حَدَّثَنَا أَبُو كُرَيْبٍ، أَنْبَأَنَا أَبُو أُسَامَةَ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، عَنْ أَبِي الزِّنَادِ، عَنْ الْأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعِ الْغَرَرِ، وَبَيْعِ الْحَصَاةِ . قَالَ: وَفِي الْبَاب، عَنْ ابْنِ عُمَرَ، وَابْنِ عَبَّاسٍ، وَأَبِي سَعِيدٍ، وَأَنَسٍ. قَالَ أَبُو عِيسَى: حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ، وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ أَهْلِ الْعِلْمِ كَرِهُوا بَيْعَ الْغَرَرِ، قَالَ الشَّافِعِيُّ: وَمِنْ بُيُوعِ الْغَرَرِ بَيْعُ السَّمَكِ فِي الْمَاءِ، وَبَيْعُ الْعَبْدِ الْآبِقِ، وَبَيْعُ الطَّيْرِ فِي السَّمَاءِ وَنَحْوُ ذَلِكَ مِنَ الْبُيُوعِ، وَمَعْنَى بَيْعِ الْحَصَاةِ: أَنْ يَقُولَ الْبَائِعُ لِلْمُشْتَرِي: إِذَا نَبَذْتُ إِلَيْكَ بِالْحَصَاةِ، فَقَدْ وَجَبَ الْبَيْعُ فِيمَا بَيْنِي وَبَيْنَكَ وَهَذَا شَبِيهٌ بِبَيْعِ الْمُنَابَذَةِ، وَكَانَ هَذَا مِنْ بُيُوعِ أَهْلِ الْجَاهِلِيَّةِ.
ابوہریرہ رضی الله عنہ کہتے ہیں کہ رسول اللہ صلی اللہ علیہ وسلم نے بیع غرر ۱؎ اور بیع حصاۃ سے منع فرمایا ہے۔ امام ترمذی کہتے ہیں: ۱- ابوہریرہ رضی الله عنہ کی حدیث حسن صحیح ہے، ۲- اس باب میں ابن عمر، ابن عباس، ابوسعید اور انس رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- اہل علم کا اسی حدیث پر عمل ہے، وہ بیع غرر کو مکروہ سمجھتے ہیں، ۴- شافعی کہتے ہیں: مچھلی کی بیع جو پانی میں ہو، بھاگے ہوئے غلام کی بیع، آسمان میں اڑتے پرندوں کی بیع اور اسی طرح کی دوسری بیع، بیع غرر کی قبیل سے ہیں، ۵- اور بیع حصاۃ سے مراد یہ ہے کہ بیچنے والا خریدنے والے سے یہ کہے کہ جب میں تیری طرف کنکری پھینک دوں تو میرے اور تیرے درمیان میں بیع واجب ہو گئی۔ یہ بیع منابذہ کے مشابہ ہے۔ اور یہ جاہلیت کی بیع کی قسموں میں سے ایک قسم تھی۔
Narrated Abu Hurairah: The Messenger of Allah (ﷺ) prohibited the Gharar sale, and the Hasah sale. [He said:] There are narrations on this topic from Ibn 'Umar, Ibn 'Abbas, Abu Sa'eed, and Anas. [Abu 'Eisa said:] This Hadith of Abu Hurairah is Hasan Sahih Hadith. This Hadith is acted upon according to the people of knowledge, they dislike the Gharar. Ash-Shafi'i said: The Gharar sale includes selling fish that are in the wate, selling a slave that has escaped, selling birds that are in the sky, and similar type of sales. And the meaning of Hasah sale is when the seller says to the buyer: 'When I toss the pebble at you, then the sale between you and I is final.' This resembles the sale of Munabadhah and this is one of the selling practices of the people of Jahiliyyah.

Hadith 1205
An-Numan bin Bashir narrated that the Messenger of Allah (S) said: The lawful is clear and the unlawful is clear, and between that are matters that are doubtful (not clear); many of the people do not know whether it is lawful or unlawful. So whoever leaves it to protect his religion and his honor, then he will be safe, and whoever falls into something from them, then he soon will have fallen into the unlawful. Just like if someone grazes (his animals) around a sanctuary, he would soon wind up in it. Indeed for every king is a sanctuary (pasture), and indeed Allah's sanctuary is what He made unlawful.
