حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ الْحَسَنِ، عَنْ سَمُرَةَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: عَلَى الْيَدِ مَا أَخَذَتْ حَتَّى تُؤَدِّيَ . قَالَ قَتَادَةُ: ثُمَّ نَسِيَ الْحَسَنُ، فَقَالَ: فَهُوَ أَمِينُكَ لَا ضَمَانَ عَلَيْهِ، يَعْنِي الْعَارِيَةَ . قَالَ أَبُو عِيسَى: هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، وَقَدْ ذَهَبَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، إِلَى هَذَا وَقَالُوا: يَضْمَنُ صَاحِبُ الْعَارِيَةِ، وَهُوَ قَوْلُ: الشَّافِعِيِّ، وَأَحْمَدَ، وقَالَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ: لَيْسَ عَلَى صَاحِبِ الْعَارِيَةِ ضَمَانٌ، إِلَّا أَنْ يُخَالِفَ، وَهُوَ قَوْلُ: الْثَّوْرِيِّ، وَأَهْلِ الْكُوفَةِ، وَبِهِ يَقُولُ إِسْحَاق.
سمرہ رضی الله عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”جو کچھ ہاتھ نے لیا ہے جب تک وہ اسے ادا نہ کر دے اس کے ذمہ ہے“ ۱؎، قتادہ کہتے ہیں: پھر حسن بصری اس حدیث کو بھول گئے اور کہنے لگے ”جس نے عاریت لی ہے“ وہ تیرا امین ہے، اس پر تاوان نہیں ہے، یعنی عاریت لی ہوئی چیز تلف ہونے پر تاوان نہیں ہے۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- صحابہ کرام وغیرہم میں سے بعض اہل علم اسی طرف گئے ہیں یہ لوگ کہتے ہیں: عاریۃً لینے والا ضامن ہوتا ہے۔ اور یہی شافعی اور احمد کا بھی قول ہے، ۳- صحابہ کرام وغیرہم میں سے بعض اہل علم کہتے ہیں کہ عاریت لینے والے پر تاوان نہیں ہے، الا یہ کہ وہ سامان والے کی مخالفت کرے۔ ثوری اور اہل کوفہ کا یہی قول ہے اور اسحاق بن راہویہ بھی اسی کے قائل ہیں۔
Narrated Qatadah: From Al-Hasan, from Samurah, that the Prophet (ﷺ) said: Upon the hand is what it took, until it is returned. Qatadah said: Then Al-Hasan forgot, so he said: 'It is something you entrusted, he is not liable for it.' Meaning the borrowed property. [Abu 'Eisa said:] This Hadith is Hasan Sahih. Some of the people pf knowledge, among the Companions of the Prophet (ﷺ) and others, followed this Hadith. They said that the possessor of the borrowed thing is liable. This is the view of Ash-Shafi'i and Ahmad. Some of the people of knowledge among the Companions and others said that the possessor of the borrowed this is not liable unless there is dispute. This is the view of Sufyan Ath-Thawri and the people of Al-Kufah, and it is the view of Ishaq.

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
