حَدَّثَنَا يُوسُفُ بْنُ حَمَّادٍ الْبَصْرِيُّ، حَدَّثَنَا عَبْدُ الْأَعْلَى بْنُ عَبْدِ الْأَعْلَى، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ أَنَسٍ، أَنَّ رَجُلًا كَانَ فِي عُقْدَتِهِ ضَعْفٌ، وَكَانَ يُبَايِعُ، وَأَنَّ أَهْلَهُ أَتَوْا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالُوا: يَا رَسُولَ اللَّهِ، احْجُرْ عَلَيْهِ، فَدَعَاهُ نَبِيُّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَنَهَاهُ، فَقَالَ: يَا رَسُولَ اللَّهِ، إِنِّي لَا أَصْبِرُ عَنِ الْبَيْعِ، فَقَالَ: إِذَا بَايَعْتَ فَقُلْ: هَاءَ وَهَاءَ، وَلَا خِلَابَةَ . قَالَ أَبُو عِيسَى: وَفِي الْبَاب، عَنْ ابْنِ عُمَرَ. وَحَدِيثُ أَنَسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ، وَقَالُوا: الْحَجْرُ عَلَى الرَّجُلِ الْحُرِّ فِي الْبَيْعِ وَالشِّرَاءِ إِذَا كَانَ ضَعِيفَ الْعَقْلِ، وَهُوَ قَوْلُ: أَحْمَدَ، وَإِسْحَاق، وَلَمْ يَرَ بَعْضُهُمْ أَنْ يُحْجَرَ عَلَى الْحُرِّ الْبَالِغِ.
انس رضی الله عنہ کہتے ہیں کہ ایک آدمی خرید و فروخت کرنے میں بودا ۱؎ تھا اور وہ ( اکثر ) خرید و فروخت کرتا تھا، اس کے گھر والے نبی اکرم صلی اللہ علیہ وسلم کے پاس آئے اور ان لوگوں نے عرض کیا: اللہ کے رسول! آپ اس کو ( خرید و فروخت سے ) روک دیجئیے، تو نبی اکرم صلی اللہ علیہ وسلم نے اس کو بلوایا اور اسے اس سے منع فرما دیا۔ اس نے عرض کیا: اللہ کے رسول! میں بیع سے باز رہنے پر صبر نہیں کر سکوں گا، آپ نے فرمایا: ” ( اچھا ) جب تم بیع کرو تو یہ کہہ لیا کرو کہ ایک ہاتھ سے دو اور دوسرے ہاتھ سے لو اور کوئی دھوکہ دھڑی نہیں ۲؎“۔ امام ترمذی کہتے ہیں: ۱- انس کی حدیث حسن صحیح غریب ہے، ۲- اس باب میں ابن عمر رضی الله عنہما سے بھی روایت ہے، ۳- بعض اہل علم کا اسی حدیث پر عمل ہے، وہ کہتے ہیں کہ آزاد شخص کو خرید و فروخت سے اس وقت روکا جا سکتا ہے جب وہ ضعیف العقل ہو، یہی احمد اور اسحاق بن راہویہ کا بھی قول ہے، ۴- اور بعض لوگ آزاد بالغ کو بیع سے روکنے کو درست نہیں سمجھتے ہیں ۳؎۔
Narrated Anas: That there was a man who was not very sensible and he would make purchases. So his family came to the Prophet (ﷺ) and said: O Messenger of Allah! Stop him (from making purchases). So Allah's Prophet (ﷺ) called him to prohibit him, and he said: O Messenger of Allah! I have no patience for business. So he said: When you are buying, say: 'Hand to hand, and no cheating.' [Abu 'Eisa said:] There is a narration on this topic from Ibn 'Umar. The Hadith of Anas is a Hasan Sahih Gharib Hadith. This is acted upon according to the people of knowledge. They say that the free man can be prevented from selling and buying when his intellect is weak. This is the view of Ahmad and Ishaq. Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
