حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا وَكِيعٌ، عَنْ شُعْبَةَ، عَنْ أَبِي عَوْنٍ الثَّقَفِيِّ، عَنْ الْحَارِثِ بْنِ عَمْرٍو، عَنْ رِجَالٍ مِنْ أَصْحَابِ مُعَاذٍ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَ مُعَاذًا إِلَى الْيَمَنِ، فَقَالَ: كَيْفَ تَقْضِي ؟ فَقَالَ: أَقْضِي بِمَا فِي كِتَابِ اللَّهِ. قَالَ: فَإِنْ لَمْ يَكُنْ فِي كِتَابِ اللَّهِ ؟ قَالَ: فَبِسُنَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. قَالَ: فَإِنْ لَمْ يَكُنْ فِي سُنَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ قَالَ: أَجْتَهِدُ رَأْيِي، قَالَ: الْحَمْدُ لِلَّهِ الَّذِي وَفَّقَ رَسُولَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .
معاذ بن جبل رضی الله عنہ کے شاگردوں میں سے کچھ لوگوں سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے معاذ کو ( قاضی بنا کر ) یمن بھیجا، تو آپ نے پوچھا: ”تم کیسے فیصلہ کرو گے؟“، انہوں نے کہا: میں اللہ کی کتاب سے فیصلے کروں گا، آپ نے فرمایا: ”اگر ( اس کا حکم ) اللہ کی کتاب ( قرآن ) میں موجود نہ ہو تو؟“ معاذ نے کہا: تو رسول اللہ صلی اللہ علیہ وسلم کی سنت سے فیصلے کروں گا، آپ نے فرمایا: ”اگر رسول اللہ صلی اللہ علیہ وسلم کی سنت میں بھی ( اس کا حکم ) موجود نہ ہو تو؟“، معاذ نے کہا: ( تب ) میں اپنی رائے سے اجتہاد کروں گا۔ آپ نے فرمایا: ”اللہ کا شکر ہے جس نے اللہ کے رسول کے قاصد کو ( صواب کی ) توفیق بخشی“۔
Some men who were companions of Mu'adh narrated from Mu'adh that the Messenger of Allah (ﷺ) sent Mu'adh to Yemen, so he (ﷺ) said: How will you judge? He said: I will judge according to what is in Allah's Book. He said: If it is not in Allah's Book ? He said: Then with the Sunnah of the Messenger of Allah (ﷺ). He said: If it is not in the Sunnah of Messenger of Allah (ﷺ)? He said: I will give in my view. He said: All praise is due to Allah, the One Who made the messenger of the Messenger of Allah suitable.

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
