حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ الْخَلَّالُ، وَعَبْدَةُ بْنُ عَبْدِ اللَّهِ الْخُزَاعِيُّ الْبَصْرِيُّ أَبُو سَهْلٍ، وَغَيْرُ وَاحِدٍ، قَالُوا: حَدَّثَنَا عَبْدُ الصَّمَدِ بْنُ عَبْدِ الْوَارِثِ، عَنْ يَزِيدَ بْنِ إِبْرَاهِيمَ، عَنْ ابْنِ سِيرِينَ، عَنْ أَيُّوبَ، عَنْ يُوسُفَ بْنِ مَاهَكَ، عَنْ حَكِيمِ بْنِ حِزَامٍ، قَالَ: نَهَانِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ أَبِيعَ مَا لَيْسَ عِنْدِي . قَالَ أَبُو عِيسَى: وَرَوَى وَكِيعٌ هَذَا الْحَدِيثَ، عَنْ يَزِيدَ بْنِ إِبْرَاهِيمَ L8387، عَنْ ابْنِ سِيرِينَ L7016، عَنْ أَيُّوبَ L746، عَنْ حَكِيمِ بْنِ حِزَامٍ L2468 وَلَمْ يَذْكُرْ فِيهِ، عَنْ يُوسُفَ بْنِ مَاهَكَ، وَرِوَايَةُ عَبْدِ الصَّمَدِ أَصَحُّ وَقَدْ رَوَى يَحْيَى بْنُ أَبِي كَثِيرٍ L8208 هَذَا الْحَدِيثَ، عَنْ يَعْلَى بْنِ حَكِيمٍ L8546، عَنْ يُوسُفَ بْنِ مَاهَكَ L8584، عَنْ عَبْدِ اللَّهِ بْنِ عِصْمَةَ L4953، عَنْ حَكِيمِ بْنِ حِزَامٍ L2468، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ، كَرِهُوا أَنْ يَبِيعَ الرَّجُلُ مَا لَيْسَ عِنْدَهُ.
حکیم بن حزام رضی الله عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے مجھے اس چیز کے بیچنے سے منع فرمایا ہے جو میرے پاس نہیں ہے۔ امام ترمذی کہتے ہیں: ۱- وکیع نے اس حدیث کو بطریق: «عن يزيد بن إبراهيم عن ابن سيرين عن أيوب عن حكيم بن حزام» روایت کیا ہے اور اس میں یوسف بن ماہک کے واسطے کا ذکر نہیں کیا ہے۔ عبدالصمد کی روایت زیادہ صحیح ہے ( جس میں ابن سیرین کا ذکر ہے ) ۔ اور یحییٰ بن ابی کثیر نے یہ حدیث بطریق: «عن يعلى بن حكيم عن يوسف بن ماهك عن عبد الله بن عصمة عن حكيم بن حزام عن النبي صلى الله عليه وسلم» روایت کیا ہے، ۲- اکثر اہل علم کا اسی حدیث پر عمل ہے، یہ لوگ اس چیز کی بیع کو مکروہ سمجھتے ہیں جو آدمی کے پاس نہ ہو۔
Narrated Hakim b. Hizam: The Messenger of Allah (ﷺ) prohibited me from selling what was not with me. [Abu 'Eisa said:] Waki' reported this Hadith from Yazid bin Ibrahim, from Ibn Sirin, from Ayyub, from Hakim bin Hizam, and he did not mention in it: From Yusuf bin Mahak. And the narration of 'Abdus-Samad (a narrator in the chain of Hadith no. 1235) is more correct. Yahya bin Abi Kathir reported this Hadith from Ya'la bin Hakim, from Yusuf bin Mahak, from 'Abdullah bin 'Ismah, from Hakim bin Hizam, from the Prophet (ﷺ). This Hadith is acted upon according to most of the people of knowledge, they dislike for a man to sell what is not with him.

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
