيِّ، عَنْ الْأَعْرَجِ،‏‏‏‏ عَنْ أَبِي هُرَيْرَةَ، قَالَ:‏‏‏‏ سَمِعْتُهُ يَقُولُ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ إِذَا اسْتَأْذَنَ أَحَدَكُمْ جَارُهُ أَنْ يَغْرِزَ خَشَبَهُ فِي جِدَارِهِ،‏‏‏‏ فَلَا يَمْنَعْهُ . فَلَمَّا حَدَّثَ أَبُو هُرَيْرَةَ،‏‏‏‏ طَأْطَئُوا رُءُوسَهُمْ،‏‏‏‏ فَقَالَ:‏‏‏‏ مَا لِي أَرَاكُمْ عَنْهَا مُعْرِضِينَ،‏‏‏‏ وَاللَّهِ لَأَرْمِيَنَّ بِهَا بَيْنَ أَكْتَافِكُمْ،‏‏‏‏ قَالَ:‏‏‏‏ وَفِي الْبَاب،‏‏‏‏ عَنْ ابْنِ عَبَّاسٍ،‏‏‏‏ وَمُجَمِّعِ بْنِ جَارِيَةَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ،‏‏‏‏ وَبِهِ يَقُولُ الشَّافِعِيُّ،‏‏‏‏ وَرُوِيَ عَنْ بَعْضِ أَهْلِ الْعِلْمِ،‏‏‏‏ مِنْهُمْ مَالِكُ بْنُ أَنَسٍ،‏‏‏‏ قَالُوا لَهُ:‏‏‏‏ أَنْ يَمْنَعَ جَارَهُ أَنْ يَضَعَ خَشَبَهُ فِي جِدَارِهِ،‏‏‏‏ وَالْقَوْلُ الْأَوَّلُ أَصَحُّ.

ابوہریرہ رضی الله عنہ کہتے ہیں کہ   میں نے رسول اللہ صلی اللہ علیہ وسلم کو فرماتے سنا: ”جب تم میں سے کسی کا پڑوسی اس کی دیوار میں لکڑی گاڑنے کی اس سے اجازت طلب کرے تو وہ اسے نہ روکے“۔ ابوہریرہ رضی الله عنہ نے جب یہ حدیث بیان کی تو لوگوں نے اپنے سر جھکا لیے تو انہوں نے کہا: کیا بات ہے، میں دیکھ رہا ہوں کہ تم لوگ اس سے اعراض کر رہے ہو؟ اللہ کی قسم میں اسے تمہارے شانوں پر مار کر ہی رہوں گا یعنی تم سے اسے بیان کر کے ہی رہوں گا۔ امام ترمذی کہتے ہیں: ۱- ابوہریرہ رضی الله عنہ کی حدیث حسن صحیح ہے، ۲- اس باب میں ابن عباس اور مجمع بن جاریہ رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- بعض اہل علم کا اسی پر عمل ہے۔ شافعی بھی اسی کے قائل ہیں، ۴- بعض اہل علم سے مروی ہے: جن میں مالک بن انس بھی شامل ہیں کہ اس کے لیے درست ہے کہ اپنے پڑوسی کو دیوار میں لکڑی گاڑنے سے منع کر دے، پہلا قول زیادہ صحیح ہے۔

Al-A`raj narrated from Abu Hurairah, saying: “I heard him saying: ‘the Messenger of Allah (ﷺ) said: “When one of you seeks his neighbor’s permission to affix a wooden beam in his wall, then do not prevent him. ' When Abu Hurairah narrated it, they tilted their heads, so he said: ‘Why do I see that you are averse to it? By Allah! I will continue to narrate it among you.'

Hadith 1205

An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.

Hadith 1208

Abu Wa'il narrated that Qais bin Abi Gharazah said: The Messenger of Allah (S) came to us, and we were what was called 'brokers,' he said: 'O people of trade! Indeed the Shaitan and sin are present in the sale, so mix your sales with charity.' He said: There are narrations on this topic from Al-Bara' bin 'Azib and Rifa'ah. [Abu 'Eisa said:] The Hadith of Qais bin Abi Gharazah (a narrator) is a Hasan Sahih Hadith. Mansur, Al-A'mash, Habib bin Abi Thabit and others reported it from Abu Wa'il, from Qais bin Abi Gharzah, from the Prophet (ﷺ). We do not know of anything from the Prophet (ﷺ) narrated by Qais other than this.

Hadith 1209

Abu Sa'eed narrated that the Prophet (ﷺ) said: The truthful, trustworthy merchant is with the Prophets, the truthful, and the martyrs. [Abu 'Eisa said:] This Hadith is Hasan, we do not know it except from this route, a narration of Ath-Thawri from Abu Hamzah. Abu Hamzah's name is 'Abdullah bin Jabir, and he is a Shaikh from Al-Basrah.
