حَدَّثَنَا الْحَسَنُ بْنُ قَزَعَةَ، أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ الْحَجَّاجِ، عَنْ الْحَكَمِ، عَنْ مَيْمُونِ بْنِ أَبِي شَبِيبٍ، عَنْ عَلِيٍّ، قَالَ: وَهَبَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غُلَامَيْنِ أَخَوَيْنِ، فَبِعْتُ أَحَدَهُمَا، فَقَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: يَا عَلِيُّ، مَا فَعَلَ غُلَامُكَ ؟ فَأَخْبَرْتُهُ، فَقَالَ: رُدَّهُ رُدَّهُ . قَالَ أَبُو عِيسَى: هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ، وَقَدْ كَرِهَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، التَّفْرِيقَ بَيْنَ السَّبْيِ فِي الْبَيْعِ، وَيُكْرَهُ أَنْ يُفَرِّقَ بَيْنَ الْوَالِدةِ وَوَلَدِهَا وَبَيْنَ الإِخْوَةَ وَالأَخَوَاتِ فِي الْبيع، وَرَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِي التَّفْرِيقِ بَيْنَ الْمُوَلَّدَاتِ الَّذِينَ وُلِدُوا فِي أَرْضِ الْإِسْلَامِ، وَالْقَوْلُ الْأَوَّلُ أَصَحُّ. وَرُوِيَ عَنْ إِبْرَاهِيمَ النَّخَعِيِّ أَنَّهُ فَرَّقَ بَيْنَ وَالِدَةٍ وَوَلَدِهَا فِي الْبَيْعِ، فَقِيلَ لَهُ: فِي ذَلِكَ، فَقَالَ: إِنِّي قَدِ اسْتَأْذَنْتُهَا بِذَلِكَ، فَرَضِيَتْ
علی رضی الله عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے مجھے دو غلام دیئے جو آپس میں بھائی تھے، میں نے ان میں سے ایک کو بیچ دیا، پھر رسول اللہ صلی اللہ علیہ وسلم نے مجھ سے پوچھا: ”علی! تمہارا غلام کیا ہوا؟“، میں نے آپ کو بتایا ( کہ میں نے ایک کو بیچ دیا ہے ) تو آپ نے فرمایا: ”اسے واپس لوٹا لو، اسے واپس لوٹا لو“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن غریب ہے، ۲- صحابہ کرام وغیرہم میں سے بعض اہل علم بیچتے وقت ( رشتہ دار ) قیدیوں کے درمیان جدائی ڈالنے کو ناجائز کہا ہے، ۳- اور بعض اہل علم نے ان لڑکوں کے درمیان جدائی کو جائز قرار دیا ہے جو سر زمین اسلام میں پیدا ہوئے ہیں۔ پہلا قول ہی زیادہ صحیح ہے، ۴- ابراہیم نخعی سے مروی ہے کہ انہوں نے بیچتے وقت ماں اور اس کے لڑکے کے درمیان تفریق، چنانچہ ان پر یہ اعتراض کیا گیا تو انہوں نے کہا: میں نے اس کی ماں سے اس کی اجازت مانگی تو وہ اس پر راضی ہے۔
Narrated 'Ali : The Messenger of Allah (ﷺ) gave me two boys who were brothers, so I sold one of them, and the Messenger of Allah (ﷺ) said to me: 'O, 'Ali! What happened to your boy?' So I informed him, and he said: 'Return him, return him.' [Abu 'Eisa said:] This Hadith is Hasan Gharib. Some of the people of knowledge among the Companions of the Prophet (ﷺ) and others, disliked separating between the captives when selling them. Some of the people of knowledge permitted separating the children that were born in the land of Islam, but the first view is more correct. It has been related that Ibrahim An-Nakha'i seperated a mother and her child in a sale, so he was asked about that. He said: I sought her permission for that and she approved

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
