حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا وَكِيعٌ، عَنْ زَكَرِيَّا، عَنْ الشَّعْبِيِّ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، أَنَّهُ بَاعَ مِنَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعِيرًا، وَاشْتَرَطَ ظَهْرَهُ إِلَى أَهْلِهِ . قَالَ أَبُو عِيسَى: هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ، عَنْ جَابِرٍ، وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، يَرَوْنَ الشَّرْطَ فِي الْبَيْعِ جَائِزًا، إِذَا كَانَ شَرْطًا وَاحِدًا، وَهُوَ قَوْلُ:، أَحْمَدَ، وَإِسْحَاق، وقَالَ بَعْضُ أَهْلِ الْعِلْمِ: لَا يَجُوزُ الشَّرْطُ فِي الْبَيْعِ وَلَا يَتِمُّ الْبَيْعُ إِذَا كَانَ فِيهِ شَرْطٌ.
جابر بن عبداللہ رضی الله عنہما کہتے ہیں کہ انہوں نے ( راستے میں ) نبی اکرم صلی اللہ علیہ وسلم سے ایک اونٹ بیچا اور اپنے گھر والوں تک سوار ہو کر جانے کی شرط رکھی لگائی ۱؎۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- یہ اور بھی سندوں سے جابر سے مروی ہے، ۳- صحابہ کرام وغیرہم میں سے بعض اہل علم کا اسی پر عمل ہے۔ یہ لوگ بیع میں شرط کو جائز سمجھتے ہیں جب شرط ایک ہو۔ یہی قول احمد اور اسحاق بن راہویہ کا ہے، ۴- اور بعض اہل علم کہتے ہیں کہ بیع میں شرط جائز نہیں ہے اور جب اس میں شرط ہو تو بیع تام نہیں ہو گی۔
Narrated Jabir bin ‘Abdullah : That he sold a camel to the Prophet (ﷺ) and made a condition that he could ride it to (return to) his family. [Abu 'Eisa said:] This Hadith is Hasan Sahih. It has been reported through other routes from Jabir. This is acted upon according to some of the people of knowledge among the Companions of the Prophet (ﷺ) and others. They consider it allowed to make a condition in a sale when it is one condition. This is the view of Ahmad and Ishaq. Some of the people of knowledge said that it is not allowed to make a condition in a sale, nor to complete a sale when there is a condition for it.

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
