حَدَّثَنَا أَبُو عَمَّارٍ الْحُسَيْنُ بْنُ حُرَيْثٍ، حَدَّثَنَا مُحَمَّدُ بْنُ يَزِيدَ الْوَاسِطِيُّ، عَنْ إِسْمَاعِيل بْنِ مُسْلِمٍ الْمَكِّيِّ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: الطِّفْلُ لَا يُصَلَّى عَلَيْهِ، وَلَا يَرِثُ وَلَا يُورَثُ حَتَّى يَسْتَهِلَّ . قَالَ أَبُو عِيسَى: هَذَا حَدِيثٌ قَدِ اضْطَرَبَ النَّاسُ فِيهِ، فَرَوَاهُ بَعْضُهُمْ عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَرْفُوعًا، وَرَوَى أَشْعَثُ بْنُ سَوَّارٍ، وَغَيْرُ وَاحِدٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ مَوْقُوفًا، وَرَوَى مُحَمَّدُ بْنُ إِسْحَاق، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، عَنْ جَابِرٍ مَوْقُوفًا، وَكَأَنَّ هَذَا أَصَحُّ مِنَ الْحَدِيثِ الْمَرْفُوعِ، وَقَدْ ذَهَبَ بَعْضُ أَهْلِ الْعِلْمِ إِلَى هَذَا، قَالُوا: لَا يُصَلَّى عَلَى الطِّفْلِ حَتَّى يَسْتَهِلَّ، وَهُوَ قَوْلُ: سُفْيَانَ الثَّوْرِيِّ، وَالشَّافِعِيِّ.
جابر رضی الله عنہ سے روایت ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”بچے کی نماز ( جنازہ ) نہیں پڑھی جائے گی۔ نہ وہ کسی کا وارث ہو گا اور نہ کوئی اس کا وارث ہو گا جب تک کہ وہ پیدائش کے وقت روئے نہیں“۔ امام ترمذی کہتے ہیں: ۱- اس حدیث میں لوگ اضطراب کے شکار ہوئے ہیں۔ بعض نے اِسے ابو الزبیر سے اور ابو الزبیر نے جابر سے اور جابر نے نبی اکرم صلی اللہ علیہ وسلم سے مرفوعاً روایت کیا ہے، اور اشعث بن سوار اور دیگر کئی لوگوں نے ابو الزبیر سے اور ابو الزبیر نے جابر سے موقوفاً روایت کی ہے، اور محمد بن اسحاق نے عطاء بن ابی رباح سے اور عطاء نے جابر سے موقوفاً روایت کی ہے گویا موقوف روایت مرفوع روایت سے زیادہ صحیح ہے، ۲- بعض اہل علم اسی طرف گئے ہیں، وہ کہتے ہیں کہ بچے کی نماز جنازہ نہیں پڑھی جائے گی۔ جب تک کہ وہ پیدائش کے وقت نہ روئے یہی سفیان ثوری اور شافعی کا قول ہے۔
Jabir narrated that: The Prophet said: The child is not prayed over, nor does he inherit, nor is he inherited from until one is sure he was alive at birth.

Thuwair [and he is Ibn Abi Fakhitah] narrated that : His father said: Ali took me by the hand and said: 'Come with us to pay a visit to Al-Hasan.' So we found that Abu Musa was with him.' Ali - peace be upon him - said: 'O Abu Musa! Did you come to visit (the sick) or merely (stop by to) visit?' He said: 'No, to visit (the sick).' So Ali said: 'I heard the Messenger of Allah saying: No Muslim visits (the sick) Muslims in the morning, except that sevety-thousand angels, sent Salat upon him until the evening, and he does not visit at night except that seventy thousand angels sent Salat upon him until the morning, and there will be a garden for him in Paradise.
