حَدَّثَنَا أَبُو سَلَمَةَ يَحْيَى بْنُ خَلَفٍ، حَدَّثَنَا عَبْدُ الْأَعْلَى، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ الْحَسَنِ، عَنْ سَمُرَةَ بْنِ جُنْدَبٍ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: إِذَا أَتَى أَحَدُكُمْ عَلَى مَاشِيَةٍ فَإِنْ كَانَ فِيهَا صَاحِبُهَا فَلْيَسْتَأْذِنْهُ، فَإِنْ أَذِنَ لَهُ فَلْيَحْتَلِبْ وَلْيَشْرَبْ، وَإِنْ لَمْ يَكُنْ فِيهَا أَحَدٌ فَلْيُصَوِّتْ ثَلَاثًا، فَإِنْ أَجَابَهُ أَحَدٌ فَلْيَسْتَأْذِنْهُ، فَإِنْ لَمْ يُجِبْهُ أَحَدٌ فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَلَا يَحْمِلْ . قَالَ: وَفِي الْبَاب، عَنْ عُمَرَ، وَأَبِي سَعِيدٍ. قَالَ أَبُو عِيسَى: حَدِيثُ سَمُرَةَ حَدِيثٌ حَسَنٌ غَرِيبٌ صَحِيحٌ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ، وَبِهِ يَقُولُ أَحْمَدُ، وَإِسْحَاق. قَالَ أَبُو عِيسَى 12: وَقَالَ عَلِيُّ بْنُ الْمَدِينِيِّ، سَمَاعُ الْحَسَنِ مِنْ سَمُرَةَ صَحِيحٌ، وَقَدْ تَكَلَّمَ بَعْضُ أَهْلِ الْحَدِيثِ فِي رِوَايَةِ الْحَسَنِ، عَنْ سَمُرَةَ، وَقَالُوا: إِنَّمَا يُحَدِّثُ عَنْ صَحِيفَةِ سَمُرَةَ.
سمرہ بن جندب رضی الله عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”جب تم میں سے کوئی کسی ریوڑ کے پاس ( دودھ پینے ) آئے تو اگر ان میں ان کا مالک موجود ہو تو اس سے اجازت لے، اگر وہ اجازت دیدے تو دودھ پی لے۔ اگر ان میں کوئی نہ ہو تو تین بار آواز لگائے، اگر کوئی جواب دے تو اس سے اجازت لے لے، اور اگر کوئی جواب نہ دے تو دودھ پی لے لیکن ساتھ نہ لے جائے“ ۱؎۔ امام ترمذی کہتے ہیں: ۱- سمرہ کی حدیث حسن غریب ہے، ۲- اس باب میں عمر اور ابو سعید خدری سے بھی احادیث آئی ہیں، ۳- اہل علم کا اسی پر عمل ہے، احمد اور اسحاق بن راہویہ اسی کے قائل ہیں، ۴- علی بن مدینی کہتے ہیں کہ سمرہ سے حسن کا سماع ثابت ہے، ۵- بعض محدثین نے حسن کی روایت میں جسے انہوں نے سمرہ سے روایت کی ہے کلام کیا ہے، وہ لوگ کہتے ہیں کہ حسن سمرہ کے صحیفہ سے حدیث روایت کرتے تھے ۲؎۔
Narrated Samurah bin Jundab: That the Prophet (ﷺ) said: When one of you comes upon livestock, if its owner is with it then seek his permission. If he permits him then let him milk it and drink. If there is no one with it then call out three times, if someone answers then seek his permission. If no one answers then let him milk it and drink without carrying (any of it away). [He said:] There are narrations on this topic from Ibn 'Umar and Abu Sa'eed. [Abu 'Eisa said:] The Hadith of Samurah is a Hasan Gharib Sahih Hadith. This is acted upon according to some of the people of knowledge, and it is the view of Ahmad and Ishaq. [Abu 'Eisa said:] 'Ali bin Al-Madini said: It is correct that Al-Hasan heard this from Samurah. Some of the people of Hadith criticized the narrations of Al-Hasan from Samurah, they said that he only narrated from a writing of Samurah.

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
